COMMISSIONER'S REPORT: Commissioner Rahrnan requested Commission review of parking standards in light of recent discussions regarding Gateway Center /Food4Less proposal. Planning - Director Tuft indicated staff would bring SPARC Parking Standards /Zoning Ordinance Parking Standards to Commission for informal discussion duringlune. CORRESPONDENCE: None. TAIT AND ASSOCIATES; SHELL STATION - 1001 LAKEVILLE; AP NO. 005- 44 020 -064; FILE NO'S CUP94005 -7. 45 46 Request to authorize the complete reconstruction of the existing Shell Oil gasoline 47 service station including a convenience market and a carwash. The following 48 actions are requested: 49 50 1. Adoption of a Mitigated Negative Declaration. 51 2. Approval of three Conditional Use Permits to authorize development of a 52 gasoline service station, a convenience market, and a car wash in a CH 53 Zoning District. 186 Planning Commission Minutes May 10, 1994 1 2 Assistant 'Planner Hans Grunt presented the staff report; indicated that the corporate .3 architecture submitted was inappropriate for this gateway location and would be reviewed 4 through SPARC; staff otherwise pleased with project. 5 Commissioner Shea - What is the process? After SPARC, does this come back here for 6 reapproval of design? 7 Planning Director Pamela_ Tuft - Project does not return to Planning Commission after 8 SPARC will work. With applicant and architect to achieve 'a m ore acceptable gateway 9 design; example of striking carwash architecture is the fairly new building in Santa Rosa on 10 Mendocino Avenue. 11 Commissioner Torliatt - Why 'didn't` this project go through SPARC for a preliminary 12 review before coming to Plamung_Conimission? 13 Planning Director- Tuft - Applicants are encouraged to apply for Preliminary SPARC but it 14 is not mandatory; timeline for this applicant was to obtain CUP first. 15 Commissioner vonRaesfeld - How will this project affect traffic at this intersection? 16 City Traffic Engineer Allan Tilton The site has limited access (triangular site); turning 17 movements will be restricted to some degree; City is gaining some right -of -way; designated 18 bike paths will be located on Caulfield, not on Lakeville Highway; Sierra Fence will be 19 restricted to right turn -in, right turn -out for access following improvements to Lakeville. 20 Commissioner Rahman - Is this a tight fit for on- site circulation? 21 Assistant Planner Grunt - On -site circulation is tight, but staff feels design will work;. 22 stacking onto Lakeville or Payran not identified as a potential problem; clarified circulation 23 through carwash. 24 25 The public hearing was opened. 26 27 SPEAKERS: 28 29 Peter Tobin - Tate and Associates - 1001 Galaxy Way, Suite 404; Concord, 94520 - 30 Engineer for applicant - Lakeville will be widened; 7 cars can stack at carwash; 10 cars can 31 refuel atone time; operation will include option for credit card pay at pumps; look forward 32 to working with staff on a great gateway design; no problems with any of" the conditions. 33 Commissioner Rahman - Will people entering from Lakeville conflict with cars exiting 34 from carwash? 35 Peter Tobin - From past experience /designs, no problem anticipated. 36 Commissioner vonRaesfeld - Parking seems light; what percentage of customers stop for 37 store, no gas purchase? Concerns with lack of parking; air /water , services. should count as 38 only one parking space; what about employee parking? On Payran? 39 Planning Director. Tuft Doesn't want to require m eployees to park off -site (on Payran); 40 CUP for Gateway Shopping Center specified employees must be allowed to park on -site 41 but management of Lucky Store has dictated to employees otherwise. 42 Commissioner vonRaesfeld - Concerns with handicap access and parking. 43 Planning Director Tuft ,- Striping of ark, ng and, clearly marked spaces for market will 44 prohibit confusion; another space could probably be found and striped if the Commission 45 feels the need. 46 Commissioner Torliatt - Potential for congestion at vacuum area. 47 Commissioner Thompson - How long will' each car be in carwash? 48 Dick Blankenfeld Shell Oil - 1.150 Bayhill. Dr., #.200; San Bruno, 94066 - Cars take less 49 than 1 minute in carwash (75 -100 per hour); new gas pumps are faster; majority (95%) of 50 customers buy gasoline and use either the carwash ormarket; only 5% use the store only. 51 Commissioner Thomson - Will there be a public phone, where will it be located? 52 Commissioner Rahman There should be a pay phone; how many employees at one time? 53 Dick Blankenfeld - 1 2 employees at a time; carwash is fully automated; carwash will be 54 free with gas purchase. The public hearing was closed. Commission Discussion - The existing station is immaculate, well kept; the trash enclosure fronting Lakeville should be relocated or screened substantially; discourage illuminated signage;; consider wooden signage because of important Gateway location; encourage applicant to look up and down Lakeville at newer buildings plus downtown for design ideas; glad to see another carwash closer to the east side; illuminated signs help travelers see services, but should be well, designed through SPARC; signs should not be visible from freeway, consider freeway