2. Consideration of a Conditional Use Permit to allow the operation of a day_
care /preschool.

Planning Director Tuft presented the staff report.
Commissioner Read - Concerns with this use at this location - traffic will. be a problem;
what will layout of interior space be ?; requested information regarding ingress and egress.
Planning Director Tuft - Reviewed the site plan for traffic flow patterns.
Commissioner Rahman - Were there any complaints from the neighbors?

Allan Tilton - City Traffic Engineer - The circulation here will be much better than on the
previously proposed site for this project.
Mary Abascal- Hildebrand - Appliciant - Answered questions regarding services offered; 32
children ('potentially) in all -day care; 18 in partial daycare; traffic should not be a problem;
plans to reuse the existing sign.
Commissioner Read Where will the staff park?
Dick Lieb - Applicant's architect ! Clarified sign usage; lighting will be toned down in
intensity; `restriping of parking lot will not add more parking spaces - parents can stop
behind staff cars to drop off children.
Commissioner Parkerson - Good use for this location.
Commissioner Read - Will this Use Permit run with the property?
Planning; Director Tuft - Yes.
Commissioner Tarr - No problems with access off the Boulevard; this is a good location;
the setback from the Boulevard is vood.
The public hearing was closed.
A motion was made by Commissioner Bennett and seconded by Commissioner Tarr to
adopt a Mitigated Negative declaration based on the findings and subject to the following
mitigation measures:

Findings
1. On the basis of the initial study and any comments received, there is no substantial
evidence that the proposed) project, with the following mitigations, will have a
significant impact on the environment.
2. There is no evidence that the proposed project would have any potential for adverse
effect on wildlife resources.
Mitigation Measures
1. Drop -off and pick -up of chi) ren shall be staggered to all extent possible to reduce
traffic congestion and increase safety.
2. Parents shall be encouraged to walk their children to and from the facility premises.
3. The operation of the preschool /daycare shall be limited to the hours between 6:30
AM to 6:30 PM Monday through Friday.
4. At no time shall the children be left unsupervised in the building or on the
playgrounds.
5. All proposed fencing (wood, chainlink, etc.) shall be a minimum of 6' tall to insure
containment of the children and prevent contact with strangers outside the facility,
subject to staff review and ap�roval prior to occupation and operation of the facility.

6. Play equipment within the play yards that exceeds 8' in height shall be located a
minimum of 5' from the perimeter property lines, subject to staff review and
approval.
A motion was made by Commissioner Bennett and seconded by Commissioner Rahman to
approve a Conditional Use Permit based on the findings and subject to the following
amended conditions:

Findings:
1. The proposed Day Care Center, as conditioned, will conform to the requirements
and intent, goals, and policies of the Petaluma General Plan.
2. The proposed Day Care Center, as conditioned, will conform to_ the requirements
and intent of the Petaluma Zoning Ordinance in that the project has adequately
addressed all. applicable sections of the Ordinance pertinent to issuing this
Conditional Use Permit within the C -C District.
3. The proposed Day Care Center will not constitute a nuisance or be detrimental to
the public welfare of the community.
Project Specific Conditions
1. All requirements of the Fire Marshal shall be met, including:
a. Provide fire extinguishers 2A rated ABC dry chemical type as required by the
Fire Marshal.
b. No extension cords. All equipment and appliances shall be direct plug -in.
C. Provide metal or flame retardant plastic waste cans.
d. Post address at or near main entry door - minimum two -inch letters.
e. Occupancy Class - E3.
L Storage and janitor closets shall be of one -hour fire resistive construction
with openings protected by 3/4 hour assemblies.
g. Total occupancy - - -41 to be determined by the Fire Marshal prior to
commencement of use.
h. All gates shall be openable without a key or special knowledge for
emergency ingress or egress.

