Summarized events of this issue: 26 27 Mark Bernardi Stated need for a check valve in 84" pipe. 28 9/28/93- Holmber new proper1y owner drain .pipe is supposed to have a check 29 valve. 30 Ed Sartori Stated that a check valve must be included. 31 Allan Tilton Stated that he would take the issue to SCWA and the City 32 Engineering Department. 33 9/27/94 Planning Commission review Holmberg agreed to do it; made cement 34 ditch; assumed a check valve was installed. Confirmed that a permit was pulled but 35 never fulfilled; states there still is no check valve in that location. 36 2/2/98 Flood could have been impacted by absence of check valve. 37 38 Asked for check valve to be placed before next winter. New owner seems willing to work 39 with neighbors. 40 41 Staff indicated they would follow up on this issue. Hargis, Director of Engineering, will 42 check.into the finaling of the permit. 43 44 DIRECTOR'S REPORT: 45 Urban_ Growth Boundary Workshop: July 11, 1998, 9:00 -11:00 a.m. Will provide answers 46 to questions and tabletop discussion. 1 City of Petaluma, CA - Planning Commission Minutes - June 23, 1998 1 Planning Commission Hearing, July 14, 1998, on location and text. 2 City Council soon to follow Planning Commission consideration. 3 4 COMNIISSIONERS' REPORT: 5 Chairperson Feibusch Request to send public notices to Planning Commissioners in 6 biweekly packets. 7 8 CORRESPONDENCE: 9 APA conference brochure. 10 Letter from Khang Van Do regarding the funeral home to be established at 331 Lakeville 11 Street. 12 13 APPEAL STATEMENT: Was read. 14 15 LEGAL RECOURSE STATEMENT: Was noted on the agenda. 16 17 18 CONTINUED BUSINESS 19 PUBLIC HEARING 20 21 I. WOODSIDE VILLAGE; Minor PUD Amendment to the Woodside Village 22 Planned Unit District Landscaping and Fencing Development Standards to allow 23 fencing to be constructed in alternate locations Okt). 24 25 (Continued from Planning Commission Meeting of May 26, 1998.) 26 27 Jane Thomson, Senior Planning Technician presented the staff report. 28 29 Commissioner Healy How does this compromise compare to the previous approval? 30 Jane Thomson It moves the fence a little further from driveway. 31 Commissioner Broad Questioned who supports this compromise. 32 Jane Thomson The three owners are representing the neighborhood. 33 34 The public hearing was opened. 35 36 Matt Thomas 1425 Woodside Circle: Resident group has spoken to all Woodside Circle 37 residents (not Capri) and have come to consensus. Considered requiring all four 38 neighbors' approval but decided it was not necessary because it was not obstructing the 39 driveway. 40 Commissioner Broad Front residents should be required to obtain both rear residents' 41 approvals to modify fence, because it is not self evident that both rear residents will not be 42 effected. 43 Matt Thomas Impact is house by house, directly behind modified fence. 44 45 The public hearing was closed. 2 City of Petaluma, CA - Planning Commission Minutes - June 23, 1998 DISCUSSION: 4 Chairperson Feibusch Commends neighbors for coming to resolution. 5 Commissioner Healy Does not agree with the position that only front and back neighbors 6 on one side of a quad are affected by fence changes. 7 Commissioner Torliatt Asked whether residents could agree that all four neighbors must 8 approve a fence modification/permit. 9 Jack Feller, Resident Neighbors that spoke did not have concerns with the property 10 across the street, just properties directly in front. 11 Commissioner Bennett Commented that they should not change the agreement now that 12 the neighbors have it worked it out; neighbors were instructed at the May 26, 1998 13 meeting to work it out; they have followed the Commission's direction and reached an 14 agreement and he does not like the thought of changing their hard work. 15 Commissioner Thompson If all neighbors agree, why not have all four neighbors agree to 16 any fence modification. If they can all agree, he can approve. 17 Jack Fellow Unless there is a problem, it would not be brought before the Planning 18 Commission, just to staff. 19 20 A motion was made by Commissioner Bennett and seconded by Commissioner Thompson 21 to recommend exemption from CEQA and approval of a Minor PUD Amendment to the 22 Woodside Village PUD Landscape and Fencing Standards to City Council. 23 24 DISCUSSION: 25 26 Commissioner Torliatt Does not agree with motion. Should have consensus of all four 27 houses in a quad; there is no reason not to add the requirement that all four need to sign. 28 Needs all four neighbors' agreement, will vote `No' unless all four need to sign. 29 Commissioner Healy Agrees with Torliatt; if it is not a problem to obtain approval from 3o all four neighbors, then supports requiring all four approvals. 31 Commissioner Broad This is not a static situation, property ownership will change in the 32 future. Supports requiring all four neighbors' approval to fence changes. Expressed 33 appreciation again for all the hard work that residents have put into this project. 34 35 A motion was made by Commissioner Bennett and seconded by Commissioner Thompson 36 to recommend exemption from CEQA and approval of a Minor PUD Amendment to the 37 Woodside Village PUD Landscape and Fencing - Standards to City Council, with the 38 amendment that all four residents must agree to any fence modification in any given quad, 39 and a fence permit obtained from the Planning Department. 