REPORT OUT OF CLOSED SESSION

City Attorney Danly reported that the Council unanimously directed the City Manager to
execute a settlement agreement between the City and Bus West as successor in interest
to California Bus Sales. Terms provide for a check to the City in the amount $23,871.59
and payments under the contract totaling $51,065.40, as well as the care by Bus West for
failed Telma retarder brackets and tailpipe hangers on the City's six cutaway buses.

Julie Akins, Executive Director, PCA TV, Petaluma, introduced herself and invited people
to get involved with PCA. Also stated that PCA wants to improve the quality of
broadcasting and she is delighted to serve the community.
Paul Francis, Member of the Old Eastside Neighborhood Association, Petaluma, spoke
about the East Washington place project and that his group had interviewed over 200
people in the neighborhood and noted that 68% of those interviewed, had no
information on the Kenilworth site. Requested that the neighborhood 500 foot
notification area be expanded to a three-quarter mile radius.
Tiffany Ren6e, Petaluma, wanted to follow up on the emergency operations presentation
and said that the library has an excellent history display of the Petaluma Fire
Department. Other tools for emergency preparedness are available online at
www.r)etalumanert.orq.
Ellen Bickler, Sustainable Petaluma, Petaluma, thanked the Council for their attention on
water issues and putting forth other ideas. She also thanked Director of General Plan
Administration Pamela Tuft and her staff, and stated that, "We should think ahead for the
next seven generations, specifically about water issues."
David Keller, Petaluma, spoke about a lawsuit filed in Sonoma County Superior Court
challenging the Sonoma County Water Agency's Urban Water Management Plan as
being inadequate. It has been challenged by a consortium of 14 organizations,
including the Sonoma County Water Coalition. Commented that the Council was on the
cutting edge of what the city needs to be doing regarding water. He also commented
on the General Plan DEIR and asked Council to specify exactly when they will be
revisiting the public comments on the DEIR, especially as it relates to the casino impacts,
greenhouse gases, and global warming.
Geoff Cartright, Petaluma, spoke about water issues and climate change. Encouraged
dredging which is federally funded.
Diane Reilly Torres, Petaluma, spoke about her PCA television program entitled "City
Watchdog." She reported that a week ago she interviewed Supervisor Mike Kerns
about Zone 2A, transportation and the casino issue. She attended the Zone 2A meeting
and filmed it. She encouraged citizens to attend these meetings. She also met with
Steve Arago about the plans for DSL site.

Mayor Torliatt suggested, and Council concurred, that because there were so many
present to speak at Public Comment for the Item 7B, the continued General Plan Public
Hearing, the discussion on Sub -Area 7C, Lands of Bennett, Sub -Area 7D, Lands of
Johnson; and Sub -Area 128, Sonoma Mountain Parkway, be continued to the April 16,
2007 7.00 p.m. Council Meeting. Sub -Area 8A, Lands of Davidon, and Sub -Area 11A,
Lands of DSL, would remain on tonight's agenda.

Toni Mattos, Petaluma, spoke in support of restriping as it helps to slow the
traffic.
Mark Goldman, Petaluma, spoke in favor of the road diet.
John Goldman, Petaluma, spoke in favor of the road diet. He was
concerned about getting out of his car on the street with trucks going by
at 40 MPH.
David Keller, Petaluma, spoke in support of this road diet, saying it is the
right thing to do, and that the Boulevard is overbuilt and is uncomfortable

moratorium. He urged caution about risk analysis as the flood plains are
higher than the 1987 FEMA floodplain maps. He requested that Council
accept this ordinance and seek completion of the final flood plain

Public Comment on Sub -Area 8A
Robert Bailey, Petalumans for Responsible Planning, Petaluma, spoke
about the Highlands project and the limit of 340 homes. He has had three
automobile incidents in front of his house in the past 25 years. His son's car
was demolished by a hit and run driver.
Marne Coggan, Petaluma, spoke about the guiding principles of the
General Plan. She requested that the Council vote in favor of the historic,
low -residential designation.
Trevor Pitts, President of the Victorian Homeowners Association,
Petaluma, stated that these hills are not very stable and subject to slides.
"The only safe development is to leave it alone and the zoning has to be
restricted."

