That the selection of this site, with the limited access (school bus only) to Corona 16 Road meets the intent of the objectives and policies of the Petaluma General Plan 17 and Corona /Ely Specific Plan. 18 19 20 NEW BUSINESS 21 PUBLIC HEARING 22 23 II. WALT WATKINS; A -1 TAXI; 372 PARK PLACE DRIVE; AP NO. 149 -430 -009 Request for approval of an amendment to the Certificate of Public Convenience and Necessity for A -1 Taxi to increase the number of taxicabs operated inside City limits from 2 to 10. Principal Planner James McCann presented the staff report. The public hearing was opened. SPEAKERS: Commissioner Torliatt - Have the people who wrote letters expressing concern regarding parking been contacted? Principal Planner McCann - Yes, they have been apprised of off -site garaging and are no longer opposed to this request. Walt Watkins_ - Requested to make clear that he may pursue an appropriate site to garage the taxicabs within the city without the need to amend the Certificate of Public Convenience. The public hearing was closed. A motion was made by Commissioner Feibusch and seconded by Commissioner Torliatt to recommend to the City Council that they find the proposal to be exempt from the requirements of CEQA 'and approve. an amendment to the Certificate of Public Convenience and Necessity for A -1 Taxi, based on the findings and subject to the conditions set forth below: COMMISSIONER. The proposed expansion of the taxi company services, as conditioned, will conform 8 to the requirements and intent of the Petaluma Municipal Code and the Petaluma 9 Zoning Ordinance. 10 11 2. The proposed expansion of the taxi company services, as conditioned, will conform 12 to the requirements and intent, goals, and policies of the Petaluma General Plan. 13 14 3. The proposed expansion of the taxi company services, as conditioned, will not 15 constitute a nuisance or be detrimental to the public-welfare of the community. 16 17 Conditions 18 19 1. A -1 Taxi shall comply with all applicable provisions of Petaluma Municipal Code .20 Chapter 14. 21 22 2. A -1 Taxi shall be permitted to operate a total of ten (10) taxicabs inside City of 23 Petaluma city limits. Any proposal for increase in the number of taxicabs shall be 24 reviewed and approved by the City Council before expansion of service is made. 1 21 26 3. The business address for A -1 Taxi shall be 372 Park Place Drive, APN 149- 430 -009. 27 A relocation of the business to another address shall result in this certificate being 28 void, and shall be subject to review and approval by the City Council before 29 operations may re- commence. As proposed by the applicants, all cabs shall be 30 garaged at 1590 Eucalyptus Avenue, such location and proposed use being subject 31 to review and approval by the Sonoma. County Planning Department. A copy of the 32 Sonoma County Planning Department approval shall be provided to the City before 33 the commencement of operation of the additional 8 taxicabs. A relocation of the 34 storage of the cabs to an address inside city limits shall be subject to review and 35 approval by the City Planning Department. 36 37 4. The fare rates as approved by the City. Council 11/21/94 by Resolution 94 -310 are 38 still in force, and may only be changed by City Council action. 39 40 5. This Certificate of Public Convenience may be suspended or revoked for violation 41 of any of the terms of Chapter 14 of the Petaluma Municipal Code, or for violation 42 of any of the terms of the certificate, or for misuse or abuse of the privilege hereby 43 granted, pursuant to Chapter 14 of the Petaluma Municipal Code. 44 45 6. Before any of the additional vehicles may be operated, the additional vehicles shall 46 be inspected by the Police Department. Any defects uncovered during the 47 inspection shall be corrected and the vehicles reinspected by the Police Department 48 prior to commencement of use. 1 41 50 7. All drivers .of A -1 Taxi vehicles shall maintain a (taxi) driver's license issued through 51 the Central Permit Bureau (Finance Department of the City of Petaluma) before 52 commencement of operations. 53 3 8. All vehicles owned and operated by A -1 Taxi shall obtain annual vehicle permits issued through the Central „Permit Bureau. (Finance Department .of the City of Petaluma) before commencement of operations. All permits for taxicabs shall expire annually the thirtieth day of June. 9. Before a vehicle permit may be issued, and prior to the operation of any of such vehicles, there shall be filed with the City. Clerk a policy of public liability insurance executed and delivered by a company authorized to carryout any.insurance business in the state,'the financial responsibility of which company has been approved by the City Manager. 