APPROVAL OF MINUTES: Minutes of July 9, 1996 were approved as printed.
PUBLIC COMMENT: None.
DIRECTOR'S REPORT: Principal Planner James McCann noted that Leslie Kerr, the
Planning Department's new secretary died today following open -heart surgery. Leslie was
a fine secretary and an important part of the Planning Department. The staff is very
saddened by Leslie's death, she'll be missed.
COMMISSIONER'S REPORT: Commissioner's Rahman and Wick will be absent
from the August 13 meeting.
CORRESPONDENCE: Memo regarding Sonoma/Marin Multi -Modal Transportation
and Land Use Study; Opportunity Center Status Report #6.
APPEAL STATEMENT: Was read.
LEGAL RECOURSE STATEMENT: Was noted on agenda.
OLD BUSINESS
CONTINUED PUBLIC HEARING
L NOISE ORDINANCE; CITY OF PETALUMA (vcs).
Continued consideration of an amendment to the Zoning Ordinance to replace the
existing noise regulations (Section 22 -301) with new noise regulations.

5 John Fitzgerald - Speaking for Barbara and M. Lind (Jerico Products) - Reinforced the
6 need to recognize and protect existing industrial uses. Reference tonnage shipped on river
7 accelerated since 1981; 95% of tonnage related to Jerico; tonnage very important to allow
8 Corps of Engineers to dredge River; on record that Jerico is important to community -
9 operations occur on 24 -hour basis; operated since 1920's - expect to remain and expand
10 operations; noisy at different times of day and night.
11 Wayne Vieler - Ambient noise should be considered in Ordinance and considered in setting
12 "standards"; mixed land uses very important to recognize; when have boundaries between
13 zones (residential and commercial) should establish/recognize a buffer (distance
14 consideration); Ordinance needs to be fair to all involved; reference Kodiak Jack's noise
15 analysis; proposed measurements (criteria in Table 1) very similar to existing measurement;
16 transfer sound measurement responsibilities to Police Department - they're out 24
17 hours/day; easy to instruct officers and equipment cheap ($60 -70 each); average traffic
18 volume on Petaluma Blvd. North is 70 -80 dBA; need to include clause regarding ambient
19 noise levels in recommendation; hire acoustic consultant to take measurements and get
20 base of sensitive data (at real sites recognized as being loud or sensitive) use these
21 numbers as the base; reference change in population since 1950 - grown 4 times in size -
22 we're proposing to use the same standards - things have changed considerably - the
23 standards should change also; need an appeals board (with qualified people); concerned
24 with definition of "reasonable persons" too subjective - need to nail criteria down; would
25 be more fair.

29 Commissioner vonRaesfeld - Reinforce Mr. Vieler's comments regarding ambient noise.
30 Commissioner Rahman - Agree; needs to be fair, realistic, reasonable.
31 Commissioner Wick - Need more balanced approach recognizing mixed -uses and
32 Industrial land uses; inconsistencies within General Plan regarding river oriented and
33 industrial uses while calling for peace and quiet; suggest a sound study be done up -front as
34 suggested by Mr. Vieler; non - conforming set by ambient noise - if go beyond by some
35 percent, then use is in violation; existing ambient is normal.
36 Wayne Vieler - Non - conforming status is unattractive and cumbersome (and expensive).
37 John Fitzgerald - Non - conforming status might prohibit ability for businesses to expand,
38 take advantage of opportunities like Jerico's opportunity.

Consideration of a proposed Mitigated Negative Declaration and a Use Permit
Amendment to allow the addition of a 21' tall, 1,584 square foot enclosed play
structure to an existing fastfood/drive- through restaurant located at 103 North
McDowell Blvd., within the Petaluma Plaza Shopping Center (AP No. 007 -340-
008).
Principal Planner McCann presented the staff report.
The public hearing was opened.
SPEAKERS:
John Records - The applicant will donate the existing play equipment to COTS; urges
approval of the application.
The public hearing was closed.
Commissioner Feibusch - SPARC plans unacceptable; should go back to SPARC before
Planning Commission considers CUP.
Commissioner Thompson - Agrees with Commissioner Feibusch.
Commissioner vonRaesfeld - No problem with land use; design is in need of significant
improvement.
Commissioner Wick - Agrees, design should go back to SPARC before Commission acts
on CUP.
Gary Flynn - Applicant - We've redesigned already - $50,000 in additional costs; happy to
go back to SPARC.
The public hearing was continued to the August 27 Planning Commission meeting.
