Broad, Feibusch *, Healy, Torliatt, Thompson Commissioners Absent: Bennett, Vieler Staff. Pamela A Tuft, Planning Director Vincent Smith, Principal Planner Hans Grunt, Associate Planner Allan Tilton, Traffic Engineer * Chairperson 18 19 PLEDGE OF ALLEGIANCE 20 21 MINUTES OF April 14,1998 were approved with corrections (pages 5 & 6). 22 23 PUBLIC COMMENT: John Chaney - 55 Rocca Drive - Regarding Holmberg Roofing 24 - Grading permit issued to fill the lot over the "Cherry Valley Drainage Channel "; not in 25 zero net fill area; does not like noise and mess; concerned with fill compacting; "drop" the 26 grading permit and have a Planning Commission hearing; Tom Hargis needs to review and 27 approve - if Mr. Hargis approves, he (Chaney) will not oppose. Planning Director Tuft - 28 City reviewed plan for compliance with Zoning Ordinance and drainage; can't require or 29 voluntarily refer issue to Planning Commission - Staff will look at September, 1993 30 Minutes and update Planning Commission at the next meeting. Commissioner Torliatt - 31 Why not in zero net fill? Get a response back to us; how does grading apply to a CUP not 32 in compliance? Commissioner Broad - No flexibility in CUP to now allow fill? 33 Planning Director Tuft - No, we have to rely on the Zoning Ordinance. Commissioner 34 Broad - Is grading exempt from City Environmental Guidelines? Planning Director Tuft 35 - Yes, exempt. Commissioner Torliatt - Would like to see this on the next agenda if 36 there is not compliance. 37 38 DIRECTOR'S REPORT: Urban Growth Boundary update. 39 40 COMMISSIONER'S REPORT: None. 41 42 CORRESPONDENCE: None. 43 44 APPEAL. STATEMENT: Was read. 45 46 LEGAL RECOURSE STATEMENT: Was noted on the agenda. 1 Planning Commission Minutes - April 28, 1998 l 2 3 OLD BUSINESS 4 CONTINUED PUBLIC HEARING: 5 6 L i MAXWELL SUBDIVISION EAST OF "D" STREET AT WINDSOR 7 DRIVE; TENTATIVE SUBDIVISION MAP EXTENSION; CHARLE AND 8 PAULINE MAXWELL; AP NO. 019- 120- 045(hg). 9 1 Continued consideration of a request to extend the expiration date for a fourteen 11 lot residential Tentative Subdivision Map by one year to May 20, 1999. 12 13 (Continued from the Planning Commission Meeting of March 24, 1998.) 14 15 The public hearing was continued: 16 17 SPEAKERS: 18 19 Commissioner Broad - Why not require improvements and dedication of the public 20 access path? 21 Commissioner Torliatt - Would like to see irrevocable offer and improvements; work 22 with Stoneridge and the County if necessary to consider ridge trail; contact County 23 regarding possible development. 24 Commissioner Healy - .Primary focus on Kelly Creek; better use and better benefit; ridge 25 would get less use; conditions on extensions must be agreed to by applicants; stub street 26 from Maxwell to Horich properties to get only one access from "D" Street to minimize 27 access points. 28 Commissioner Thompson - Concerned with access and impacts on creek. 29 Steve Buckley - Representative for Maxwell and Stoneridge - Moving forward on 30 Stoneridge; access would go through a building site; not a workable situation.. 31 Mrs. Fredericks - Sunnyslope - Was not notified; she has enhanced the creek, go out and 32 look at the creek; not an attractive idea; flood problems in area. 33 Bonnie Diefendorf - Project Engineer - No development potential west of site on 34 Maxwell property. 35 Commissioner Healy - Stub street? 36 Bonnie Diefendorf - Difficult to justify the road; the project currently requires an 37 excessive amount of dedication and improvements for a 14 -lot subdivision; additional 38 expense for water and sewer and 28' wide street and sidewalk does not seem appropriate. 39 Commissioner Broad - Is there a benefit to having a pathway that does not connect to 40 Sunnyslope?; if so, require construction of path now; the "County portion" is a remainder 41 to the Maxwell Subdivision; access over the remainder to Premo and to Sunnyslope could 42 be a requirement of this project. 43 Steve Buckley - Concerns regarding maintenance of creek. 44 Commissioner Healy - Maintenance concern is an issue - staff should talk to Parks and 45 Recreation. 2 \ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Planning Commission.
