DOUGLAS STREET PETALUMA ECUMENICAL PROPERTIES; 200 Douglas Street; AP No. (portion of) 008 - 161 -014; File No. REZO1001; Planner: Tiffany Robbe Commissioner Barrett reclused herself because she resides within 300' of noticing area. Tiffany Robbe presented the staff report. Dick Lieb - Applicant representative- described project; current PEP residents in other properties have very few cars, only 4 bicycles; does not want bicycles on sidewalk - a hazard; this is a great site, near all; Steve LaFranchi (project engineer) available for questions on drainage. Superintendent of Schools office right at this site - any problems caused by students are taken care of very quickly. School District held a neighborhood meeting. PEP held a neighborhood meeting - only one person attended. Chair Glass - If this project approved with staff report as written, would you be happy? Dick Lieb - Yes. Commissioner Vouri - Where will construction equipment /trailer be parked? Dick Lieb - At easement side of project allowing access through easement; it will be fenced; it will be a clean site. Commissioner Vouri — If the donut shop leaves, you want to remove the speed table? Dick Lieb — No, speed tables will limit speed. Wants to remove cross walk striping and side walk from speed table to donut shop and replace one parking space if donut shop leaves. The public hearing was opened. Diane Buckley — 250 Douglas Across from this project, would like to see speed decks left in; wants to see what project looks like; where is project in relation to neighbors? Doesn't know much about PEP - will it be for seniors in perpetuity? (Answer, yes.) April Conteo - 19 Spring Street - concerns with traffic on Spring — which street will traffic be encouraged to use? Dick Lieb — This project is a very low traffic generator; right -of -way use for public, not a public street but will be a public right -of -way; not very many deliveries, residents are on a fixed income; services provided will not bring more traffic; existing projects are very neighbor - friendly. Walter Laabs - Traffic Engineer - traffic will primarily be using Douglas Street. Commissioner O'Brien - Very good staff report - all questions answered; great use of property; everything in here is a positive; Commissioner Vouri - Why was hairpin median proposed to be removed? Tiffany Robbe — So that the apartments are on an accessway with more of a "street- feel" The speed table will slow traffic in same way with more residential feel. Commissioner O'Brien — School District should also receive kudos. 2 I The public hearing was closed. 2 3 A motion was made by Commissioner O'Brien and seconded by Commissioner Monteschio to 4 recommend adoption of a Mitigated Negative Declaration, to approve a Rezoning to PUD 5 (Planned Unit District) and to approve the PUD Development Standards subject to the following 6 findings and amended conditions (and recommending a condition that the crosswalk striping may 7 be removed if the donut shop leaves). 8 9 Commissioner Barrett: Abstain 10 Commissioner Dargie: Yes 11 Commissioner Monteschio: Yes 12 Commissioner O'Brien: Yes 13 Commissioner Vouri: Yes 14 Chair Glass: Yes 15 16 Findings for Approval of a Mitigated Negative Declaration 17 18 1. An Initial Study was prepared and demonstrated that there is no substantial evidence 19 that supports a fair argument that the project, as conditioned, would have a significant 20 effect on the environment. 21 22 2. The project does not have the potential to affect wildlife resources as defined in the 23 State Fish and Game Code, either individually or cumulatively, and is exempt from 24 Fish and Game filing fees because it is proposed on an small undeveloped site 25 . surrounded by development with none of the resources as defined in the Code. 26 27 3. The project is not located on a site listed on any Hazardous Waste Site List compiled 28 by the State pursuant to Section 65962.5 of the California Government Code. 29 30 4. The Planning Commission reviewed the Initial Study and considered public 31 comments before making a recommendation on the project. 32 33 5. A Mitigation Monitoring Program has been prepared to ensure compliance with the 34 adopted mitigation measures. 35 36 6. The record of proceedings of the decision on the project is available for public review 37 at the City of Petaluma Plamring Division, City Hall, 11 English Street, Petaluma, 38 California. 