information signs installed similar to those used by CalTrans; SPARC should be aware that Commission is not happy with any part of the existing architecture /design, not just minor items like the color; landscaping should be emphasized, monument signs can be designed to be very visible; consider incorporating wood into building /signage. A motion was made by Commissioner Rahman and seconded by Commissioner Torliatt to adopt a Mitigated Negative Declaration and approve three Conditional Use Permits for a gasoline service station with six pump islands, a 1,150 sq.ft. convenience market, and an automatic car wash, based on the findings and subject to the mitigations and conditions as follow: COMMISSIONER SHEA: Yes COMMISSIONER PARKERSON: Yes COMMISSIONER RAHMAN Yes VICE CHAIR THOMPSON: Yes CHAIRMAN BENNETT: Absent COMMISSIONER TORLIATT: Yes COMMISSIONER vonRAESFELD: Yes Findings for Approval of a Mitigated Negative Declaration of Environmental Impact 1. An Initial Study has been prepared and proper notice provided in accordance with CEQA and local guidelines. 2. Based upon the Initial Study and comments received, potential impacts could be avoided or reduced to a level of insignificance by mitigation measures attached as conditions of approval. There is no substantial evidence that the project, as conditioned, would have a significant effect on the environment. 3. The project does not have potential to affect wildlife resources as defined in the Fish and Game code, either individually or cumulatively and .is exempt from Fish and Game filing fees because no significant wildlife resources have been identified on the project site. 1. The proposed project, as conditionally approved, will conform to the requirements ,and intent of the Petaluma Zoning Ordinance, specifically: the project provides parking and setbacks in conformance with Zoning Standards and the project respects the provisions of Section 21 -403, Gasoline Stations. 3 188 Planning Commission Minutes May 10, 1994 2. The proposed project, as conditionally approved, will conform to the requirements and intent, goals, and policies of the Petaluma General Plan, specifically: the improvements required of the project will improve the traffic flow in the area; the project will provide improvement to adjacent public streets; the project will provide needed services to residents and visitors the project will, by virtue of conditions of approval, be designed to satisfy the Gateway design standard& of the General Plan. 3. The proposed project, with provisions for the treatment of any site contamination . and restrictions on lighting signs and outdoor storage, will not constitute a nuisance or be detrimental to the public welfare of the community inasmuch. as: the project will provide needed traffic improvements resulting in enhanced motorist safety; soil contamination will be remedied; .lighting, signage, outdoor displays, and other visually offensive activities are regulated through the project approval. 4. The prohibition of alcohol sales is appropriate given the location of this business in proximity to the :freeway and bicycle /pedestrian access to a local school, and testimony of the Police Department. Mitigation Measures 1. The project applicant shall dedicate property for public right-of-way use as follows: a. Thirty feet of Payran Street, as shown on this 3/15/94 submittal. b. The necessary road right- of- way-.required to accomplish the Lakeville Street widening consistent with the City of Petaluma Lakeville Highway widening project plans. The above- stated dedications shall be reflected a. deed which shall be recorded after acceptance by the City. 2. Frontage improvements shall be .constructed on Payran Street, Caulfield Lane, and Lakeville Street. Frontage improvements, as set forth below shall include conforming to the existing.. pavement grades, curb, gutter and sidewalk, all to conform to the Engineering Department's standards and specifications. 3. A public improvement agreement shall be, executed by the project applicant with the City prior to the issuance of a building; permit to assure proper installation and completion of the off -site construction. Improvement plans shall be prepared by a registered civil engineer for the construction within the public' right -of -way. All public improvements shall be completed prior to issuance' of a Certificate of Occupancy. a. The Lakeville frontage improvement& shall be coordinated and consistent with the City of Petaluma Lakeville Highway Widening Project plans. The relocation of the existing traffic signal equipment, the storm drain structures, street light, fire hydrant, power pole, and installation of handicap access ramps shall be designed and constructed by the project applicant: The project. applicant, upon request, shall be reimbursed actual costs incurred for the relocation of said facilities. The City shall not reimburse, to the applicant, any actual costs incurred 'over the City's estimated cost of $33,700. This construction shall be contained within the existing right - of -way. b. The Caulfield Lane improvements, as shown on this submittal, are acceptable to the Engineering staff except for what is mentioned above in Conditional Use Permit Condition #la on the corner of Lakeville and Caulfield. C. Payran Street improvements shall include a 24 -foot pavement section, a 6- foot sidewalk from face -of -curb to back -of- sidewalk and a handicap access ramp on the corner of Payran and Caulfield. The street improvements shall be constructed up to the easterly edge of the proposed Payran Street driveway. 