A. Consideration of Options Regarding the Regulation of Medical Marijuana
Dispensaries and Cultivation; Adoption of an Urgency Ordinance and
Adoption (Second Reading) of a Ordinance 2269 N.C.S. Prohibiting the
Establishment and Operation of Medical Marijuana Dispensaries in the

Mayor Torliatt opened the Public Hearinq,.
Richard Sharke, Petaluma, McDowell Drug Task Force, said that there is no
such thing as medical marijuana. He hoped Council had looked at the
materials he had given them at the last meeting.

Seeing no one else wishing to speak, Mayor Torliatt closed the Public
Hearinq.
Motion: Approve an Urgency Ordinance Prohibiting the Establishment and
Operation of Medical Marijuana Dispensaries in the City of Petaluma, to
take effect immediately.

Bike to Work Week Awards.
Bernie Album, Petaluma, Pedestrian and Bicycle Advisory Committee
Chris Arras, Petaluma, Planning Commission Representative to the Pedestrian and
Bicycle Advisory Committee, presented the Golden Sprocket Award, given to the
business with the highest percentage of employees participating on Bike to Work Day.
Sonoma Technology won for the sixth consecutive year, with 36% of employees
participating.
Steve Reed, Sonoma Technology, accepted the award.
David Webster, Petaluma, Pedestrian and Bicycle Advisory Committee, presented the

Chain and Cluster Award, given to the delivery service with the highest percentage of
employees participating on Bike to Work Day, to DHL, with 1 I% of employees
participating.

organized his company's participation in the event.

Becky Choi, Petaluma, Pedestrian and Bicycle Advisory Committee, announced the
winner of the Bicycle Fork and Mini Wheel Trophy and $75, which is awarded to the
elementary school with the highest percentage of students participating on Bike to
Work Day. Corona Creek Elementary School was the winner, with 46% of eligible
students participating.
Bernie Album presented the Golden Handlebar and Bell Trophy and $100 award,
given to the junior high school with the highest percentage of students
participating on Bike to Work Day, to Kenilworth Junior High School.
Adam Donahue, instructor at Kenilworth Junior High, accepted the award.

Allen Tacy, Petaluma, Pedestrian and Bicycle Advisory Committee, presented the
Golden Chair Wheel and Crank Arm Trophy and $200, given to the high school with
the highest percentage of students participating on Bike to Work Day, to Casa
Grande High School. They have won every year since 2002 and had 213 students
participate this year.

Richard Brawn, Petaluma, spoke of illegal immigrants and cited numerous negative
effects he feels their presence in the United States has caused.

Geoff Cartwright, Petaluma, spoke of "big box" retail, which he says take money away
from local communities, and are not loyal to the communities in which they do business.
Stan Gold, Petaluma, spoke regarding the "economic multiplier effect," which states
that you get maximum economic advantage when you can spend the same dollar over
again in the same area. Therefore, he said, local businesses contribute to the strong
economy of the City, while chains do not.
Kelly Drake, Petaluma, spoke about flooding in Petaluma, while she was growing up, and
more recently. She left a series of photographs taken during the New Year's 2005 storm in
Youngstown Mobile Home Park for Council to see. She asked that Council address the
issue of flooding in Petaluma and the possibility of people dying when flooding occurs.
Gene Hamm, Petaluma, said the fight to keep "big box" retail out of Petaluma is a classic
David and Goliath story. The way he'd heard the story, David was the hero. But he said
that the opinions expressed by some Council Members and the editors of the Argus -
Courier put them "squarely on the side of Goliath." He believes Regency has been using
deceptive tactics to sell their project to the citizens.
Peter Tscherneff, Petaluma, spoke about You Tube; the problems of Vietnam Vets, many
of whom struggle with drug and alcohol addiction; hunger, and the Bible.
Kirk Andrade, Petaluma, told Council he's always thought Petaluma was a place with a
"nice balance." Now there are signs all around showing it's out of balance. He says
Petaluma faces a shortage of drinking water, flooding, and traffic - all because a "Small
number of people are making a lot of money."
Xander, Petaluma, Petaluma Neighborhood Association, said that the neighborhood
association is, "A group of citizens concerned about the future of Petaluma and the
dangers of 'big box' retail." He spoke about Regency using 'push polls' and other
unsavory tactics" and says there are here "to make money, period."
Chip Rees, Petaluma, spoke about a paper called the Coastal Traveler, from which he
read a description of Petaluma as a charming, historic town which has not yet been
taken over by "big box" retail. He gave copies to Council.
Shelly Trumbo, Petaluma, Petaluma Neighborhood Association, expressed concern
about the number of new homes being built in Petaluma, and how it will impact the City.
She is especially worried about there being sufficient water to support all this new
development.
Paul Francis, Petaluma, Petaluma Neighborhood Association, presented Council with
copies of the book "The Small -Mart Revolution: How Local Businesses Are Beating the
Global Competition," by Michael Shuman. He hopes Council will read it and resist the
current "zoning for dollars strategies" on the table in Petaluma.
Diane Reilly Torres, Petaluma, spoke about harassment of tenants at the mobile home
parks by park owners.
Bruce Hagen, Petaluma, spoke about a fundraiser for the Phoenix Theatre, to be held on