39 40 Findings of Approval for Rezoning from Administrative and Professional Office (C -0) to 41 Planned Unit District (PUD) 42 43 1. The proposed Amendment to Zoning Ordinance No. 1072 N.C.S., to classify and rezone 44 the subject parcel from Administrative and Professional Office (C -O) to Planned Unit 45 District (PUD) will result in a more desirable use of land and a better physical 46 environment than would be possible under any single zoning district or combination of 47 zoning districts in that the proposed uses comply with the Planned Unit District 3 I designation, which allows inclusion within its boundaries density, building intensity, or 2 design characteristics, which would not normally be permitted in a single use district and 3 which governs the development of residential projects. Additionally, this proposal 4 incorporates the policies and guidelines of the PUD- Planned Unit District of Article 19A 5 of the Zoning Ordinance. 6 7 2. The public necessity, convenience and welfare clearly permit and will be furthered by the 8 proposed Amendment to the Zoning Ordinance, reclassifying and rezoning the 9 undeveloped 0.84 portion of the site to Planned Unit District in that the PUD will result 10 in the provision of housing units which are affordable to low and very low- income 11 seniors. 12 13 1. The PUD is proposed on property which has a suitable relationship to one or more 14 thoroughfares (Douglas Street and Baker Street); and said thoroughfares are adequate to 15 carry any additional traffic generated by the development. 16 17 2. The development of the subject property, in the manner proposed by the applicant, will 18 not be detrimental to the public welfare, will be in the best interests of the City, and will 19 be in keeping with the general intent and spirit of the zoning regulations of the City of 20 Petaluma and with the Petaluma General Plan because the project provides housing 21 consistent with the City's housing objectives and goals, and the project will be located on 22 a site near services and bus routes. 23 24 3. The development of the subject property, in the manner proposed by the applicant and 25 conditionally approved, shall provide affordable housing in perpetuity for low and very 26 low - income seniors. 27 28 4. The requirements of the California Environmental Quality Act (CEQA) have been 29 satisfied through the preparation of an Initial Study and the drafting. of a Mitigated 30 Negative Declaration to avoid or reduce to a level of insignificance, potential impacts 31 generated by the proposed PEP Douglas Street Planned Unit District. In compliance with 32 the requirements of the California Environmental Quality Act, an Initial Study was 33 prepared for the rezoning of the site from Administrative and Professional Office (C -O) 34 to Planned Unit District (PUD). Based upon the Initial Study, a determination was made 35 that no significant environmental impacts would result. A copy of this notice was 36 published in the Argus Courier and provided to residents and occupants within 300 feet 37 of the site, in compliance with CEQA requirements. 38 39 From the Planning Division: 40 41 1. Plans submitted for building permit shall include a plan sheet, which shall contain all 42 Conditions of Approval and Mitigation Measures verbatim. 43 44 2. The plans submitted for building permit review shall be in substantial compliance with 45 the plans dated June 4, 2001. 46 4 1 3. All Mitigation Measures adopted in conjunction with the Mitigated Negative Declaration 2 for the PEP Douglas Street project are herein incorporated by reference as conditions of 3 project approval. 4 5 4. Upon approval by the City Council, the applicant shall pay the $35.00 Notice of 6 Determination fee to the Planning Division. The check shall be made payable to the 7 County Clerk. Planning staff will file the Notice of Determination with the County 8 Clerks office within five (5) days after receiving Council approval. 9 10 5. Prior to issuance of a building permit, the project shall obtain SPARC approval. 11 12 6. Prior to issuance of a building permit, the project sponsor shall execute a binding 13 agreement with the City of Petaluma insuring that the occupancy of the 22 units shall be 14 held in perpetuity for low and very-low income persons 62 years of age or older. 