4. The project applicant shall pay to the City prior to the issuance of the Certificate of Occupancy half of the project cost for the proposed traffic signal at Payran Street and Caulfield Lane. The proposed traffic signal at Payran Street and Caulfield Lane is included in the 1994 -99 City Capital Improvement Program and scheduled for installation in the fiscal year 1994 -95. Estimated project cost of said traffic signal is $150,000. If the Shell Station project occurs prior to the scheduled traffic signal installation, then the project applicant shall design and install the complete traffic signal. If the project applicant installs said traffic signal, the project applicant, upon request, shall be reimbursed by the City half the actual cost incurred by the project applicant for the design, construction, and inspection of the said traffic signal, not to exceed $75,000. 5. To insure adequate area for landscaping, the planters included on the proposed site plan shall be increased in size /area as generally indicated on Exhibit A. Site and landscape plans submitted for SPARC review shall be consistent with Exhibit A. The landscape plan shall be prepared to address the General Plan Gateway policies. 6. The project's site plan, landscape plan and architectural plans shall be referred to SPARC for review and approval. In their review, SPARC shall note that the project is located on a portion of Lakeville Street that is designated as a Gateway in the General Plan and as such shall be treated as a prominent entry to the City. Extraordinary design is expected. This extraordinary treatment should be reflected in innovative and high quality building and landscape design. 7. Plans submitted at time of application for SPARC review shall include the following: a. Architectural plans which contain detailed building elevations and a floor /site plan. All proposed exterior materials shall be identified, and accompanied by a materials and color board. b. A Sign Program including the locations of all proposed signs on the site plan, with details identifying their, size, design, and color. (Note: Signs shown on the plans are not approved as part of this project. All signs must be designed to conform with the Zoning Ordinance). C. A detailed landscape plan, consistent with the planting areas reflected on Exhibit A, that indicates the locations and species of all trees, bushes, and W1 190 Planning Commission Minutes May 10, 1994 1 ground cover. The plan shall include details for trellising, fencing, planting 2 wells and hardscape elements. 3 4 8. All exterior light fixtures shall be shown on plans: presented for SPARC approval. 5 All lights attached to buildings shall provide a soft "wash" of light against the wall. 6 All lights shall conform to City Performance Standards (e.g., no direct glare, no 7 poles in excess of 20 feet height, etc.) and shall compliment building architecture. 8 9 9. In the event that archaeological remains are encountered during grading, work shall 10 be halted temporarily and a qualified archaeologist shall be consulted for evaluation 11 of the artifacts and to recommend future action. 10. The project applicant shall be responsible for conformance with all local, state, and federal requirements for remediating and disposing of contaminated materials encountered during construction. In the event that an on-site groundwater remediation facility is required (e.g. pump equipment, plumbing, and pre- treatment tank) its location and measures to screen. it from views shall be subject to Administrative SPARC review and approval prior to installation. 11. To, mitigate the incremental demand for City services, the project proponent shall pay a Community Facilities Development Fee. To mitigate the incremental increase in demand for local school facilities, the project. proponent shall pay a School Facilities fee. Said fee shall be paid prior to issuance of a building permit. 14. To mitigate the incremental demand on City transportation systems, the project proponent shall pay a Traffic Mitigation fee. Said fee shall be. calculated at time of building permit issuance, and due and payable prior to issuance of a Certificate of Occupancy. 15. All grading and erosion control shall conform to the City's Erosion Control Ordinance 15.76. 16. Pursuant to Section 710 of the Uniform Plumbing Code, the car wash shall be adequately protected against storm or surface water and shall drain or discharge into an :intercepter of .an approved design for this use, to the satisfaction of the Chief Building Official, prior to the issuance of a building permit. 