MINUTES OF OCTOBER 8, 1991 were approved with corrections to pages 6 and 10.
PUBLIC COMMENT: None.
DIRECTOR'S REPORT: A.speaker name address sign -in sheet has been supplied on the
podium; ! annual Sonoma State Planning Seminar will be held on December 7 - more
information will follow.
COMMISSIONER'S REPORT: All Commissioners who attended the APA Conference in
Sacramento felt it was worthwhile; Commissioner Libarle asked that the Tree Committee
consider eliminating certain fire- and freeze -prone species of eucalyptus from the City
Street Tree List.
CORRESPONDENCE: Unsigned letter regarding California Co -Op Creamery and staff
action; Graphic regarding Jack -In -The Box; memo from Pamela Tuft to City Attorney
regarding Zoning Administrator's appeal process.
APPEAL STATEMENT: Was read.

PUBLIC HEARINGS
I. SOUTHPOINT BUSINESS PARK, SOUTHPOINT BLVD. AT NORTH
McDOWELL BLVD., AP NO.'s 48-080-21,30,31,32; 7-401-11,12,14,15,16,27,31,
34, 35, 36, 38, 39, 40, 41 AND 42; FILE NO. REZ91009(dd).
1. Consideration of a rezoning of the Southpoint Business Park from M -L
(Light Industrial) to PUD (Planned Unit Development) to permit a variety
of integrated uses.
The public hearing was opened.
SPEAKERS:
Commissioner Tarr - What is the zoning at Corona and McDowell Blvd. North? (Answer:
M -L).
Dick Lieb - Applicant's representative - Answered questions.
Commissioner Tarr - Feels this mixed use zoning is not being fully analyzed.
Commissioner Libarle - Mixed use (PUD) in business parks should be encouraged.
The public hearing was closed.
A motion was made by Commissioner Thompson and seconded by Commissioner
Parkerson to recommend to the City Council adoption of a Mitigated Negative Declaration
of Environmental Impact based on the finding and subject to the mitigations listed below:

Finding
1. On the basis of the Initial Study, there is no substantial evidence that the project as
mitigated will have a significant effect on the environment.
Mitigations
1. An acoustical analysis shall be performed before approving permits for an office or
commercial use on those lots located within 100 feet of the Highway 101 right -of-
way.
2. Any new lights shall be directed away from Highway 101. Lighted signs shall be
oriented away from Highway 101.
3. Development shall generally follow the mix of uses proposed by the applicant: 80%
of floor area for light industrial uses and 20% retail /office uses. If the applicant
wishes to change this mix of uses to include more retail /office uses, or to increase

the total floor area at build -out beyond 347,000 square feet, an amendment to the
PUD and a General Plan Land Use amendment will be necessary.
4. Traffic mitigation fees will be required prior to the issuance of a certificate of
occupancy. Each developer /applicant shall be responsible for the additional fees
required upon any change in use of an approved industrial space to office or
commercial use.
A motion was made by Commissioner Thompson and seconded by Commissioner
Parkerson to recommend to the City Council the rezoning of Southpoint Business Park and
adoption of the PUD Standards based on the findings and subject to the conditions listed
below:

Findings
1. The proposed Rezoning is in general conformity with the General Plan Land Use,
Community Health and Safety, and Community Character Chapters.
2. Public necessity, convenience, and general welfare clearly permit the adoption of
the proposed amendment by permitting a more viable and efficient mix of uses for
the business park.
Conditions
1. The master plan for the Southpoint Business Park shall be put into the form of PUD
standards and shall be amended to include the permitted uses, including the
requirement that no more than 20% of the floor area be devoted to retail and /or
office uses, based on the projected maximum build -out of 347,000 square feet
subject to approval by Planning staff.
2. The PUD Standards shall be modified to include No.'s 9, 10 and 11 as conditionally
permitted uses subject to a use permit.
3. Uses numbers 9 and 11 in the PUD Standards shall be modified to indicate that
these uses shall only be permitted as uses incidental to the industrial park.
4. Changes in use shall be reviewed by staff for compliance with the Parking
Standards.
5. Any exceptions to the Southpoint Business Park design guidelines shall be subject to
approval by Site Plan and Architectural Review Committee.

II. JACK -IN- THE -BOX, McDOWELL BLVD. NO. AND OLD REDWOOD
HIGHWAY, AP NO. 047-360-01, FILE NO. VAR91010(tp).
1. Consideration of a variance to reduce the required 20 foot setback for
parking adjacent to the McDowell Blvd. street frontage for Lot 1, Redwood
Business Park II PCD.
The public hearing was opened.
SPEAKERS:
Commissioner Parkerson - Is there a "stacking" standard in Petaluma? (Answer - No.)
Bill White - 13.01 Redwood Way - Property Owner - Project can work using either scenario.
Bill Fishel - 2395 American Lane, Hayward - Applicant - staffs proposal is workable - some
concerns for pedestrian safety.
Rey Mojica - 2395 American Lane, Hayward - Applicant - with larger stacking capability
driveway congestion is eliminated; answered questions.
Dick Lieb - Staffs plan presents potential safety problems; this is a very minor variance
request.
Commissioner Parkerson - Both plans are workable; would like to avoid a variance.
Commissioner Bennett - Safety is not a factor in either of these plans; supports staff.
Commissioner Thompson - Supports staff proposal.
The public hearing was closed.
A motion was made by Commissioner Tarr and seconded by Commissioner Parkerson to
deny a variance to reduce the required parking setback from 20' to 16' based on the
findings listed below:

Fines
1. There are no peculiar and unusual conditions inherent in the property in question
sufficient to cause a hardship, uncommon to all or most of the properties in the
immediate area.
2. Parking setbacks may be met through alternative site design and /or location of off -
site parking as permitted under Zoning Ordinance Section 20 -205.
Dick Lieb thanked the Commission for holding this special meeting.
Commissioner Tarr - Would like General Plan Map and Zoning Map in Council
Chambers.