15 16 7. Prior to issuance of a building permit, the plans shall be revised to show two flat top 17 speed tables as per the standards described in Walt Laabs, TJKM's Memorandum dated 18 July 6, 2001. The southerly of these two speed tables shall be striped as a crosswalk. 19 The existing speed bumps shall be removed. 20 21 8. Prior to issuance of a building permit, the plans shall be revised to depict at least two 22 covered bicycle parking spaces located either at an outside entrance or inside the fence 23 near the community room. 24 25 9. The applicant shall be required to utilize Best Management Practices regarding 26 pesticide/herbicide use and fully commit to Integrated Pest Management techniques for 27 the protection of pedestrian/bicyclists. The applicant shall be required to post signs when 28 pesticide/herbicide use occurs to warn pedestrians and bicyclists. 29 30 10. The site elevator shall be accessible to residents only by use of a key card or key to 31 prohibit non - residents access. If key coded, knox box shall be installed for emergency 32 personnel. 33 34 11. The required parking shall be designated for residences only by way of a small sign or 35 asphalt painting. 36 37 12. A small "No Trespassing" sign shall be posted on all entrance gates. 38 39 13. Emergency contact information shall be forwarded to Petaluma Police Department with 40 at least three contact persons listed. 41 42 14. Prior to issuance of a building permit, temporary protective fencing shall be erected 5 feet 43 outside the drip line of the three trees along the northwesterly property line. The fencing 44 shall be a minimum of 5 feet in height and shall be secured with in- ground posts subject 45 to staff inspection. Fencing shall be installed prior to grading permit issuance and any 5 I grading /construction activity. Proof that the temporary fencing has been installed shall 2 be made to the Planning Division by photographs. 3 4 15. - Plans submitted for building permit shall include an exterior lighting plan. Said plan 5 shall include a detail of the types of all fixtures to be installed for review and approval by 6 the planning staff in regards to the Site Plan and Architectural Review standards for 7 lighting and shall be hooded and project downward, providing a soft "wash" of light. 8 9 16. Prior to issuance of a building permit, the plans shall be modified to accommodate 10 recycling containers in the interiors of the units. 11 12 17. All construction activities shall be limited to 7:00 a.m. to 5:30 p.m. Monday through 13 Friday and 9 :00 a.m. to 5:00 p.m. on Saturdays. Construction shall be prohibited on 14 Sundays and all holidays recognized by the City of Petaluma, unless a permit is first 15 secured from the City Manager (or his/her designee) for additional hours. There will be 16 no start up of machines nor equipment prior to 8:00 a.m., Monday through Friday; no 17 delivery of materials nor equipment prior to 7:30 a.m. nor past 5:00 p.m., Monday 18 through Friday; no servicing of equipment past 5:30 p.m., Monday through Friday. 19 20 18. Should the donut shop leave and not be replaced by a similar use, the crosswalk striping 21 and the sidewalk from speed table to donut shop may be removed to allow for one more 22 parking space. 23 24 From the Engineering Division: 25 26 19. To create a separate parcel as indicated on the application site plan, the developer shall 27 submit an application for a tentative parcel map and record a parcel map prior to 28 building permit application. 29 30 20. The necessary access, utility, and drainage easements shall be granted at the time of the 31 parcel map. 32 33 21. Parking and backup dimensions shall be per City parking standards. 34 35 22. The proposed buildings shall be served by underground electrical and telecommunication 36 facilities. 37 38 23. • Lot -to -Lot surface drainage shall not be allowed unless contained in an easement and 39 storm drain system. 40 41 24. The applicant shall propose a solution to the drainage issue at the end of Baker Street 42 which ,shall be reviewed and approved by the Engineering Section. 