17. A mitigation monitoring plan consistent with the local CEQA Guidelines shall be prepared by the Planning Director prior to the issuance of, a building permit. Conditional Use Permit Conditions 1. All conditions of the Engineering Department shall be met, including: R 01 Planning Commission Minutes May 10, 1994 1 a. City staff will recommend to the City Council abandonment of the portion of 2 Caulfield Lane frontage in exchange for the dedications required in 3 mitigation #1, reserving from said abandonment public storm drain, public 4 sanitary sewer, PG &E easements and a public utility easement if deemed 5 necessary. A formal request must be applied for in the Planning Department 6 for the abandonment. The resulting Caulfield right -of -way shall be sufficient 7 to accommodate a curb -to -curb width of 75 feet with a 6 -foot distance from 8 face -of -curb to property line, in addition to handicap ramps and traffic signal 9 equipment on the comer of Lakeville and Caulfield. 10 2. The condition of the Water Department shall be met as follows: a. The project proponent shall provide upgraded water service as found necessary prior to issuance of a building permit. 3. All conditions of the Fire Department shall be met, including: a. Provide fire extinguishers 2A rated ABC dry chemical type as required by the Fire Marshal. 20 21 b. Post address at or near main entry door - minimum two inch letters. 22 23 C. No extension cords. All equipment and appliances shall be direct plug in. 24 25 d. Provide metal or flame retardant plastic waste cans. 1 6 7 e. All roof covering material shall have a class "B" rating or better, treated in 28 accordance with the Uniform Building Code Standard 32.7. 29 30 f. Permits for tank removal are required from both the Fire Marshal's office 31 and Sonoma County Public Health, Department, Hazardous, Materials 32 Division prior to beginning work. 33 34 g. Permits for tank installation are„ required from both the Fire Marshal's office 35 and the Sonoma County Public H_ ealth Department, Hazardous Materials 36 Division prior to beginning work. 37 38 h. All procedures for underground flammable liquid storage shall comply with 39 requirements on file with the City Fire Department. 40 41 i. Installation of water /oil separators, 3 compartment clarifiers and like 42 equipment, installed in the ground, is required. To have a permit from the 43 State Department of Toxics, contact (916) 323 -5871. 44 45 j. Provide absorbent material for containment and proper tools and container 46 for handling spills. 47 48 4. All conditions of the Building Division shall be met, including: 49 50 a. Soils with expansion index greater than 20 requires special design foundation 51 per Uniform Building Code 2904(b). 52 53 b. Mixed occupancy separation as described in Chapter 5 of the 1991 UBC must 54 be followed. 7 192 Planning Commission Minutes 5 May 10, 1994 C. Show site drainage and grading topography. d. Indicate all utilities on site plan. e. Responsible party to sign plans. L Submit soils report to verify foundation design. g. Indicate group occupancy, type of construction, square footage. h. Plans must show compliance to 1,991 UBC, UPC, UMC, and 1990 NEC. Plans must also show compliance to current Title 24 'Energy Code. i. Provide structural calculations for all non - conventional design items. j. Demolition permit required to remove any structure. All conditions of the Planning Department shall be met, including: a. All mitigation measures shall be adopted as conditions of project approval. b. No sale of alcoholic beverages is permitted. C. No outdoor storage of rental., trucks or trailers, stacks of tires or other merchandise shall be permitted except that any proposal, for temporary outdoor,display or sales including but not limited to banners, flags, streamers, tires, and oil may be permitted by the Planning Director through the issuance of a Zoning Permit prior to the event. d. There may be some soil and /or groundwater contamination on this site. Property exchanges from the Shell Oil Company to the City of Petaluma for necessary public improvements adjacent to the project site may be contaminated. Property conveyance(§) shall include 'language to defend, indemnify, and hold harmless the City from any actions brought against the City for 'damages and /or corrections due to said contamination, subject to staff review and approval. e. Construction activities shall comply with applicable Zoning Ordinance and Municipal Code Performance Standards (noise, dust, odor, etc.). L This use permit may be recalled to the Planning Commission for review at any time due to. complaints regarding lack of compliance with. conditions of approval, traffic congestion, noise generation, or other adverse operating characteristics. At such time, the Commission may revoke the use permit or add /modify conditions of approval. g. The applicants /developers shall defend, indemnify, and hold'' harmless, the City or any of its boards, commission, agents, officers, and employees from any claim, action, or proceeding. against the City, its boards, commission, agents, officers, or employees to attack, set aside, void, or annul,, the approval off the project when such claim or action is brought within the time period provided for in applicable State and /or focal statutes. Nothing contained in 2 this condition shall prohibit the City from participating in a defense of any 3 claim, action, or proceeding if the City bears its own attorney's fees and costs, 4 and the City defends the action in good faith. 5 6 7 8 10 ids II.