Direction to Staff to Prepare Final Documents for Review. (Tuft) -
Continued from May 7, 2007 meeting.

Mayor Torliatt opened the Public Hearinq. She explained that those
wishing to speak regarding any of the General Plan topics on tonight's
agenda except the Davidon Property would be called forward first.
Following that, Council Member Harris would recuse himself due to the
proximity of his home to the Davidon property. Members of the public

wishing to speak on the Davidon property would then be heard on the
Davidon property, followed by Council discussion. Council Member Harris
would then return to the dais for Council discussion on the other General
Plan topics.
Richard Brawn, Petaluma, complimented Director of General Plan
Administration Pamela Tuft on her work on the General Plan. He spoke
about the federal deficit and immigration problems.
Duane Bellinger, Petaluma, spoke about flooding and projected water
levels over the next fifty years.
John Cheney, Petaluma, said he remembers many projects that were
going to be "above flood level" which have flooded since they were
built. He said that EIR's don't work - at best, they are educated guesses.
He told Council, "It's time to stop building in the floodplain."
Diane Reilly Torres, Petaluma, did not like the fact that comments she
made at the Planning Commission Meeting about the General Plan were
not included verbatim.
Geoff Cartwright, Petaluma, spoke about flooding in Petaluma and the
dangers of building in the floodplain. He added that the hazard mitigation
in the General Plan does not prevent building in the floodplain. "It's time
to stop building in the floodplain. Put it in the General Plan."
Council Member Harris recused himself from discussion on the Davidon
property and left the dais.
Kathleen Billings, Petaluma, read a letter from Sheldon Vermont,
Petaluma, who had been unable to stay. He feels that it is important to
remember that Davidon does not have a vested interest in Petaluma, as
do those who live here, and should not be allowed to dictate Petaluma's
future. No changes should be allowed that are not in the City's best
interests. He urged Council to "choose the high road."
Stan Gold, Petaluma, read a portion of a March 28, 2007 letter to the
editor that appeared in the Argus -Courier regarding a previous Council
Meeting where this property was discussed: "Council Members Mike
O'Brien, David Rabbitt, Karen Nau and Samantha Freitas, please tell us
your compelling reasons. Why do you think that 22 homes are too few?
Inform us of the greater benefits that you think we the people will get, by
allowing even more houses to be built in this bad construction location."
He said he had not yet seen a response from any of these Council
Members in the Argus, and hoped he might hear an explanation tonight.
Pat Spiz, Petalumans for Responsible Planning, Petaluma, spoke about
how much she has enjoyed this property and how she is saddened to
think it is in danger. She is also concerned with potential development
"east of Windsor Drive," which she understands is also unstable land.

"surprised at the project" that Davidon "could come up with." He urged
them not to "tie their hands."
Sherri Fabre Marcia, Petaluma, Petalumans for Responsible Planning,

groundwater language with City Manager Bierman's suggestions that
groundwater will be used for emergency purposes, that the pumps will be
tested once a year or more often if needed, and that it may be necessary
to consider, at the end of the General Plan, in 2024, using 1 %
groundwater, if there has been total build out by that time.

limited amount of development in the "fringe areas" of the shallow
surface flow portion of the flood plain. No Council Members were willing