43 44 25. The construction contractor shall incorporate the , following measures into the required Erosion and Sediment Control Plan to limit fugitive dust and exhaust emissions during construction. a. Grading and construction equipment operated during construction activities shall be properly mufflered and maintained to minimize emissions. Equipment shall be turned off when not in use. b. Exposed soils shall be watered a minimum of twice daily during construction. The frequency of watering shall be increased if wind speeds exceed 15 mph. C. The construction site shall provide a gravel pad area consisting of an impermeable liner and drain rock at the construction entrance to clean mud and debris from construction vehicles prior to entering the public roadways. Street surfaces in the vicinity of the project shall be routinely swept and cleaned of mud and dust carried onto the street by construction vehicles. d. During excavation activities, haul trucks used to transport soil shall utilize tarps or other similar covering devices to reduce dust emissions. From the Water Resources Department: 27. All Sewer and Storm drain lines on this property up to the point of connection at the manholes shall be private. 28. Prior to issuance of building permit, the applicant shall supply water G.P.M. requirements to determine service and meter size. 29. Individual water services with backflow devices shall be provided for each unit. Domestic and fire protection water connections shall be installed per City Standards. 30. A drop inlet shall be installed and the curb, gutter, and sidewalk shall be replaced at the end of Baker Street. From the Fire Marshal: 31. Provide one 2AIOBC rated fire extinguisher for each 3000 square feet. There shall be no more than 75 feet travel distance from any location to a fire extinguisher. 32. Post address numbers on or near main entry door. Numbers to be a minimum of four inches high with contrasting background. Must be legible and visible from street. 33. Pursuant to Ordinance 2084 any residence submitted after July 1, 2000, is required to be sprinklered. The buildings shall be protected by an automatic fire sprinkler system as required by the Uniform Fire Code and shall be provided with central station alarm monitoring, which shall notify the fire department in the event of water flow. In addition, a local alarm shall be provided on the exterior and interior of the building. 34. Contractors installing underground fire sprinkler mains shall obtain a permit and submit 2 sets of plans for approval prior to commencing work. A hydrostatic test of 200 psi for 7 I two hours is required prior to backfill. All joints shall be visible at time of inspection. 2 Underground installations shall be flushed to fire department satisfaction prior to 3 connection to overhead. NOTE: Civil utility plans and /or other plans approved, or not, 4 will not be accepted in lieu of the above requirement. 5 6 35. Contractors shall obtain Petaluma City Water Department approval prior to charging 7 onsite underground water mains. 8 9 36. All contractors shall have a city business license and a workers compensation certificate 10 on file with the Fire Marshal's office. 11 12 37. Contractors shall submit to the Fire Marshal's office evidence that the required fire flow 13 of gpms is available at the proposed structure. 14 15 38. All contractors performing work on fire sprinkler systems, either overhead systems or 16 underground fire service mains, shall have a C -16 Contractors License. 17 18 39. Activation of the fire sprinkler system shall sound an interior alarm that will notify all 19 occupied spaces. 20 21 40. For future plan reviews, please provide fully scaled plans. If plans of building/s are not to 22 scale, they will be refused and/or denied and returned. 23 24 41. Sprinklers shall be installed at overhangs and concealed spaces per NFPA 13, Chapter 4. 25 26 42. Provide an approved fire alarm system to monitor tamper switch and water flow switch 27 on the sprinkler system. 28 29 43. Fire alarm system shall be connected to a central station monitor which will notify the 30 fire department in the event of an alarm. 31 32 44. Contractor shall provide the Fire Marshal's office with two (2) sets of plans for the 33 underground fire service main for permit approval, prior to commencement of work. 34 35 45. Fire alarm system shall be installed in accordance with NFPA 72, 1998 California 36 Building Code, 1998 California Fire Code Sections 1003 and 1007. 