Continued request for approval of an amendment to the existing Burger King Conditional Use Permit to permit the establishment of drive -thru service. The following actions are required: 1. Approval of Mitigated Negative Declaration. 2. Conditional Use Permit' amendment to permit addition of a drive- through facility to an existing 2,693 sq. ft. fast food restaurant. .(This public hearing was closed at the June 8, 1993 meeting.) DISCUSSION: . Principal Planner Jim McCann presented the staff_ report. Mike Foresee - Project Architect - presented revised plans; noted that striping and pedestrian walkway will be textured and colored. Herb Brown Project Architect - answered questions regarding site plan; traffic circulation on site; requested clarification regarding tree replacement ratio (1:1 or 2:1 ?). Allan Tilton -. City Traffic Engineer - Traffic count was done several : years ago on exiting /entering McDowell - the drive to the north or,2urger King is very lightly used (only 20% of the other two drives). David Tones - 1709 Indian Trails, Novato - Representing Terry Flynn (owner of McDonalds) continued concerns regarding safety of pedestrians. Dave Vorpahl 400 Santa Clara Street, Vallejo. - Burger King Representative - presented pictures showing safety features of several McDonalds and Burger Kings. Terry. Flynn _ -. Owner .of McDonald's - Wants (and has requested previously) an EIR because of traffic concerns on McDowell; the present plan is a dangerous design, the City will be liable. i Ierb Brown the proposed plan is the safest for pedestrians. Allan Tilton - Moving the drive -thru to the other side of the building as well as other alternatives were looked at again but were determined to be less safe than current proposal. Commission 'Discussion Centered around concerns with entrance on north side from .McDowell. (will listen to Traffic Engineer advice); number of trees to be removed and number to be replaced; pedestrian safety at drive -thru; adequacy of signage.at exits. The public_ hearing was closed. An Initial Study, including an expanded traffic analysis, has been prepared and 7 proper notice provided in accordance with CEQA and local guidelines. 8 9 2. Based upon the Initial Study and comments received,- potential impacts could be 10 avoided or reduced to a level of insignificance by mitigation measures attached as 11 conditions of approval. There is no substantial evidence that the project, as conditioned, would have a significant effect on the environment. Mitigation Measures - 1. During peak noon hour (12:00 PM to 1:00 PM) and evening commute /dinner hour periods (5:00 PM to 6 :30 PM) or any time that five or more vehicles are queued in the drive - through lane, an employee with a headset shall be stationed outside the building to aid in taking orders, taking money, making change, and delivering 20 special orders. 21 22 2. During peak periods, customers with special orders shall be directed to park in 23 nearby parking spaces, rather than slow the queue, and their order should be 24 delivered by the employee helping outside. 25 6 3. Three parking spaces shall be reserved (and clearly identified by signs) for vehicles 7 in the drive - through lane which are directed to park directly adjacent to the end of 8 the drive - through lane (while awaiting special orders). 29 30 4. The proposed loudspeaker shall not be audible to the residences across McDowell 31 Boulevard. 32 33 S. A sign(s) shall be installed at the drive -thru exit advising motorists that right turn 34 movement is the only maneuver permitted. Design and placement of the sign(s) shall be 35 subject to review and approval of the City Engineer prior to issuance of a building 36 permit. 37 38 6. A decorative open fence, e.g. wrought iron approximately 42" in height shall be installed 39 at the back of curb adjacent to the planter area and along the sidewalk leading to the 40 main entry. Design and placement of the fence shall be subject to review and 41 by the Planning Director prior to issuance of a building permit. 42 43 7. An opening in the median in the entry/exit aisle on the north side of the site shall be 44 permitted. The design and location of this opening shall be subject to review and 45 approval by the City Engineer prior to issuance of a building permit. 46 47 8. On-site. and off -site (northerly entry/exit drive) circulation conditions shall be monitored 48 following the establishment of the drive -thru service for a six (6) month period by the 49 City Traffic Engineer. The proposed drive- through addition to the -existing 2,693 sq. ft. Burger King Restaurant, as conditioned, will 'conform to the requirements and intent of the Petaluma Zoning Ordinance. 2. The proposed drive- through addition, as conditioned, will conform to the requirements and intent, goals, and policies of the Petaluma General Plan. 3. The proposed drive- through addition, as conditionally approved, will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. All requirements of the Environmental Operating Services shall be met including: a. Installation of a drain that will direct the washdown to the grease interceptor or guarantee that no waste or washdown will reach the storm drain shall be required, subject to approval of the Environmental Operating Services Department (762 -5892) prior to issuance of a building permit. 2. Ali conditions of the existing Conditional Use Permit approval granted November, ,_1980 and SPARC approval granted December, 1980 are incorporated as conditions of the Conditional Use Permit Amendment hereby approved (copy attached). 3. Administrative Site Plan and Architectural Review ( SPARC) shall be required with emphasis on landscaping, signs, trash containment, etc. ' In particular, four of the sycamores proposed to be .removed shall - be replaced in the new planter on the north side of the drive -thru lane. 4. The landscape median shall be extended at the drive - through entrance per the attached Exhibit B, subject to staff approval prior to issuance of Certificate of Occupancy. 