10. Drivers shall not meet or congregate, nor shall taxis be garaged at 372 Park Place Drive. III. BEN. SHIMEK; WEST PAYRAN SHELL, 900 PETALUMA BLVD. NORTH; AP NO. 150-011-005; FILE NO. CUP0045akt). Consideration of a Conditional Use Permit to legalize a pre - existing service station and to allow the conversion of the existing three service bays. to a 1,255 sq.ft. convenience market. Principal Planner McCann - Staff believes that the proposed conversion will create a more intense land use which will have increased traffic 7volumes. This increased. in traffic volume can be reasonably addressed througgh the closure of one of the driveways on Payran. Street and. with the dedication of right- of-way along. Petaluma Blvd. North. The dedication will permit future circulation improvement to Petaluma Blvd. North. Corn missioner'Torliatt How much more traffic is anticipated by virtue of this conversion? Will circulation be a problem? Traffic Engineer Allan Tilton Addressed General Plan circulation goals identified the goal of eliminating driveways at high volume 'intersections; right -of -way necessary for widening of the roadway to provide a continuation of the bike route; physical Co ick - Is there any data documenting Country Shopping Center redfvelops. ommissioner improvements would be deferred until the Town. ng bike trip ends (like auto trip ends)? Allan Tilton - No, have not seen any., but would be interested. Ben Shimek - Owner of business, Shell. Oil owns property; regarding Mitigation Measure 2 (right -of -way dedication), City is asking for a commitment that could create a serious problem. A. dedication of 6' would effect his canopy and pump :islands; has a problem with Mitigation #5 (delivery times restriction) - not realistic, need more flexibility; driveway closure no problem; concerns with Planning Condition No. 12 (parking) - number of parking stalls adequate, people. do not, pull away from pumps when they purchase convenience items; requeste41clanfication regarding Condition_ 13 (trash enclosures) - two enclosures or two containers? (clarification - one enclosure). Allan Tilton - Right -of -way required is actually less than 3' (not 6' as stated in the staff report). 4 367 1 Dick Bl'akenfeld - Shell Oil representative - opposes right -of -way dedication; he noted that 2 this is a minor project; dedication would render area unsafe; if Shell remodeled in the 3 future, dedication would be reasonable and acceptable; agrees to closing driveway and 4 additional landscaping; parking requested unnecessary (6 -7 spaces acceptable). 5 Planning Director Tuft - Suggests the deletion of Mitigation #3 (bonding for future 6 improvements) but the retention of Mitigation Measure #2 (dedication). Also suggested 7 that delivery hours can be more flexible - avoid 7AM - 9AM / 4PM - 6PM. 8 Principal Planner McCann - Clarification - only 1 trash enclosure required; parking 9 requirements can be modified to require six or seven spaces. 10 Commissioner vonRaesfeld - good idea to eliminate Mitigation #3; looks like dedication 11 area needs to be looked at more carefully. 12 Commissioners Wick and Thompson - Parking OK; Mitigation #3 should be eliminated; 13 right-of-way dedication should be eliminated. 14 Commissioner vonRaesfeld - More discussion needed regarding right -of -way dedication, 15 measurements need to be clarified. 16 Planning Director Tuft - Dedication is smaller than staff report illustrated; suggest to 17 continue this to another meeting for clarification. 18 Ben Shimek - Agrees, should continue to clarify. 19 20 The public hearing was continued to the Planning Commission meeting of March 28, 1995. 21 22 23 24 5 6 7 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 DEPARTMENT REPORTS IV. PROJECT STATUS: - Petaluma Queen outstanding conditions of approval - SPARC application received and approved; improvements must be within 60 days. - 334 Bodega Avenue (Heffner) - Has not been appealed - letter sent requesting compliance. - Zoning Ordinance interpretation appeal (Vieler) - City Council upheld Planning Director interpretation regarding live entertainment. - Pacific Theatres, Clegg, Terranomics Area Master Plan - Working toward Master Plan. - City Council Goal Setting Update - Will bring goals to Planning Commission when they are more complete.
