COMMISSIONER'S REPORT: Commissioner Torliatt - Glad to be back on Planning Commission; summarized issues discussed during a joint meeting were discussed during a joint meeting with Novato and Petaluma City Council last night; Commissioner Healy - Referenced the recent court case - Hoffmaster vs. City of San Diego and suggested that the CR.y needs to identify sites to be made available as transitional shelter as a part of the Housing Chapter, City Attorney should be consulted regarding adequacy of our Housing Element is it specific enough? CORRESPONDENCE: Adjusted 1998 Planning Commission Meeting Schedule; Letter from Victor Thuesen forwarding December 4 communication regarding Kodiak Jack's; Memo from D.J. Phimister (Police Department) regarding Kodiak Jack's; 8 letters regarding Petaluma Christian Church. PUBLIC HEARINGS NEW BUSINESS L PETALUMA CHRISTIAN CHURCH; DICK LIEB; 1160 SCHUMAN LANE; AP NO. 006 - 411 -010 (ld). Consideration of categorical exemption and conditional use permit to allow a 3,117 sq.ft. addition to the church facility which includes 2,524 sq.ft. to be used as a classroom and fellowship hall. Assistant Planner Dunn presented the staff report. The public hearing was opened. SPEAKERS: Commissioner Broad - Is required parking based on sanctuary use only? Assistant Planner Dunn - Parking is based on understanding that all uses will not be going on at the same time. Commissioner Broad - That should be a condition. Pastor Wayne Bigalow - Introduced speakers from Petaluma Christian Church. Wayne Cole - Our church is growing and needs to know where the church is going; vision is to build integrity with church expansion; the church has presented the community with plans, honest answers. Beverly Proud - Has lived on Elm Drive for 26 years; church enhances beauty of the neighborhood; after this expansion there will still be much open space. Ryan Billing - Has attended this church since he was a child; great place to go. Richard Matthews - Elder, Petaluma Christian Church - Church has been in Petaluma for 130 years; moved to this site in 1972; seeking to offer improved facilities to youth, more members. David Traversi - 723 Cindy Lane - Neighbor of church for 21 years - Church is excellent neighbor, is the addition single - story? (yes); will classrooms be used as fulltime school? (no); does not want a full-time school use - that should be a condition; no objections with current uses or this proposal. Julian Podbereski - 1100 Schuman - Had initial concerns - Pastor Bigelow met with neighbors to answer questions; plan is to increase membership to 500; this would double membership; concerns with doubling traffic; speeding cars on Schuman are already a problem; Elders addressed another concern - long range plan regarding day school - shown on floor plan as a teen educational building - architect indicated this would be removed from plans; teen educational building is still part of plan; concerns regarding increased neighborhood noise; supportive of teen activities, has fine relationship with the 2 Planning Commission Minutes - January 13, 1998 1 church; concerns with plan that may unfold slowly, incrementally, to avoid environmental 2 review; noise, traffic concerns; limit fixture expansion. 3 Jennifer Cannon - 707 Cindy Lane - Shared storm drain inlet with church - needs to be 4 kept clear; hydrology reports (proposed to be prepared by the Church) need to be done, 5 can! existing storm drain handle this addition? concerns with traffic - already heavy traffic 6 on Schuman - traffic study was not done during peak (church) traffic; existin uneve 7 balance of church attendance - most attendance at L OAM service - parking g n 8 now (parking on P g is not sufficient (P g grass); fellowship hall will be used for large (non- church related) events, 9 will `there be enough parking? will parking be on neighboring streets? do not allow use as a 10 day school at any time in future. 11 Commissioner Thompson - What was drainage like after heavy rains (this week)? Was 12 drain clear? 13 Jennifer Cannon - Didn't look at drainage this week; church has been good neighbor and 14 made effort to have members park on property (not on street). 15 Rudulphy Presel - Attends church - very fine church; staff report addresses problems - 16 pastor has concerns with drainage also; his children attend Sunday School; ans this a ion 17 is a modest plan to address members needs; if church grew too large a larger site would be 18 needed. 