HEROLD IVIAHONEY, 239 WATER STREET, AP NO.006- 284- 18(jkt). L' ' Request" for approval from the Planning .Commission to allow. continued use of a portion of a property with a similar non - conforming use. The public hearing was opened. SPEAKERS: Commissioner Bennett asked staff to clarify what it was that the Commission was to determine. Planning Director Tuft clarified definitions in Zoning Ordinance regarding use permit requirements and non - conforming uses. Commissioner Nelson questioned if the stored /parked cars that look abandoned belonged to this business. Staff responded no. Planning Director Tuft staff can work with the Police Department to help Mr. Mahoney remove unwanted vehicles from his property. Herold Mahoney 2781 Middle Two Rock Road; owner of 239 Water Street: is aware of Building and Fire Department inspections and has made all corrections asked for; stored vehicles being restored; - he watches his parking lot to keep it cleared of unwanted vehicles; prior . uses of 239 Water Street included a cabinet shop, restoration of classic cars, tine business; automotive repair: Commissioner Tarr is willing to recommend an administrative - use permit to allow this use to be put on record, especially for future uses. Commissioner °Parkerson agrees with Commissioner Tarr; doesn't feel the use permit would be an inconvenience for the owner or tenant. The public hearing was closed. A motion was made by Commissioner Pa:rkerson and seconded by Commissioner "Tarr to direct applicant to apply for a minor conditional use permit, to be approved administratively, to bring the business at 239 Water Street into compliance with the Zoning Ordinance. The public hearing was opened. 2 City of Petaluma Planning Commission Minutes 11/26/91 L SPEAKERS: Commissioner Tarr - asked how this matter came to staff's attention; in the future, would like staff reports to reflect circumstances of complaints, etc. Jane Thomson Planning: an anonymous complaint was received. Planning Director Tuft In response to letter of concern from neighbor (received just prior to meetin washer and dryer 'relocation will-be added as an- additional condition; compost pit concerns would need to be referred to the Health Department as there is nothing in the Zoning Ordinance to cover this topic; concerns with P -trap and sewer will be directed to the Building Division. George Dowd 912 "F" Street: read letter regarding history of 916 "F" Street and how granny unit came into being; expressed concerns with washer and dryer location as well as P -trap and pipes; would not have any objections if building was brought up to code and relocated the washer and dryer. Jean Sutton owner, 916 "F" Street: unit was existing when she inherited home; willing to work with staff to resolve laundry issue. Commissioner Tarr How many people do you rent to? Any other complaints directed to you regarding the accessory dwelling? Chairman Libarle Asked Ms. Sutton if she was aware of conditions in staff report. Ms. Sutton One tenant rents the unit; no one else in the neighborhood has complained; aware and agrees with conditions in staff report. Commissioner Parkerson supports condition regarding washer and dryer; feels accessory dwelling is a nice addition to property. Commissioner Tarr There was a similar dispute on "F" Street - how was that one resolved? Planni'n'g Director Tuft Staff is still working with, the applicant and neighbor to resolve fence issues, project currently has a pending appear. The "F" Street unit was also identified through an abatementprocess. Commissioner Tarr Would. like staff to. investigate illegal accessory dwellings in this neighborhood; is becoming uncomfortable approving these one at a time. Commissioner Parkerson Feels accessory dwellings are necessary; feels .City regulations and policies have made provisions for second units. Commissioner Tarr In regards to the Boys & Girls Club, there were concerns with traffic ., impacts; concerned with more impacts on neighbors in a concentrated area; need to have an idea of how many more units are in Petaluma and at least try to plan for it. Commissioner Bennett Agrees with Commissioner Tarr that illegal units need to be brought up to,standards with City codes; feels the policy of this City is to encourage in -fill units for better utilization of housing as well as low -cost housing; it is a given that these units will increase traffic. Commissioner Nelson Feels that Commission is seeing the second units through the process of abatement and that this is not a good way of acquiring second units; area may become concentrated with second units. Commissioner Parkerson feels that most accessory units are coming before the Commission through the process of the public wanting the units, not through abatements. Chairman Libarle agrees with Commissioner Parkerson.. Planning _Director Tuft Concerns from neighbors have, more to do with the activities of the occupants of the second units rather than density or traffic impacts; would be happy to check files to see how many units have come before the Commission through abatements. Commissioner Tarr Additional density does cause more problems with neighbors; why have a use- permit if they are routinely allowed? Chairman Libarle: Would like to make the issue of second units a topic for discussion for a 21 future! meeting. Dick Lie One Bodega Avenue, applicant representative: unit remaining is smaller than this one, and owner is aware that future tenant will need to have low intensity parking needs; peak parking demands for doctors and fitness center differ; Mr. Stevens has allowed parkingioverflow in the evenings onto the DMV lot; no exterior changes are needed for this office. Commissioner Tarr Questioned why the doctors are locating farther away from the hospital: Dick Lieb The doctors wanted to locate next to the health club; cardiology becoming less invasive; there is a growing trend for doctors to be near or located in a health club facility, and also easy referral for clients. Planning staff finds on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. St. Skip Sorrimer 501 East Washington, applicant representative: project is a huge downgrade