COMMISSIONER'S REPORT: Commissioner Parkerson reported that trees at Parent- Sorensen have been marked for trimming and /or removal, including marks on oak that was to be preserved. TIM STUHR, PAYLESS DRUG STORE, 365 E. WASHINGTON STREET, AP NO. 007 - 072 -41, FILE NO. CUP92007(dh). 1. Continued consideration of environmental exemption. 2. Continued consideration of an amendment to existing Conditional Use Permit to allow expanded outdoor display of plants in parking area. The public hearing was opened. SPEAKERS: Jim McCann presented the staff report. Commissioner Parkerson - Condition of Copeland Avenue is very bad - employees may have hard time negotiating the road. Pamela Tuft - If Payless is serious about enforcing parking requirement, this proposal will be feasible. Commissioner Bennett - Will this parking requirement only be in force March through August? , Commissioner Tarr - Any recommendation for screening of parking area? Jim McCann - No screening /landscaping is recommended;/ parking enforcement only needed during period of outdoor display. Commissioner Nelson - Payless is easily accessible to west side homeowners; very large trucks park in front often delivering plants and making maneuverability difficult; very disappointed that there was a tent sale last weekend especially when this item was scheduled for Planning Commission review tonight. Walter Kieckhefer - Owner, Lakeville Shopping Center - employees should be parking farther away from building; staff report is totally satisfactory; sales of plants is a great success for this Payless store; 12 employee parking spaces at rear of property is a good idea; late shift would like to be allowed to park in front (but away from entrance) to allow for safety; store manager should be able to work with the truck drivers regarding their delivery schedules. Jim Stuhr - Payless Manager - tent sale has always been held on Memorial Day weekend (corporate offices required tent sale to be held); employees are aware that parking may be required to be moved to rear of building - they are willing to comply; trucks parking in front can be required to deliver to rear. Commissioner Libarle - What is liability to City of Petaluma regarding Copeland Street? Allan Tilton - Traffic Engineer (City of Petaluma) - The City has no jurisdiction over maintenance of Copeland and no liability. Commissioner Rahman - Was tent sale a big problem this weekend? Tent sale should not be banned in the future; trucks should be required to deliver in the off -hours (early in the morning). The public hearing was closed. This use will not constitute a nuisance or be detrimental to the public welfare of the community due to the conditions of approval. Conditions 1. All, previous conditions of approval (8/16/77, 8/21/79 and 10/8/91) shall remain in force, and be made a part of this approval. 2. The. seasonal display of nursery items shall be located as indicated in Exhibit "A ". At no time shall the items for display /sale /storage outside block the entrance /exit doors, emergency exits, handicapped "parking, entry ramps for safety, 2 phone booths, or newspaper racks at the Payless Drugstore. 3. The use of these areas for seasonal display of nursery items shall be restricted to the months of March through August. 4. Display merchandise in the outdoor area shall include only plants. Display of landscape- related merchandise (e.g., peat moss, fertilizer, tools, patio furniture) shall not be permitted. 5. The management of Payless shall, in writing, direct all employees to use the designated employee parking spaces at the rear of the store only. A copy of this notice shall be sent to the Planning Department. 6. This amendment is unique to Payless Drugstore at 365 East Washington, and does not infer the right for any other business in the center to use the outdoor areas for display /storage without first applying to the Planning Commission for an amendment to the Use Permit for the Shopping Center. 3 PLANNING COMMISSION MINUTES 169 MAY 26, 1992 7. Daphne, Shapiro - 407 Kentucky - across street from proposed center - 4 -way stop sign is a must; parking problems exist now without daycare center in operation; did not receive City notification of this meeting; Lombardi's does not bake on Wednesdays and there is not as much of a parking problem on that day; concerns regarding loss of three parking spaces on Kentucky. Dr. A. Hilderbrand applicant - Staggering of arrival /departure of children - no problems anticipated with arrival times; adult must escort child into the daycare center; issue of parking ashould not be made worse by this project - loading zone should make parking better; recommended fence heights are no problem. M 170 PLANNING COMMISSION MINUTES MAY 26, 