5. A pedestrian walkway (meandering through the existing trees) shall be provided along the northerly building frontage per the attached Exhibit B, subject to staff approval, prior to issuance of Certificate of Occupancy.. 6. A low wall (3 -4 feet) shall be constructed around the perimeter of the outdoor dining area, subject to staff approval, prior to issuance of Certificate of Occupancy. 1�[` 4 i l 7. Replace trees to be removed (two eycalyptus trees) from the proposed driveway at 2 northeast corner of parking lot on a two -to -one basis elsewhere in the parking lot, in 3 the proposed planting median on the eastern perimeter of the lot and in the existing 4 planter opposite the proposed entrance to the restaurant. 5 6 8. Establish a pedestrian walkway in the existing planter opposite the proposed 7 entrance to the restaurant. The proposed amendment to allow 24 hour operation of a two table cardroom, as conditioned, will conform to the requirements and intent of the Petaluma Zoning Ordinance regarding uses within Highway Commercial districts .and Sections 21,420.00 through 21- 42042 regarding regulations governing cardroom facilities. 2. The proposed amendment to allow 24 hour operation of a two table cardroom, as conditioned, will conform to the requirements and intent, goals, and policies of the Petaluma General Plan by encouraging small and locally owned business. 3. The proposed amendment to allow 24 hour operation of a two table cardroom, as conditioned; will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions: 1. All requirements of the Police Department shall be met, including: A. The applicant shall provide the Police Department with ' a written security plan for. the location and operation of the business prior to expanding to 24 hour operation. The plan shall include policy,_ procedures, and use of security personnel on the premises during all hours of operation. B, The operators shall comply fully with all provisions of Section 21- 420 -30 of the Petaluma Municipal Code. C.. Police Chief in order to identify and mitigate any possible traffic piol lems andneighborhood concerns. 3. Adequate exterior lighting shall be installed in order to increase nighttime visibility. A lighting plan shall be submitted for review and approval by the Planning Director and Police Chief and, lighting improvements installed pursuant to. this plan prior to occupancy of the building. The proposed activities (office, senior drop -in rogram, worship center, 12 -step program, food distribution and related activities shall be the limit of activities permitted at this site. Additional activities shall' be permitted with the permission of the Planning Director. Activities may not overlap The Planning Director shall be notified in writing of any change in hours or. addition /deletion of activities prior to commencement of the activity. Said activities shall occur only as listed on, the approved schedule (Exhibit B) as amended' to permit additional worship related activities on Saturday and Sunday. E 1 2 2. 1. Existing on -site parking shall be considered sufficient for all approved uses, with the 3 exception of the food distribution, until such time as additional activities are added. 4 At that time the parking shall be re- calculated before activity may commence. 5 6 3. Request to authorize open storage at 16 Cedar Grove Park. The following actions , are required: 1. Adoption of .a Mitigated Negative Declaration. 2. A Conditional Use Permit to authorize open storage. 1 11 1 The public hearing was opened. 2 ' 3 SPEAKERS: 4 5 Principal Planner Jim McCann - presented the staff report. i 6 John Chaney - 55 Rocca Drive - Objected to continuing this item; this was an empty lot in 7 1984; Mr. Holmberg is bringing .in fill in .flood zones; started to complain in October of id. 8 1992 when fill was brought in on weekends; Police were called, Building Department - 9 required fill to be removed; Mr. Holmberg moved tractor trailers (12 feet high) along 10 property line shared with Mr. Holmberg; in June of 1993 more fill was placed on property 11 and. was again required to be removed; other concerns are: noise (diesel engines start at 'i 5:30 AM even on weekends) and continue after 7:00 PM at night; hazardous materials ` (tar, oil, etc.) stored on site; junk cars and trailers, no landscape screening; disregard for Indian !artifacts and. old family cemetery on site (being covered with garbage); these problems need to be dealt with now this item shouldn't be continued. 6 Ravnof, West - 51 Rocca - Grading and earth moving has been going on since 1989; recently storage trailers have been placed at property lines; general clean -up of site is needed'. Planning Director Pamela Tuft Placement of fill is being handled by Building Division; 20 parts of Holmberg property can be filled because it is Flood Plain, not Floodway; zero net 21 fill regulations do not apply to this property. 22 Commissioner Rahman - Is Mr. Holmberg using old roofing material for fill? Recommend that the City Council conditionally approve the Tentative Map. 46 47 The public hearing was opened: ;j 48 49 SPEAKERS: 50 51 Assistant Planner Dede Dolan presented the staff report. 52 Peter Henson - Concerns with staff recommendation regarding roof pitches; added variety I 53 of elevations. 2 12 Commission Discussion Several Commissioners expressed .regret that 'SPARC had not seen this project as a preliminary review prior, to this meeting; concerns included: massive amounts of cement and garage doors in front yards; density; souiidwall-design (too many two - story, homes backing soundwall),; too few detached and side -entry. garages;- design does ' not support public transportation needs;• design discourages sense of community; more noise and traffic on Sonoma Mountain Parkway after. Santa. Rosa Junior College is built; project "needs redesign and further review by Planning Commission and SPARC. (Commissioner - Parkerson made a motion to approve the .adequacy of the. previously certified.
