ROLL CALL: Present: Rahman*, Thompson, Torliatt, vonRaesfeld; Absent: Barlas, Feibusch, Wick STAFF: Pamela Tuft, Planning Director James McCann, Principal Planner * Chairman PUBLIC COMMENT: None. DIRECTOR'S REPORT: None. COMMISSIONER'S REPORT: None. CORRESPONDENCE: Letter from Donald Weisenfluh regarding Cross Creek; 6 letters regarding West View Estates. APPEAL STATEMENT: Within fourteen (14) calendar days following the date of a decision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed with the City Clerk. Said appeal shall be accompanied by the appeal fee as specified by Resolution 92 -251 N.C.S. as adopted by the City Council. The appeal shall state specifically the grounds for the appeal and the relief sought by the appellant. LEGAL RECOURSE STATEMENT: Was noted on the agenda. CONTINUED BUSINESS PUBLIC HEARINGS L WEST VIEW ESTATES SUBDIVISION; NORTHBAY CONSTRUCTION; BODEGA AVENUE BETWEEN NORTH WEBSTER STREET AND RUTH COURT; AP NO'S 006 - 470 -10, 006 - 480 -003, 005, 011, 012, 016, and 031. 1 1 2 Proposal for a 55 -lot single - family home development on 21.6 acres of hillside 3 property in west Petaluma and request for public and Commission comments on 4 the Draft Initial Study. 5 6 (Continued from Planning Commission meeting of November 14.) 7 8 This item was continued to the Planning Commission meeting of December 5, 9 1995. 10 11 12 U. CITY OF PETALUMA; PETALUMA RIVER ACCESS AND 13 ENHANCEMENT PLAN (File WRK91034). 14 15 Continued consideration of the Draft River Access and Enhancement Plan. 16 17 Continued public hearing: 18 19 SPEAKERS: 20 21 Planning Director Tuft requested that the Commission continue to receive public 22 testimony. 23 Eileen Boheen, Chelsea GCA, Inc. (parcels B &C on either side of the factory outlet 24 project) - Introduced design team (Sandy Reed, John Meserve, Mike Jocelyn) - would like 25 to offer alternate greenway design for Commission consideration. 26 Mike Jocelyn - Complimented the City on the nice plan for the 150' buffer proposed on 27 these parcels; presented slides of river through parcels B & C. 28 John Meserve consulting arborist/horticulturist for factory outlet - Complimented staff 29 and consultants on Draft Enhancement Plan; felt there was a limited number of native oaks 30 present in area of parcel B & C; soil type (heavy clay soils) greatly limit the extent of areas 31 suitable for riparian woodland should consider an alternate to the regular 150' buffer - 32 buffer should follow existing material conditions in soil, moisture condition - may be as 33 little 25 - 75'; suggested site visit to examine existing site conditions. 34 Commissioner Thompson - Had questions regarding tree species. 35 Commissioner Torliatt - Questioned Mr. Meserve's buffer -are there any areas that should 36 be greater than 150'? 37 John Meserve - No area even at 150' - too far away from the river to be riparian. 38 Eilleen Boheen - Chelsea would like to present site plan; after January 23, would like to 39 schedule a site visit. 40 Bob Abbott - 805 North Webster Street - Referenced his previously submitted letter; also 41 suggested field trip to view conditions. 42 Jane Hamilton - Suggested inviting the River Enhancement Committee on the field trip; 43 many hours of discussion were spent regarding how /why buffer width was established. 44 Commissioner Torliatt - City Council could be invited, too. 45 John Roberts , Planning Consultant - Clarified River Plan - upstream (Capri Creek) 100' 46 minimum buffer - downstream 150' average, 100' minimum - 50' buffer from dripline - 2 I primary buffer to riparian zone but also buffer habitat that exists or to be encouraged; oak 2 woodland and oak/grassland combination. 3 Pamela Tuft - Were there any comments from the public or Commission regarding Initial 4 Study? 5 Commissioners Torliatt and Rahman - Thanked the Chelsea Group for their efforts and 6 interest. 7 s 8 The public hearing was continued to the Planning Commission meeting of January 9 23, 1996. 10 11 : 12 M. CRITERIA FOR DETERMINATION OF "UNDUE CONCENTRATION"; 13 CITY OF PETALUMA U cm). 14 15 Recommendation of an exemption from the requirements of CEQA and of criteria 16 to be adopted for use in making determinations of "public convenience or 17 necessity" in areas identified by the Department of Alcoholic Beverage Control as 18 experiencing an undue concentration of licensed premises. 19 20 Continued from the October 24, 1995 meeting. 21 22 A request has been received to continue this item to January, 1996. 23 24 The public hearing was continued to the Planning Commission meeting of January 9, 25 1996 (tentative date, subject will be renoticed). 26 `. 27 28 NEW BUSINESS 29 PUBLIC HEARING 30 31 IV. CITY OF PETALUMA; CAPITAL E PLANS (CIP) 32 33 General Plan consistency finding for projects added to the 1994 -99 CIP. 34 35 Planning Director Tuft presented the staff report. 36 37 The public hearing was opened. 38 39 SPEAKERS: F 40 41 Commissioner Thomson - Page 3 Water System; what will be deleted in the General Plan? 42 (response: reference to upgrading Lawler Treatment Plan). 43 Commissioner vonRaesfeld - How does the public comment on specific public projects? 44 (response: during the Council consideration of the CIPS and Annual Budget). 45 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 The Planning Commission raised questions on street signalization ( "D" and 4th); and water (reference to Lawler Treatment Plant). The public hearing was closed. A motion was made by Commissioner Thomson and seconded by Commissioner to find the 5 -year CIP Projects, with the exception of water; which was continued until December 5, 1996, as incorporated into the Capital Improvement Plan are consistent with the General Plan.