1992 Commissioner Parkerson - Could you supply rosters of arrival /departure times if necessary? Dr. Hilderbrand - Yes. David Fietz - Property owner - operates office in the building; many of the cars now parked on street are non- operational (parked there by neighboring car repair shops). Commissioner Parkerson - Would City recommend a four -way stop on Kentucky and Oak? Allan Tilton - City is looking at that area now for additional stop signs; looks like a good candidate for a stop sign at this time; pedestrian loading zone has time. limits (M -F 6AM - 6PM); may help alleviate some of the parking problems in this area. Commissioner Rahman - Can neighbors request a stop sign through the Traffic Committee? Commissioner Tarr - Does this type of use require one space per employee (off- street parking) and does it require any off - street parking for risers? Allan Tilton - Typically there are rushes during certain hours in AM and PM. Pamela Tuft - Additional parking on -site could be required per Planning Commission discretion; felt that on- street parking should be adequate; staff could work with applicant to create more on -site parking. Commissioner Parkerson - A few more spaces should be required on -site. Commissioner Bennett - How is parking working out at Montessori School? Pamela Tuft - To my knowledge, there have not been any complaints. Commissioner Libarle - This 2 -hour parking zone could be enforced better than it is by the Police Department. Pamela. Tuft - Some parking options could be explored with the applicant. Commissioner Libarle - If there are parking problems after operations begin, they can be addressed then. Commissioner Bennett - Administrative SPARC - neighborhood should be taken into consideration (i.e. landscaping, etc.). Commissioners RahmaUnompson - Should try this project - it can be recalled to this Commission if there are problems. Commissioner Parkerson - supports staff report. Commissioner Tarr - Concerns regarding parking; two -hour parking limit should be enforced;, off -site (not on- street) parking could be considered; some employers in area should be notified that employees are possibly causing parking problems. Commissioner Rahman - Since this area has been identified as an area with parking problems, could there be a request for more enforcement made to the Police Department? The public hearing was opened. On the basis of the initial study and any comments received there is no substantial evidence that the proposed project with the mitigations listed per conditions 2a and 4 through 10 will have a significant impact on the environment. 2. There is no evidence that the proposed project would have any potential for adverse effect on wildlife resources. Mitigation Measures (D 1. The 2 -hour parking sign on Oak Street near the entrance to the facility shall be C V ) replaced with a loading zone sign for parent drop- off /pickup prior to occupation CY) and operation of the facility. 2. At no time shall the children be left unsupervised in the building or on the play- grounds. 6. All proposed fencing (wood and chainlink) outside of the required setback shall be a minimum of 6' tall to insure containment of the children and prevent contact with strangers outside the facility, subject to staff review and approval prior to occupation and operation of the facility. 7. The existing wood fence across the northerly boundary and the 4'6" chainlink fence across the easterly boundary shall be replaced or adjoined by a solid wood fence a minimum of 6' tall to insure containment of the children and reduce noise and visual impacts between the adjoining properties, subject to staff review and approval prior to occupation and operation of the facility. 8. Play equipment within the play yards that exceeds 8' in height should be located a minimum of 5' from the perimeter property lines. These mitigations are incorporated as conditions 2a and 4 -10 below. The proposed Day Care Center, as conditioned, will conform to the requirements and intent, goals, and policies of the Petaluma General Plan. 2. The proposed Day Care Center, as conditioned, will conform to the requirements and intent of the Petaluma Zoning Ordinance in that the project has adequately addressed all applicable sections of the Ordinance pertinent to issuing this use permit within the RMG District. 