37 38 46. Provide strobe/horns in bedrooms and strobes only in living/dining area. 39 40 47. CITY DE PETALUMA HOUSING ELEMENT REVIEW. Review the following Housing Policy Documents; provide recommendations to staff; refer to City Council for adoption (Bonne Gaebler, Hoiusing Administrator). Draft 1999 — 2006 Housing Element Draft Petaluma Area Chamber of Commerce Workforce Housing Taskforce Report. Bonne Gaebler presented the staff report. Commissioner Barrett - Regarding Attachment 2 - Policy Modifications - clarify difference between programs 10 and 11 - was that just done with Workforce Housing? (Yes); page 8 -9, numbers 1 and 2 are the same; what happened to Programs 23 to 29 on same page? (Numbering error ?), Number 1 on Page 2, regarding In -Lieu Housing Fees increase - could that be a certain percentage? Commissioners Glass and Barrett — Suggested that developments doing less than 5 houses should also contribute into housing fund on a percentage basis. Commissioner Dargie — Question regarding modifying Growth Management Allocations. Bonne Gaebler — That program has not been implemented for the last two years. Pamela Tuft - Growth Management Allocation System was in place to allow smaller projects to develop without problems. Bonne Gaebler — County sponsored "nexus" study behind schedule. Chair Glass Attachment 2 - regarding mobilehome rent control policy - could we look at strengthening this policy? Rohnert Park or Cotati have ordinances which the rent increases to Social Security increases. Commissioner O'Brien - Candlewood residents were at City Council at last meeting - City Council will be looking at our rent stabilization policy. Commissioner Barrett - Should we discuss Workforce Housing Taskforce Report - would like to be specific on comments recommended to City Council. Bonne Gaebler - If in general, Planning Commission thinks recommendations should be included, Housing, General Plan and Planning staff will collaborate to develop appropriate language. WASHINGTON CREEK VILLAGE by Cobblestone Homes; E. Washington Street; 5 AP No. 149 - 180 -015 and 016; File No.'s TSM01001 and ZOA01001; Planner: 6 Tiffany Robbe. 7 8 The applicant proposes to subdivide a 9.23 acre parcel on East Washington Street 9 southwest of Prince Park into 37 single - family residential lots and to adopt Planned Unit 10 District development guidelines for the subdivision. The project also proposes the 11 dedication of 1.8 acres of creekside property to the City as open space. 12 13 Tiffany Robbe presented the staff report. 14 15 Commissioner O'Brien — Question (to Police Dept.) — can bicycle path be adequately patrolled? 16 Cindy Fahy — Petaluma Police - Path should be wide enough for emergency access, path 17 recommended on north side instead of south side for sight. 18 Bruce Aspinall - Planning Consultant - Cobblestone Homes - Complemented Tiffany Robbe on 19 staff report - very clear; classic in -fill site; north of site - Willow Glen, west - Alderwood 20 Subdivision; Prince Park and Washington Creek bisects site; site constraints dictated design; 21 overall density 4 units per acre; 3 bike paths incorporated into plan; all 7 changes asked for by 22 SPARC have been incorporated into proposal; held a neighborhood meeting (20 -25 people in 23 attendance) - concerns included flooding and increased traffic; Traffic Study prepared by Alan 24 Tilton of W- Trans; had not been aware of flooding in this area in past - when water gets high in 25 creek, depression area fills and can threaten Alderwood Subdivision; discuss filling depression - 26 would require a revised environmental document; from Corps of Engineers standpoint, this 27 would probably not be a problem. 28 Frank Denney - Cobblestone Homes — Concerns with some proposed conditions — No. 5 - 29 regarding elimination of Lot 4 - unwilling to eliminate this lot; No. 6 - regarding deed restriction - 30 would be a severe restriction; No.20 — temporary fencing only around trees to be retained; item 31 No. 41 — only proposing to review hydrology in proximity of project to west side of Sonoma 32 Mountain Parkway -.item No. 42 — will be done through lighting and landscape assessment 33 district; No. 51 proposing a 7 foot PUE; No. 58 — proposing a no net loss lot line adjustment. 34 John Thatch - Dahlin Group Architects - (kind of) a continuation of Turtle Creek (Willow Glen) 35 project; described diverse architecture; Lot 4 is very important to this project and an interesting 36 signature lot, doesn't believe there would be a security problem; trees in proposed park area 37 would be saved; created a fourth plan - more variety. 38 Commissioner Vouri - How many granny units? (answer 15 — however, they are not granny 39 units — no kitchen facilities, just extra living space). 