of use and related environmental impacts (noise, traffic, visual impacts, eight vehicles as opposed 4 t o hundreds) from previous use; 80% of business done in the field with 20% of business repairing equipment on the premises. Planning ?Director Tuft Mitigation doesn't necessarily address cleaning of the vehicles - it would address the cleaning of debris found on the pumps brought to the site for repair (oil, etc.) and how they should be cleaned so that contaminated water would not flow into the river or the sewer system. Commissioner Tarr In moving from a small to large location, what will take place on the rest of the property? Mr. Sommer Nothing has been planned yet; owner may sublease part of site. Study and any comments received there, is no substantial evidence that the proposed project with the following mitigation will have a significant effect on the environment. Mitigation Prior to being stored and /or worked on, all materials or equipment should first be cleaned of all soil deposits, oils and other residue, if any, that may otherwise be washed from the site through storm runoff or other means and properly disposed of through the use of a City approved waste management system. Findings of Exemption for Department Of Fish And Game De Minimis Impact An _initial study has been conducted by this lead agency, which has evaluated the potential for this project to cause an effect -- either individually or cumulatively--on wildlife resources. For this purpose, wildlife is defined as "all wild animals, birds, plants, fish, amphibians, and related ecological communities including the habitat upon which the wildlife depends for its continued viability ". 2. There is no. evidence that the proposed project would have any potential for adverse effect on wildlife resources. Whenever necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements. What is future use directly adjacent to the cluster of compact parking spaces? be constructed with the Lakeville Ms. Dolan There will be an right - turn -only entrance to Widening Project, and another entrance off Marina Drive; Fish & Game has seen this plan and approved it; compact spaces not looked at. Planning Director Tuft SPARC typically looks at compact spaces ratio and location; Lakeville widening project .currently under review by Caltrans. Commissioner Parkerson Design Guidelines for future buildings? Ms. Dolan Staff would like to see consistent architecture throughout the site. Richard Coombs 5510 Skylane Blvd., Suite 202, Santa Rosa, owner /MOPA;representative: explained original and existing boundaries and the proposed addition of spur, additional acreage will allow MOPA to dress up the entrance to their site; has worked with Fish & Game and those issues have been resolved; there is a need to enlarge the hotel; concurs with staff that fastfood restaurant be a conditional use; from Lakeville Highway, only the roof structure of the project would be visible, so would prefer signage to be designed into the roof architecture; wanted program to be changed to permit up to two buildings on the 1.3 acre site. Ms. Dolan Staff would not have a problem with allowing two buildings on that site. Commissioner Parkerson Has been working with a detailed site plan; will want to see how new buildings will be proposed on the site. Planning Director Tuft Regarding PUD and PCD zones, PUD does require elevation plans to be submitted, PCD does not. Commissioner Parkerson Concerned with continuing consistency of project; regarding signs, language is different that what has already been approved? Mr. Coombs Sign program does not cover the spur, an d he is suggesting changes to the program to reference the river and the freeway. Plannrn� Director Tuft Quoted section from PCD program regarding signs. Commissioner Tarr: Feels more comfortable deleting reference to freeway. Commissioner Parkerson Concerned with any fast food facility in this project. Mr. Coombs Agrees to move fastfood to a conditional use; hopes to find a free - standing restaurant that is not fastfood, but marketplace is dictating that only the fastfood restaurants are currently finding financing; does not want a project this size to be without food facilities. Commissioner Nelson Sees this as a high- amenity area. Commissioner Tarr In reference to freeways and signage, is there anything in the Zoning Ordinance? Mitigations Hydrology: 1. The proposed additional buildings and parking lot areas shall be designed to avoid filling or otherwise adversely affecting the capacity of the drainage channel to the satisfaction of the City Engineer, the Sonoma County Water Agency, and possibly the Corps of Engineers. Certification by a registered professional engineer must demonstrate that any encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge. 2. The project sponsor shall comply with all applicable City policies and ordinances regarding development in Floodplain Corn imng districts, and other regulations contained in Zoning Ordinance Article 16 and Municipal Code Chapter 17.30 "Storm Drainage Impact Fees." 11 30 City of Petaluma Water Quality Planning Commission Minutes 11/26/91 3. The applicant shall submit a landscaping plan with an development plans to improve the banks and provide a buffer zone along the ch aim els .in the vicinity of AP No. 005- 060 -06, which shall utilize native riparian and upland species where appropriate, subject to approval by SPARC with review and comment from the Department of Fish & Game. Biological Impacts 4. The development plan shall include the widening of the lower end of the channel on 'the portion of APN NO. 005. 060 -60 to be included in the _PCD, as an enhanced wetlands area, and a mitigation monitoring program, subject to approval by the Department of Fish and Game prior to construction or grading on the parcel. Air Quality /Traffic ` 5. Cumulative impacts on air quality from the proposed project shall be mitigated by encouraging the use of alternate forms of transportation in the following ways: a. Design not already approved buildings and related facilities to emphasize convenient bicycle access, pedestrian and public transportation subject to approval by SPARC. b.