1 9 Wayne Bigalow - No plans for full -time school; trying to be a good neighbor; wants to 20 grow with the City; no control over which service members attend; largest service is at 21 9AM! - second largest attendance at 10.45AM; would like to grow to 500 some day; 22 existing building has no handicap access, would like to add this; hard to grow sounds like 23 neighbors have more faith then we do in growth; Youth Center is a dream - if it were to be 24 added, we would have to come back to Planning Commission; regarding drainage -Birch 25 Court drainage is being addressed last year and this winter; most water from buildin and 26 future expansion should be taken care of on lot behind existing building. g 27 Dick. Lieb - Project Designer - Asked all church members to stand (most of room )• two 28 minor issues - asked for neighbor input at beginning of project; held two neighborhood 29 meetings; responded to neighborhood concerns; there have only been two minor traffic 30 accidents in the recent past; church is becoming a better neighbor; only covering small 31 percentage of property with roof area; drain is kept clean by the church; will continue to 32 be even better neighbors; neighborhood church; only church with 5 acres in City limits; 33 Project Engineer Steve LaFranchi will do a hydrology report; not a dense project; 34 regarding future expansion - no intent to start full -time school; adding only one classroom; 35 fellowship hall and sanctuary will not be used at the same time; church has historically 36 been a good neighbor; will continue; a Use Permit goes with the land - can be recalled if 37 there are problems; personally pray that church/neighbors can get together. 38 Commissioner Bennett - Any limitation of membership in existing CUP? 39 Principal Planner McCann - (No to above question); there is no request to add 40 additional uses or activities; establishment of full time school would require a CUP 41 'amendment; church is not restricted on membership now; Commissioner Broad has a ood 42 point - might want to add condition to define allowed uses. g 43 Commissioner Thompson - What would church have to do to expand into a private 44 school? 45 Principal Planner McCann - Request an amendment to their CUP. 3 Planning Commission Minutes - January 13, 1998 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 Commissioner Torliatt - Neighbors had concerns regarding the noticing period - not enough response time. Commissoiner Vieler - Did I understand that the church is exempt from assembly requirements? Principal Planner McCann - No - all occupancy requirements apply - Fire and Safety Codes apply. Commissioner Healy - What would occupancy of expanded facility allow (answer 214). Commissioner Healy - No traffic concerns with Allan Tilton's traffic comments. Commissioner Bennett - Church growth policy not relevant tonight; should not limit attendance - fire and safety codes are sufficient. Chairman Feibusch -No traffic concerns. Commissioner Broad - On -site parking - 54 additional members allowed is a surprise tonight; as part of CUP, additional on -site parking should be required, but only if necessary; Commission could require additional parking if provided parking is not adequate. Commissioner Thompson - Agrees with Commissioner Broad - could add later if necessary. Commissioner Torliatt - Add condition to monitor at peak periods for parking adequacy. Commissioner Healy - Hearing that parking is inadequate; requirement may not fall into 4:1 ratio in Zoning Ordinance; should not restrict membership; could modest number of parking spaces be added without much damage to aesthetics? Dick Lieb - Parking can be developed (shale) to the west of church - church is already monitoring the situation; many churches in town have no off - street parking. Commissioner Torliatt - Comments regarding construction times - 7AM is fairly early. Commissioner Broad - Concerns regarding noises with potential change resulting in different type of use of building; conversion of structure will be more desirable for weddings, etc., should add time restrictions to uses (weddings, music, etc.); use of structure by outside groups should be defined; add conditions to define types and times of different uses. Chairman Feibusch - Believes church will monitor types of uses; Noise Ordinance should cover these concerns. Commissioner Bennett - This use should not be restricted more than any other church in Petaluma. Commissioner Vieler - If there is a problem with noise, Use Permit can be recalled. Commissioner Broad - Noise concerns have been brought to church's attention - that should be enough. Commissioner Healy - Regarding drainage - neighbors need to be involved with drainage studies staff will be requiring. Commissioner Torliatt - Storm drains shall be maintained (add as a condition). Commissioner Thompson - Add storm drain condition, Mr. LaFranchi to review and prepare hydrology report. Commissioner Broad - The neighbor (Cannon) with drainage concerns needs to be notified of the availability of the hydrology study; Administrative SPARC sounds ok. The public hearing was closed. 4 Planning Commission Minutes - January 13, 1998 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 A motion was made by Commissioner Bennett and seconded by Commissioner Thompson to findithe project exempt from CEQA and approve a Conditional use Permit to authorize establishment of a fellowship hall, one additional classroom, new foyer, and the relocation of existing classrooms, based on the findings and subject to the amended conditions listed in the staff report. Commissioner Bennett: Yes Commissioner Broad: Yes Chairman Feibusch: Yes Commissioner Healy: Yes Commissioner Thompson: Yes Commissioner Torliatt: Yes Commissioner Veler: Yes Findin "s: 1. ;The proposed building addition, is exempt from the California Environmental Quality Act (CEQA) per Section 15301 when minor alteration to existing facilities are proposed. 