PUBLIC COMMENT
Mayor Torliatt noted that since only four Council Members were present, the General
Plan Public Hearina would be continued to the May 21, 2007 7:00 p.m. Council Meeting;
however, Public Comment on the item would still be heard tonight.
Marty Bennett, Co -Chair, Living Wage Coalition, and Executive Director, New Economy
Working Solutions, spoke regarding comments submitted for the General Plan review,
and the need for a Fiscal and Community Impact Report (FCIR) for proposed new retail
development of more than 25,000 square feet. Such a report would examine the impacts
of land use decisions that an EIR does not, such as the cost/benefit to public agencies,
contribution to local tax base, costs of Police, Fire, road and other City services, evaluate
types of jobs, wages and benefits, part-time/full-time, permanent or contingent, housing
created or lost due to the project, etc.
Peter Tscherneff, Petaluma, spoke the deplorable conditions at "factory farms."

Harold Martin, Jr., Petaluma and Windsor, is a medical marijuana patient
injured in an attack in Arizona. He was taking many sedatives and was like
a zombie, until his doctor told him he was a candidate for medical
marijuana. He has a medical marijuana card and must have it to get into
a dispensary. He says this is much safer than getting it on the street.
Lisa Gygax, Attorney at Law, Forestville, told Council that regulations don't
really work on those people who break the law, and that safe access is
needed for those who have legitimate need for medical marijuana.
Legitimate dispensaries are happy to be regulated.
Dick Sharke, Petaluma, Executive Director, McDowell Drug Task Force, told
Council, "Don't open an illegal -by -federal -standards drug dispensary on
the backs of our children. Don't tie the hands of our law enforcement."
Kumar! Sirades, Sebastopol, Sonoma Alliance for Medical Marijuana,
worked on medical marijuana ordinances for Sebastopol and Santa Rosa.
She has been to dispensaries all over the state and most are quiet,
discreet, and "on the up and up." She said she was deeply disturbed by
the presentation given by Chief Hood, which she thought was full of
misconceptions. She said 6 counties, 24 cities have established
dispensaries. She told Council, "Don't rush through a ban."
Peter Tscherneff, Petaluma, said he thought the Police Department was
the best location for a medical marijuana dispensary.
John Sugg, Caregiver Compassion Center, Santa Rosa, runs a permitted
dispensary in Santa Rosa, and has been able to work well with the Santa
Rosa Police once Santa Rosa's ordinance was in place. He urged Council
to consider allowing a dispensary in Petaluma to serve the community. He

says such dispensaries are "Primarily dedicated to serving sick people and
providing a safe place for them to get their medicine." He has not seen
any violence in his operation and does not know where that talk is coming
from.
Doc Knapp, Sebastopol, spokesperson for Sonoma County Alliance for
Medical Marijuana, educational advocates. He wanted to address
"definition" in the ordinances, and said small collectives and cooperatives
are very different than dispensaries. He believes the City's ordinance
should focus on dispensaries.
Sean Kerrigan, Petaluma, Director at Marin Alliance for Medical
Marijuana, which has been operating for 11 years. He gave Council a
packet of information showing how the dispensary is operated and said it
can be safe and of service to the community. He encouraged Chief
Hood to call the Chief of Police in Fairfax for a different perspective. He
was in favor of a dispensary next to the Police Station, which he thought
was the safest place to be. He feels dispensaries should have all
paperwork available on site for audit at any time.
Donna Franc, Santa Rosa, operates a dispensary on Santa Rosa Avenue in
Santa Rosa, and spoke with Congresswoman Lynn Woolsey, who she said
is supportive. She added she was appalled that the Drug Enforcement
Administration (DEA) would send a representative to this meeting to
attempt to intimidate the Council. Her dispensary has checks and
balances, has a CPA, pays taxes, unemployment, etc., and provides safe
access to women, disabled, and chronically ill. She asked Council to
please consider a study group and not rush to a ban.

