41 Ordinance compliance issues, and request for direction to staff.

43 Senior Planning Technician Jane Thomson presented the staff report. - review of project
44 history.

A8 Chairman Thompson What building work has been done illegally?
9 Sr. Planning Technician Thomson reviewed Building Code violations and noted that
0 Building; Division requirements have not been satisfied and that building permit plans have
1 not been revised.

1 Chairman Thompson So permits have not been granted due to lack of information
2 submitted to the City Building Division.
3 Sr. Planning Technician Thomson - Some permits have been issued, some applied for,
4 many items still are illegal.
5 Cindy Heifner - Owner of property - No one lives in the garage /shed; has a building permit
6 with some items signed off, some not; has started tenant eviction; tenants have spread dunk,
7 etc., was not aware that construction has occurred without permits; submitted legal
8 paperwork to commence eviction of tenants; no one has ever lived in garage /shed; stairs in
9 front house were there when she bought the house - why do they need to De brought up to
10 code now ?; there has not been any construction work in the front house; trying to make
11 progress with violations; evicted tenants in front house last year and cleaned up property,
gave tenants in rear house a chance to clean up property, now they will be evicted.
Jim Mellon - 810 N. Webster - Lived there for four years; 2 problems - worst thing ever
done to move to this property; Heifner property is a hazard to the community, not safe for
children to play in his yard; large amount of cars on this property; bad language; 12 vehicles
parked on this property this weekend; met with Police on property 2 years ago, has, called
police 5 'times in the last month; many people live on property - not a single - family
dwelling; cannot sleep, too much noise to sleep; begging for some action to be taken to
clean -up this problem.
20 Commissioner Parkerson - Property owner indicates tenants will be evicted this weekend -
21 sounds like owner is making an effort to correct this problem.
22 Cindy Heifner - Wants 45 day extension after tenants are evicted to be able to clean up
23 property; am doing my best, I've been sick, there won't be any more problems, they are
24 moving now.
25 Commissioner Parkerson - Will 45 days be enough time?
"'6 Cindy Heifner - Yes, I hope so.
7 Commissioner vonRaesfeld - Building Code issues should be resolved in a few weeks; 30 -45
8 days should be sufficient amount of time to take care of all issues.
. 9 Planning' Director Tuft - Clarified that most of the problems with this property are a result
30 of increased intensity due to the CUP for the second unit; would like to commence CUP
31 revocation proceeding now - would take approximately 40 days; would like use permit
32 repealed ;if problems have not been taken care of in the time provided for in the Zoning
33 Ordinance.
34 Commissioner vonRaesfeld - Time should start now so abatement proceedings can
35 commence if necessary.
36 Commissioner Parkerson - Planning Director's suggestion to start the clock now is fair; if
37 all is done in time, revocation could be suspended and the CUP can remain in effect.
38 Ron Perry (property manager for Heifner) - Does that time -frame include drawing plans
39 and having them approved? Have resubmitted twice, different items listed each time for
40 review.
41 Chairman Thompson - City will. be very cooperative, I'm sure.
42 Per - Would like building inspectors to come to walk -thru at property site.

44 Commission Consensus (The following was read into the record):

46 1. The on -going use of the property at 334 and 334 -1/2 Bodega with the illegal
47 construction, dunk, garbage, rubbish, debris, and commercial activity is in violation
48 of'the CUP findings, conditions of approval, the Petaluma Municipal Code, Zoning
!49 Ordinance and Uniform Building Codes, and staff is directed to commence
0 revocation proceedings of the Conditional Use Permit to disallow a second unit on
1 the property, and to proceed with nuisance abatement proceedings through the City
2 Attorney's office.

10 Commissioner Torliatt - would like to schedule more speakers, maybe .continue discussions
11 on economic element or - plan for the City.
12 Commissioner Parkerson - could discuss scenarios of different downtown transportation
13 plans, railroad tracks might be used to shuttle people north /south through town.
14 Commissioner Torliatt - transit using existing facilities is an excellent idea.
15 Planning .Director Tuft - would Commissioners be interested in working with staff on small'
;16 sub- committees, informal meetings ?'
17 Chairman T1 - yes, informal meetings.
18 Commissioner vonRaesfeld - direction of new path of growth re: in -fill /reuse; zoning
19 ordinance inadequate on this subject; Downtown Design Guidelines,
'20 Commissioner Parkerson - likes subcommittee idea; maybe several members going in
21 separate directions, that's good.
22 Commissioner Parkerson - maybe 4:30?
23 Commissioner Stompe - Awanee Principles article from staff raises interesting design
24 issues.
25 Commissioner Thompson - signs on Gateway Center need to be improved upon, very
26 unattractive.
27 Planning Director Tuft - Corona /Ely has a shopping center site, another chance for center
28 sign design; will bring back a list of topics, subcommittee work suggestions.

33 - Rainier Interchange - Legislation to Council on Oct. 17
34 - McNear Hill - back on market - numerous meeting with many interested
35 developers.
36 - U -Haul - Appeal has been filed - want to display equipment at, street
37 frontage
'38 - Petaluma Oueen Storage Building - appealed Planning Commission's denial
139 of'floating storage I structure.
40 - Kodiak Jack's - appeal of denial of Use: Permit; also has appealed Director's
41 Zoning Ordinance interpretation regarding definition of bars /cocktail
42 lounges.