2. The proposed building addition to be established, as conditioned, conforms to the requirements of Section 6-401 of the R -1 10,000 Single Family Residential District as the proposed classroom and foyer addition do not intrude on the front or rear yard setbacks and Article 21 of the Zoning Ordinance where public and quasi - public buildings and uses of an educational, religious, or cultural nature may be established with a Conditional Use Permit. 3. The proposed building addition to be established, as conditioned, will conform to the requirements of Section 26 -401, Site Plan and Architectural Design, of the Petaluma Zoning Ordinance where churches and other religious buildings must be of satisfactory and harmonious design quality; where the appropriate use of quality materials and harmony and proportion exists for the overall design; the architectural style is appropriate for the project in question and is compatible with the overall character of the neighborhood; the siting of the structure on the property is compatible with the siting of other structures in the immediate neighborhood; and the bulk, height, and color of the proposed structure is compatible as compared to the bulk, height and color of other structures in the immediate neighborhood. 4. The proposed building addition, with a Public and Institutional General Plan land use designation, will conform to the requirements, intent, goals, and policies of the Petaluma General Plan. Specifically, this proposal adheres to the requirements and/or intent of the following chapters of the Petaluma General Plan: 5 Planning Commission Minutes - January 13, 1998 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 Chapter 3: Community Character, Nature and Character of Development section: Objective ('i): Upgrade the quality of public, residential, commercial and industrial development throughout the city. Objective (o): Encourage adaptive re -use of vacant of underutilized structures. Chapter 7: Parks, Recreation, Schools and Child Care, Activities for Teenagers section: Policy 33: Existing facilities should be used for teen activities. CONDITIONS OF APPROVAL FOR CONDITIONAL USE PERMIT CUP97044: From the Building Division: 1. All requirements of the Building Division shall be complied with, including: a. Indicate that the new foundation matches the existing or submit a soils report to verify the foundation design. b. Show site drainage and grading topography. C. Submit soils report to verify foundation design. d. Soils with expansion index of greater than 20 requires special design foundation per Uniform Building Code 1806.2. e. Certify pad elevations before building slab on grade is poured. f Grading must be certified when completed to indicate compliance with approved plans and will be required for occupancy. g. Plans must show compliance to 1994 UBC, UPC, UMC and 1993 NEC. Plans must also show compliance to current Tittle 24 Energy Conservation and/or Disabled Access Requirements. h. Mixed occupancy separation as described in Chapter 3 of the 1994 UBC must be followed. i. All roofing shall be "B" rated or better per Ordinance 1744/1988. j. Responsible party to sign plans. 1. Indicate group occupancy, type of construction square footage. M. Provide structural calculation for all non - conventional design items. From the Engineering Department 2. Roof downspouts must be installed on the building addition which ties into the existing drainage system and directs water towards Schuman Lane. This improvement must be illustrated on the plans submitted for building permit issuance. A Planning Commission Minutes - January 13, 1998 1 2 3 4 From:the Fire Marshal's office: 5 6 3. All requirements of the Fire Marshal's office shall be complied with, including: 7 8 a. Provide one fire extinguisher, 2AlOBC type, for each 3,000 square 9 feet of floor space and/or a maximum travel distance of 75 feet. 10 b. Post address at or near main entry door - minimum four (4) inch 11 letters on contrasting background. 12 C. The building additions shall be protected by an automatic fire 13 extinguishing system as required by the Uniform Fire Code. 14 d. Provide to the Fire Marshal's office a minimum of two (2) sets of 15 fire sprinkler plans and calculations for approval and issuance of permit 16 prior to installation of system. 17 e. All emergency exit lighting shall be provided at or near all exist and 18 as designated by the Fire Marshal's office. 19 f. Provide an on -site fire. hydrant. Fire hydrant shall be spaced at a 20 maximum of 300 feet apart. Location and type of fire hydrant is to be 21 approved by the Fire Marshal's office. 22 g. Minimum fire flow required for this project is 2,500 gallons per 23 minute at 20 pounds per square inch (psi). 24 h. All required fire lanes in which no parking is allowed, shall be 25 designated by painting curbs red. Where no curbs exists, signs approved by 26 the Fire Marshal shall be installed. 