Marcelle Guy, Petaluma, told Council she doesn't think that there is anything more
stressful than the fear of losing your home. She talked about laws to protect tenants from
retaliatory actions by landlords.
Susan Kirks, Petaluma, Paula Lane Action Network, invited Council and the community to
upcoming Paula Lane Action Network fundraisers.
Shelly Trumbo, Petaluma, referred to a letter she delivered on April 27 to Betsi Lewitter
and Council with a packet of information regarding the possibility of a velodrome for the
East Washington property.
Gene Hamm, Petaluma, showed a short animated video he made to illustrate his belief
that big box retail is not a good thing for Petaluma.

A. Public Hearing and Discussion of Draft General Plan 2025 and Draft
Environmental Impact Report: Receive Planning Commission
Recommendations on Draft General Plan 2025 and Recommendation
and Public Comments on Draft EIR; Close Public Hearings; Possible
Direction to Staff to Prepare Final Documents for Review. (Tuft)
Council is asked to discuss and/or provide direction on specific policy
issues pertaining to:
1. Development in the floodplain;
2. UGB possible expansion areas;
3. Mobility improvements;
4. Park standards;
5. Use of groundwater;
6. Prioritizing growth;
7. Public Art Committee's recommendation on dedicated TOT funding;
and,
8. Bullet points on the Davidon property.
Mayor Torliatt explained that the Public Hearinq would be continued to
the May 21, 2007 7:00 p.m. Council Meeting. However, individuals wishing
to contribute Public Comment could do so tonight.

Public Comment
Marianne Hurley, Petaluma, spoke about a letter written by the National
Trust for Historic Preservation. Heritage Homes voted in April to support all
the recommendations in the letter. She urged Council to support these
recommendations and include them in General Plan.
Wayne Morgenthaler, Petaluma, thanked Council for extending public
comment period to May 21 and spoke about civic economics - authors of
the study that show that money spent at local businesses
recirculates three times within the community, whereas money spent at
chains is spent and then gone from community.
Greg Colvin, Petaluma, Petalumans for Responsible Planning, spoke about
the Scott Ranch - Davidon Property, and said he appreciated the
direction given to staff on the way this property is to be handled. He
called this a parcel with "Enormous potential benefit to the community."
Camille Przewodek, Petaluma, announced that on Wednesday, May 9 at
Copperfield's Books at 7:00 p.m., Stacy Mitchell, author of "Big Box
Swindle" will appear. She urged attendance because she believes "It's
important for people to educate themselves about what big retail does to
a community."
Geoff Cartwright, Petaluma, spoke regarding the Washington Street
Interchange improvements and the need for a northbound ramp. He
thought the City might be able to get some help from Caltrans "if you
push." Regarding Rainier, he called it a "placeholder for development."
He doesn't see it happening easily, and said it will induce development in
the floodplain. "We do not need development, fill, or channelization in
the floodplain. It gets flooded!"
Richard Squaglia, Petaluma, said that development requires more than
space to put up a building, it takes support from the City. Just because
there's space available, it doesn't mean it's buildable. If there is not water
available or the infrastructure of the town can't handle the increased
burdens, the land is essentially unbuildable.
Mayor Torliatt continued the Public Hearing to the May 21, 2007 at 7:00
p.m. Council Meeting.

Mayor Torliatt opened the Public Hearina.
Tiffany Ren6e, Petaluma, asked what would happen if SCWA reduced the
City's water allotment.
Geoff Cartwright, Petaluma, said the City uses a little bit less than its
allocation from SCWA; however, development throughout the region is
exceeding the water supply.
Richard Squaglia, Petaluma, said this is "Like the elephant in the room that
no one wants to look at." He asked why the City is continuing to say it's
o.k. to build if there isn't going to be enough water. To build projects and
then come back and try to get everyone to sacrifice water for them is
ridiculous. Council needs to use foresight. He suggests cisterns to collect
rainwater.

Motion: Approve A. Resolution 2007-081 N.C.S. Adopting the City of
Petaluma's 2005 Urban Water Management Plan, with references in the
plan to the City's previous use of groundwater to supplement supply
during peak summer months to be changed to say simply that the City
has used groundwater in the past.