Nancy Powell, Petaluma, spoke about appreciating the area and it being
a special area, and said traffic needs to be taken into consideration, as
well as the hillsides and the potential for failure from landslides. She
implored the Council to look at other options.
Sigrun Seifert, Petaluma, stated that she has lived in the area for 20 years,
and there needs to be mitigation for traffic, noise and air pollution.
Judy Sovel, Petaluma, said she was teacher at McNear school for 15
years. She spoke about educational opportunities that exist on this this
piece of property. She would like to see the park expanded for the
community. Some of the challenges are the lack of restrooms and the
fact that they have to walk through a neighborhood to get to the park.
She asked Council's help to preserve the park.
Catherine Edmondson, Petaluma, spoke about designation for this
property and his preference for open space. She spoke about Jeff Thayer
and past comments and meetings and how the neighbors have made
good faith efforts to get the issues resolved.
William Capps, Petaluma, spoke about his concern for development on
'D' Street and the traffic problems that need to be resolved. He said the
intersection of EI Rose and 'D' is a problem in the morning and will
become worse if more homes are built.
Tiffany Ren6e, Petaluma, spoke about the opportunity to instill a legacy in
Petaluma and in keeping something valuable to the community. She also
expressed safety concerns for residents in that area.
Sue Davy, Petalumas for Responsible Planning, Petaluma, said she
had discovered more history in the Argus -Courier about the Council in
1986 about the 340 limit. She asked that Council leave the land as nature
created and adhere to the growth limit of 340 homes. She would like to
see a large active community park and the barn buildings preserved as
a legacy for our grandchildren.
Gordon McCallum, Petaluma, stated that he doesn't want something built
on the property because the animals won't have a home, the creek
can't flow, and kids won't have any place to play.
Dave Libchitz, Petaluma, stated that he lives two miles from this property
and is not a neighbor, but an open space advocate. He stated that if
you lose the opportunity for open space, it never returns. The section
north of Kelly Creek should be zoned for housing no more than the current
housing; the section south of Kelly Creek, designated as park land.
Jerry Price, Petaluma, stated that the land is very unstable and prone to
sliding. However, since this is private property, there is an owner. His
dream for the property is at the end of 'D' street to add a very tasteful

Bruce Hagen, Petaluma, showed a Power Point Presentation of Kelly Creek
to music.
Bill Morgenstern, Petaluma, spoke that the General Plan 2025 should
require all significant housing developments story poles placed on site.
David Keller, Petaluma, spoke about the parallels between this and the
West Ridge Knolls development, and the "promises made, but never
delivered." Existing west neighborhoods were promised parks, but he has
not seen one acre in active park sites. There is no recommendation in this
General Plan for more parks on the west side. Zoning and land use should
not change until environmental documentation is available. In the
meantime, the alternative would be the entire site should be park land.
Reva Novey, Petaluma, proposed that they don't build any additional
houses and develop the land into a park.
Juliet Emerson -Colvin, Petaluma, questioned whether God wanted any
more houses to be built on this site.
Jeff Thayer, Davidon Homes, said it is impossible for him to respond to
every comment. Everything will be discussed in detail when they come
before Council to present the project. The process began with the City in
2002. He is not asking for an increase in density, only that their project be
evaluated given the current density.
Geoff Cartright, Petaluma, spoke about not being a NIMBY, but a victim of
flooding many, many times. He also has seen the increase in our water
bills as we suffer this diminished water supply. He stated that "We can't
build our way out of these problems."
Lydia Schindler, Petaluma, has lived here for 30 years and raised her
children here. At one time she contemplated leaving, but stayed
because she enjoyed walking through Helen Putnam Park. She is a
physician and knows that stress causes illness. She relieves stress by going
through the beautiful lands that people in other areas don't have.

Janice Cader-Thompson, Petaluma, stated she was upset about the
public hearing process, and found it extremely disappointing that this item
is being heard so late.
Steve Arago, Kimley-Horn & Associates, spoke about making some
progress and would like to speak further when the neighbors are in
attendance.
Mary Glarden, Petaluma, counted 25 neighbors were here tonight, but 20
left because of being too tired. She asked for mixed used.
Gary Parker, Petaluma, spoke about the impact and the value of their
homes if a "big box" store goes in.
Dianne Reilly -Torres, Petaluma, read an email from an east side resident
about the east side of town.
Jerry Price, Petaluma, spoke about this property and was surprised it was
not developed sooner. He sees no reason to change from mixed used to
commercial use.
Elaine Woodruff, Petaluma, supports the mixed use designation for the DSL
property. She believed mixed use is important because of water issues
and traffic issues.
Judy Davidoff, Steefel, Levitt & Weiss, San Francisco, stated she
represents DSL. She requested the designation of community
commercial. She stated they have an issue with the delaying of the
decision on the land use designation.
David Keller, Petaluma, said he wouldn't change the zoning at all or leave
it as it is. He stated any decision would be premature and recommended