27 i. If the classrooms are used for more than four (4) hours per day or 28 twelve (12) hours per week, a fire alarm system must be installed. 29 j. Provide approved hood and duct system for commercial and 30 cooking equipment. 31 k. Provide an approved automatic fire extinguishing system to protect 32 all cooking equipment. 33 1. A permit is required from the Fire Marshal's office for fixed fire 34 extinguishing systems; two sets of plans are required to be submitted for 35 review and approval of the Fire Marshal. 36 M. This plan has been reviewed with the information supplies; 37 subsequent plans submitted for review may be subject to additional 38 requirements as plans are revised. 39 40 Add as a general note to plans: 41 42 No combustible construction is permitted above the foundation unless an approved 43 asphalt surfaced road is provided to within one hundred (150) feet of the farthest 44 point of a building or structure. 45 7 Planning Commission Minutes - January 13, 1998 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 All fire hydrants for the project must be tested, flushed and in service prior to the commencement of combustible construction on the site. From the Water Department: 4. The architect must verify that the existing 1" meter is adequate to serve the added bathrooms and kitchen. If an upgrade is necessary, install a new service and abandon the old one to City Standards. From the Planning_ Department: 5. All requirements of the Planning Department shall be complied with, including: a. Construction activities shall be limited to Monday through Friday, 8:00 wn 7.00 to 6:OOpm. Interior work can be conducted on Saturdays, from 9:OOam to 5:OOpm. No interior or exterior construction can occur on Sundays or City recognized holidays. All other requirements of the Zoning Ordinance and Municipal Code Perform Standards (noise, dust, odor, etc). shall apply. b. At no time shall future activities exceed Performance Standards specified in the Uniform Building Code, Section 22 -301 of the Petaluma Ordinance and the City of Petaluma General Plan. C. The unpaved parking area used for overflow parking shall be paved with a durable and dustless surface, that is graded and drained. This work must be reflected on the plans submitted for a building permit as new work and must be completed prior to the issuance of a Certificate of Occupancy for the classroom area. d. Administrative Site Plan and Architectural Review ( SPARC) is required prior to the issuance of a building permit. e. A landscaping plan, which indicates the location, type and species of existing and new plant materials along the western and eastern property lines, shall be submitted for the review and approval of the Planning Department in conjunction with the SPARC review. The landscaping shall be installed prior to the issuance of a Certificate of Occupancy for the building addition. 6. A permanent facility for a trash enclosure shall be constructed. The location of the trash enclosure must be shown on the plans submitted for administrative SPARC and shall be reviewed an approved by the Planning Department prior to the issuance of a building permit. The materials used shall comply with the Site Plan and Architectural Review Procedures and Guidelines handout. 7. This use permit may be recalled to the Planning Commission for review at any time due to complaints regarding lack of compliance with conditions of approval, traffic congestion, noise generation, or other adverse operating characteristics. The applicants shall defend, indemnify, and hold harmless the City or any of its boards, commissions, agents, officers, and employees from any claim, action or proceeding against the City, its boards, commission, agents, officers, or employees Ito attack, set aside, void, or annul, the approval of the project when such claim or faction is brought within the time period provided for in applicable State and/or local statutes. The City shall promptly notify the applicants of any such claim, action, or proceeding. The City shall coordinate in the defense. Nothing contained in this condition shall prohibit the City from participating in a defense of any claim, action, or proceeding if the City bears its own attorney's fees and costs, and the City defends the action in good faith. C, 16 17 18 19 10 20 21 The use shall continue in the same manner as has occurred historically. Any additional activities or uses, or the addition of full time school or day care center shall require an amendment to this CUP. The ' future teen/education center" notation shall be removed from plans submitted for SPARC review. 22 11. ;Parking adequacy was of concern to the Planning Commission. Additional 23 parking may be required if found to be necessary through a subsequent review of 24 the CUP. 25 26 12. The Church shall provide on -site parking monitors during Sunday services or 27 other peak uses. 28 29 13. The gravel parking area to the west side of the church shall be expanded to 30 include approximately 10 additional spaces. Said parking shall be reflected on 31 plans submitted for SPARC review and approval. 