40 Commissioner Monteschio - Creek setback goes into backyards? 41 John Thatch - No - all property lines and creek setback are "co- terminus ". 42 Commissioner Monteschio - Questions regarding height difference from Willow Glen. 43 Spike Godfrey - Godfrey Engineering - all pad elevations are either at or below existing 44 retaining wall - will not see pad elevation variance along Willow Glen. 45 46 The public hearing was opened. 10 2 David Jones - Linnet Lane - developer information does not match the facts at all; lots are 3 smaller, with. bigger houses than Turtle Creek, all two story - no visual relief; density is 4 significantly higher than Turtle Creek; this is being aggressively over - built, it is not more of the 5 same. 6 Todd Hopkins - 1893 Linnet Lane - Concerns with flooding, was collecting minnet crabs in 7 Washington Creek in this area last winter; traffic, speed on Linnet concerns; Lot 16 will have no 8 street parking, will be an issue for that property owner; creek is clogged, needs better 9 maintenance; bike path deadends, will be out of visual site now, there are vagrants there now - 10 put path in all at once, not now. 11 Gordon Farrow - 1901 Linnet Lane - concerns with traffic, no parking on Linnett; existing 12 granny units in Willow Glen do not have enough parking now; 13 Bob Spieldenner — 285 Redwood Circle - Alderwood Subdivision - Concerns regarding 14 flooding - in January and February, water is almost into his property, has had to sandbag - 15 fenceline has been deteriorated; airport noise - very noisy now - will airport be protected from 16 new homeowners complaints? Traveling east on Washington Street - traffic hazard; traffic onto 17 Sonoma Mountain Parkway (southbound) - cannot see small children because of landscaping. 18 Ms. Asher — 498 Hawk Drive - Not everyone was notified by developer for his meeting; when 19 was traffic study done? There are more houses in subdivision now; children need to cross 20 Sonoma Mountain Parkway to get to school. Where will construction vehicles be staged? Who 21 will do road repair from construction equipment? Fears for safety of children in already 22 inhabited area; airport issues; traffic light at Linnett and Sonoma Mountain Parkway needed. 23 Dina Agiular — 281 Redwood Circle - Alderwood Subdivision - 277 and 281 Redwood Circle 24 have flooding problems now; where will flow from new homes go? Main concerns are flooding 25 which is from creek not depression; if bike path starts at Washington Creek, where is safety for 26 homeowners in Alderwood? Why do these homes have to be so large? 27 Jerilyn Johnson (Griffin) — 277 Redwood Circle - Alderwood - appreciated meeting with Curt 28 Bates and Tiffany Robbe yesterday (looked at creek); Sonoma County Water Agency working 29 on maintenance of creek - will be several years; no one seems willing to take ownership of this 30 creek - it is debris filled. 31 Commissioner Vouri - You had work done on your house a few years ago? Wick — Taskforce Member - Discussed draft report — Committee concluded that development impact fees in Petaluma are not significant; desperate need to reevaluate density - needs to be higher density - 40 units to. acre downtown area; 30 units to acre elsewhere; focus on major transit corridors - locate closer to daily -needs shopping; 30 sites identified; asks Commission to consider expediting selective up- zoning of these parcels; reexamine more flexibility in PUD development. Commissioner Glass - Questions regarding maximum densities; transportation corridor densities should be looked at closer. J.T. Wick - Oak Creek Apartment property owners asked for property to be removed from consideration; Central Commercial district allows maximum height of 60 feet; encourage true mixed -use projects. Commissioner Vouri - This report is great - a few objections to a few of the properties; add connection between this plan and people who are employed in this City. J.T. Wick - By integrating land uses, people will be encouraged to live (in this) higher density proj ect. Commissioner Vouri - Adobe Lumber property has many constraints. Commissioner Monteschio - This report did not go far enough; .define design criteria; doesn't like teen "workforce" housing; does not want to eliminate SPARC review; does not want to see this report go forward without further discussing land that could be park land.