40 41 Commissioner Bennett: Yes. 42 Commissioner Broad: Yes. 43 Chairperson Feibusch: Yes. 44 Commissioner Healy: Yes. 45 Commissioner Torliatt Yes. URBAN GROWTH BOUNDARY; Discussion of policy options for Urban 8 Growth Boundary Ballot Measure Text (pt). 9 10 Pamela A Tuft, Planning Director presented the staff report. 11 • 12 SPEAKERS: 13 14 Mark Coggin 43 Windsor Lane: Thanked Commission for the May 30 workshop. 15 Impressed with organization and diversity of views. There was a common thread to 16 maintain sense of identity as a `small' community with economic and spiritual vitality. 17 Subjects of concern are: preserving water and sewer resources and hillsides at periphery of 18 City. Suggested feathered diversity as we reach the Urban Growth Boundary. Urban 19 Growth Boundary should not be a wall, with development piled up at it. The County is 20 `downslope' of the City and therefore, decisions of the City affect County residents 21 (runoff, traffic, water, etc.) Need to identify those areas, and keep people informed. 22 Pamela A Tuft Preparing a mailing list for properties just outside our existing Urban Limit 23 Line. 24 Bill White Hopes City seriously considers industries and businesses that are growing and 25 still need room to grow to stay in Petaluma (i.e. telecommunications industry). 26 Information on growth projections indicates not much space left, asked for consideration. 27 28 DISCUSSION: 29 30 Commissioner Healy (SCAP and OSD) Commented that the last workshop had a great 31 deal of work done on vacant land survey. Gave summary of absorption rates in the past 32 and projections. Asked about current analysis on absorption rates. (Answer: Staff is 33 working on it.) The current General Plan runs through 2005. If the Urban Growth 34 Boundary goes 20 years, how does that affect it? Would like to set process to ensure 35 consistency between the General Plan and the new work done on the General Plan update. 36 Suggested exploring options to "mesh" the two efforts. Sebastopol is the closest that keys 37 the UGB off the General Plan (20 year- but still in sync with GP). Suggests exploring 38 creative possibilities. 39 Commissioner Torliatt Rainier Interchange discussion last night touched on a timeline for 40 General Plan update. 41 Commissioner Bennett Suggested updating the General Plan and then undertaking an 42 Urban Growth Boundary as a logical outgrowth. Questions in packet are outstanding and 43 need research and analysis to make sound decisions. Arguments to slow Rainier should be 44 applied to the Urban Growth Boundary now. Has reservations that more than 25% of 45 questions can be answered only with a full fact -based analysis. Economic strategy should 4 City of Petaluma, CA - Planning Commission Minutes - June 23, 1998 1 be planned now so that discussion of what is needed in land inventory and fiscal needs are 2 included for the community vision. 3 Commissioner Thompson Agrees with Commissioner Bennett regarding answering 4 packet questions. Asked to consider what the economic impact will be. Particularly 5 Question number 15, concerning Urban Growth Boundary impact to business and 6 employment. Would like to see flexibility for job - producing transit oriented business and 7 commercial uses. Sees feathering issue as critical. 8 Commissioner Vieler Asked for an example of municipal incorporated or owned land 9 outside the Urban Growth Boundary. 10 Pamela A Tuft Wastewater Treatment plant, Lafferty Ranch. 11 Commissioner Vieler Suggested policy that would represent property owners outside the 12 City limits but within Urban Growth Boundary. Bill White's concerns are well founded. 13 Sebastopol allows Urban Growth Boundary amendment for business uses and employment 14 considerations. 15 Commissioner Broad Regarding exceptions, thinks it might be misleading. Room for 16 exception but dependent on location of the line and done carefully to gain for the 17 community and does not undermine intent of Urban Growth Boundary. Type of exception 18 would depend on how lines are drawn. 19 Chairperson Feibusch Concerns with feasibility for economic development that is based 20 on population. 21 Commissioner Healy 'Following the workshop, it is apparent that there is no area for 22 significant change without doing harm to most areas. Western rim does not have roads for 23 expansion. On the eastern rim development would need to leapfrog over Urban Separator 24 and the Airport. Suggests a disinterested planner objectively look at this for options and to 25 find the least bad alternative to expand in the future. 26 27 28 111. LIAISON REPORTS 20 21 Commissioner Torliatt Announced joint Traffic Advisory Committee (TAC) and 22 Petaluma Bicycle Advisory Committee (PBAC) meeting at 6:00 p.m. on June 24, 1998. 23 Thought that bollards were to be installed at parking lot entrance to Petaluma School 24 District Administration Office on Baker Street. (Answer- Vincent Smith: Fire, Public 25 Works and Planning have notified the School District that bollards can be installed). 26 Commissioner Healy Encourages thoughts to be put down on paper and submitted to 27 staff before August for Commission goal setting. 28 29 3o ADJOURNMENT: 8:25 P.M. 31 32 min0623/ plan99 N