32 33 14. A Hydrology Study shall be prepared by the applicant prior to Building Permit 34 submittal. Neighbors shall be notified to allow participation in evaluation of 35 adequacy of study. All recommendations contained in the study shall be reflected 36 in the plans submitted for a building permit and shall be implemented prior to the 37 issuance of a Certificate of Occupancy. 38 39 IS. NORTH; AP NO. 006-284-036 Ukt). 44 0 Planning Commission Minutes - January 13, 1998 1 Consideration of a request by Wayne Vieler to amend Kodiak Jack's Honky Tonk 2 and Saloon Conditional Use Permit to allow: 4 Cardroom a 24 hour, 7 day per week, 15 table cardroom (current facility operates 5 3 tables, 7 days per week from 9AM to 2AM). 6 Alcoholic Beverage Establishment a modification to the existing Alcoholic 7 Beverage Establishment entitlement to permit an expansion of the hours of bar 8 operation from the present 9AM to 2AM, to 6AM to 2AM. 9 Commercial Recreation/Arcade an expansion of the existing hours of 5PM to 10 2AM, 7 days/week, to 6AM to 2AM, Sunday through Thursday, and 6AM to 11 4AM Friday and Saturday. 12 13 (Commissioner's Healy and Vieler abstained.) 14 15 Senior Planning Technician Thomson presented the staff report. 16 17 The public hearing was opened. 18 19 SPEAKERS: 20 21 Commissioner Bennett - Clarify why we are looking at this after the Bankshot CUP? 22 Has Bankshot been appealed to the City Council? 23 Sr. Planning Technician Thomson - Yes, appealed but not heard yet. 24 Commissioner Thompson - Seems that the appealed issue should be settled before we 25 look at this request. 26 Commissioner Broad - This is for a maximum of 15 tables - how many cardplayers could 27 be playing at one time? (answer: 150) Would occupancy of the entire facility be 299? 28 (answer: yes) Mr. Vieler will have to give up one of the CUP's - why are we looking at 29 this proposal, this would be a fourth cardroom in Petaluma. 30 Principal Planner McCann - There is an existing cardroom license - this is an 31 amendment to an existing Use Permit, very different than the proposal by Bankshot 32 Billiards; this matter must be viewed on its own merit, not compared to Bankshot Billiards 33 or any other use. 34 Sgt. Phimister - (Petaluma Police) - Discussed number and type of police calls to this site 35 during the last year; discussed security measures, video cameras, entry/exit issues, 36 indicated that the Police Department recommended conditions mirror Bankshot Cardroom 37 conditions. 38 Commissioner Torliatt - Can we differentiate between the bar and cardroom uses? 39 Sgt. Phimister No, its not possible. 40 Lawrence Longenbaugh - 225 Kentucky Street - Supports staff recommendations with 41 regard to hours of operation; prefers this location to Bankshot Billiards, does not want to 42 see a 24 -hour operation in this neighborhood. 43 Wayne Vieler - Applicant - There seems to be confusion over intent and timetable; new 44 State gaming regulations prompted both applications; would like to move operation to the 45 Bankshot Billiards location - if the Bankshot CUP is denied, this is a "fallback" position; 10 Planning Commission Minutes - January 13, 1998 1 two problems there - there is an appeal, and financial concerns with adding separate 2 bathrooms, etc.; 24 -hour use is essential for financial viability; card players don't come 3 back if they have to stop playing at a certain time; wants the same hours as the other 4 cardrooms; State will review application after this CUP amendment is concluded; asked 5 for maximum number of tables so if expansion is warranted, CUP would not have to be 6 amended again - 10 tables would be acceptable; has no intention of ever using 15 tables; 7 not each table seats 10 players - Blackjack table can only seat 8; will apply to State for 6 8 tables (plus 2 for tournaments, etc., on as as- needed basis); cardroom operation is State 9 enforced, if the CUP is "pulled ", the State would close down business within 24- hours; 10 intends to add a restaurant to Kodiak Jack's - wants to be able to serve food between 24 11 AM; by providing food on -site, safer than driving to other locations; provides a place 12 where people can slow down; agrees that it prolongs timeframe that people use to filter 13 onto the street, but the bar will be shut down and food service only; allow cardroom to be 14 24 -hour use; regarding Police report - Kodiak Jack's security is excellent, many of the 15 incidents were reported by Kodiak Jack's in a responsible manner; surprised that there 16 were 13 Police reports taken. McDowell; during final SPARC review of his proposed mini- storage project, staff recommended 15% of use be developed for office use; high percentage of large units are planned for this facility; if other uses had the ability to store items in self - storage, expansion could occur in those other commercial/industrial uses; would like to work more with Planning staff and make proposaWrecommendations at next Planning Commission meeting. Commissioner Torliatt - Are you proposing a specific use of mini- storage at 1240 N. McDowell? John Pedicini - Prefers this type of use on this property; would like to work with staff on this proposal.