3. The proposed Day Care Center will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. All requirements of the Fire Marshal shall be met, including: a. Provide fire extinguishers 2A rated ABC dry chemical type as required by the Fire Marshal. b. No extension cords. All equipment and appliances shall be direct plug -in. C. Provide metal or flame retardant plastic waste cans. d. Post address at or near main entry door - minimim two -inch letters. e. Occupancy Class - E3. f. Storage and janitor closets shall be of one -hour fire resistive construction with openings protected by 3/4 hour assemblies. g. Total occupancy - 41. h. Exit doors, gates shall be openable from the inside without the use of key or any special knowledge or effort. i. Gates shall be provided where requested to allow access in the event of an emergency. j. Provide exit signs at required exits. k. An emergency fire plan shall be posted including the following: 1. Fire Department phone number - 9 -1 -1. 2. Assignment of person responsible to call Fire Department in case of an emergency. 3. Evacuation routes leading to public way. 4. Instructions to be followed by teacher /instructor: teacher /instructor shall remove roll book from classroom to call roll call, and shall maintain order during evacuation. 7 1 PLANNING COMMISSION MINUTES MAY 26, 1992 1. Fire drills required monthly. A drill log is required for all drills for future inspections by Fire Department or other agencies. M. Provide smoke detectors in napping room and in school room area. n. Provide additional device for teacher /instructor to sound a fire /emergency alarm and use for drills. o. Use Permit from Planning Department is required. 2. All requirements of the Engineering Department shall be met, including:. co a. The operation of the preschool /day -care shall be limited to the hours between 6:30 AM to 6:30 PM Monday through Friday. 7. The type (common and botanical name) and placement of all plant material within the existing and proposed planters; b. Two additional street trees - one on the east side of the driveway on Oak Street and one on the north side of the driveway on Kentucky Street; C. All fencing required per conditions 8 and 9 shall be indicated. Details of the fencing shall be provided. 12. All landscaping approved on the landscape plan shall be installed within 45 days of occupancy and operation of the facility subject to staff review and approval. 13. All trees shall be a minimum fifteen gallon size (i.e. trunk diameter of at least_ 3/4 inch measured one foot above the ground) unless otherwise specified (e.g.: 24" box or specimen size) and double staked; , all shrubs shall be five gallon size. All landscaped, areas not improved with lawn shall be protected with a two -inch deep bark mulch as a temporary measure until the ground cover is established. 14. Root barrier systems shall be utilized for trees near streets or walkways as needed, subject to staff review and approval. 15. All plant material shall be served by a City approved automatic underground irrigation system. 16. All planting shall be maintained in good growing condition. Such maintenance shall include, where appropriate, pruning, mowing, weeding, cleaning of. debris and trash, fertilizing and regular watering. Whenever necessary, planting shall be replaced with other plant materials to insure' continued compliance with applicable landscaping requirements. Required irrigation systems shall be fully maintained in sound operating condition with heads periodically cleaned and replaced when missing to insure continued regular watering of landscape areas, and health and vitality of landscape. materials. 17. This use permit may be recalled to the Planning Commission for review at any time due to complaints regarding lack of compliance with conditions of approval, traffic congestion, noise generation, or other adverse operating characteristics. At such time, the Commission may revoke the use permit or add /modify conditions of approval. 18. All work, within a public right -of -way requires an excavation permit from the Department of Public Works. 19. Construction activities shall comply with applicable zoning ordinance and municipal code performance standards (noise, dust, odor, etc.). 20. All parking surface areas shall be bordered with concrete curbing which is designed to meet at least the minimum specifications of the City Parking Design Standards. 21. Permit(s) for all ;outdoor advertising signs must be obtained through the Building Department,and be designed to conform with the Zoning Ordinance. Any outdoor advertising signs shall be submitted for review and approval by the Planning Department. Disappointed - the City, is not being. dealt with fairly by the developer; opposed to further extension of any kind after is one is approved. Commissioner Parkerson - Agreed with Commissioner Libarle - no further extensions. A motion was made by Commissioner Thompson and seconded by Commissioner Bennett to approve a one -year extension for the Vesting Tentative Map to April 16, 1993 with the comment;that the present Planning Commission does not support any further extensions.
