FOOD 4 LESS; 896, 926, 950 LAKEVILLE STREET; AP NO'S 005-020-43,005-060- 42 30. & 33; FILE NO. CUP93040. 43 44 Continued (from January 11, 1994) request to authorize the construction of a 51,600 45 sq:ft. discount grocery store on Lakeville Street between Lindberg Lane and 46 Caulfield Lane. 47 48 1. Conditional Use Permit to authorize development of a shopping center. 0 1 This item was continued to the February 23, 1994 meeting. )2 114 Planning Commission Minutes February 8, 1994 NEW BUSINESS PUBLIC HEARING II. LAMMA GROODY; APPEAL OF CONDITIONS IMPOSED ON TENTATIVE PARCEL MAP; AP NO. 019-232-004; FILE NO. PCL93004. Consideration of an appeal by property owner Lamma Groody of a condition imposed on the project requiring the project proponent reimburse the City for the cost of street frontage improvements. The following actions are requested: 1. A determination that the project is exempt from the requirements of CEQA. 2. Approval of a Tentative Parcel Map with amended conditions. The public hearing was opened. SPEAKERS: Principal Planner James McCann presented background on the project. Lamma Groody - 1010' Phillips Ave. Applicant - Staff has been very gracious, helpful; when City requested her to sign approval (.construction access agreement) to allow construction of frontage improvements, no reimbursement obligation was mentioned; met with Assistant City Manager Warren'Salmons, he offered to reduce original bill (to exclude design costs) and allow deferred billing until lots are sold; would like she and three children to build homes on this property; pays taxes to City, should consider increased taxable value of property toward repayment of the costs; it would be ust to waive this fee as an act of justice or of mercy; has made many improvements to site much more attractive /cleaned up than when she purchased it). Commission Discussion Council should rule on this appeal since it deals with fiscal questions; since Ms. Groody knew of this requirement and it is customary to charge developers for public improvements, this charge is equitable and should be paid. The hearing was closed. A motion was made by Commissioner Parkerson and seconded by Commissioner Thompson to find this Parcel Map exempt from the requirements of CEQA and to deny the appeal, sustaining all conditions of approval including reimbursement for frontage improvements. Should Ms. Groody choose to appeal this decision to the City Council, 3 the appeal fee will be waived by Planning staff. 4 5 6 III. OCEANIS; CORONA CREEK; ELY ROAD BETWEEN NORA LANE AND 7 BURGUNDY COURT; AP NO. 137 - 060 -95; FILE NO.'S REZ93014, TSM93010. 8 9 Consideration of a request to subdivide 20.2 acre site into 79 residential lots. 10 The following actions are requested: 1. Recommend that the Council find that the previously certified EIR adequately addresses the potential environmental impact associated with this project. pap 2.. Recommend approval of a rezoning of the property from PCD to PUD. 3. Recommend approval of a Planned Unit Development Plan. 4. Recommend approval of a Tentative Subdivision map to subdivide the 19 property into 79 single - family lots. 20 21 The public hearing was opened and continued to the Planning Commission meeting of 22 February 23, 1994. 23 24 IV.