is Gates shall be provided where requested to allow access in the event of an
emergency.
j. Provide exit signs at required exits.
k. An emergency fire pl�n shall be posted including the following:
1. Fire Department phone number - 9 -1 -1.
2. Assignment of person responsible to call Fire Department in case of
an emergency.
3. Evacuation routes leading to public way.
4. Instructions tc be followed by teacher /instructor: teacher /instructor
shall remove roll book from classroom to call roll call, and shall
� maintain orde during evacuation.
1. Fire drills required monthly. A drill log is required for all drills for future
inspections by Fire Department or other agencies.
m. Provide smoke detectors in napping room and in school room area.
n. Provide additional device for teacher /instructor to sound a fire /emergency
alarm and use for drills.
o. Use Permit from Planning Department is required.
2. All requirements of the Chief Building Official shall be met, including:
a. Indicate group, occup�ncy, type of construction and square footage.
b. Wet signature and stamp by a licensed registered California architect is
required on all plan sleets.
C. Plans must show compliance to the 1991 UBC, UPC, UMC and 1990 NEC.
Plans also to show ,compliance to the current T24 energy regulations and
handicap standards.
d. Revise dimensions of handicap parking stall and unloading area to comply
with the City of Petaluma standard detail for, handicapped parking
requirements.
3. Proof of licensing from the* Department of Social Services Community Care
Licensing Division shall be provided prior to occupation and operation of this
facility.
4. If the operators of Little Oaks do not use the free standing sign fronting the
boulevard for advertisement i it shall be removed within 45 days of this Conditional
Use Permit approval.
Standard Design Conditions
5. All' plant material shall be served by a City approved automatic underground
irrigation system.

6. All planting shall be maintained in good growing condition. Such maintenance shall
include, where appropriate, pruning, mowing, weeding, cleaning of debris and trash,
fertilizing and regular watering. Whenever necessary, planting shall be replaced
with other plant materials to insure continued compliance with applicable
landscaping requirements. Required irrigation systems shall be fully maintained in
sound operating condition with heads periodically cleaned and replaced when
missing to insure continued regular watering of landscape areas, and health and
vitality of landscape materials.
7. Construction activities shall comply with applicable zoning ordinance and municipal
code performance standards (noise, dust, odor, etc.).
8. Permit(s) for all outdoor advertising signs must be obtained through the Building
Department, and be designed to conform with the Zoning Ordinance. Any outdoor
advertising signs shall be submitted for review and approval by the Planning
Department. All signs must conform to the Zoning Ordinance and be compatible
with the building and surroundings.
9. This. Conditional Use Permit may be recalled to the Planning Commission for
review at any time due to complaints regarding lack of compliance with conditions
of approval, traffic congestion, noise generation, or other adverse operating
characteristics. At such time, the Commission may revoke the use permit or
add /modify conditions of approval.
The following two items were considered in one motion.

A motion was made by Commissioner Tarr and seconded by Commissioner Thompson to
approve 'a one -year extension for the fil of the Final Map for Sequoia Estates (with all
conditions of Tentative Map approval to remain in effect); and to approve a one -year
extension of 'Tentative Subdivision Map approval for Magnolia Terrace (with all
conditions. of Tentative Map approval to remain,in effect).

Leonard Jay - Applicant described project (slide presentation); will make improvements
to Country Club Drive (hopefully) by November; soils reports are available to anyone; Park
improvements to be complete September or October at the latest.
Planning Director Tuft 'If Commission concerns -can be discussed at the start of the ,public
hearing process, these conerns can be addressed in the Initial Study and resolved through
mitigation measures.
Commissioner Tarr - Cannot recall all studies so far; concerns regarding cumulative
impacts; openspace seems to be .increasing in size; fire safety concerns; concerns regarding
increased traffic; would like CC &R legality discussed.
Commissioner Bennett - Acknowledgement that golf course could conflict with residential
use.
Commissioner Torliatt - What type of erosion control measures will be undertaken?
Planning; Director Tuft - Erosion control measures will be addressed in the Initial Study in
accordance with. City. Standards.
Commissioner Parkerson Staff reviewed the Initial Study carefully; concerns about
preservation of trees on downside of road; Mitigated Negative Declaration is probably
adequate.
Commissioner Tarr - Agrees that Mitigated Negative Declaration is adequate.
Commissioner Rahman - Acknowledgment that golf course may not always exist - that
homes could. be built on the property is a good idea.
Planning_ Director Tuft - The Planning process should be as follows:
- Initial Study
- Notice - 21 day review period
- Wrap -up public hearings
- Sept. 9 - complete Initial Study - more public input
Sept. 22 - conclusion if possible.
Commissioner Rahman - Should we wait until after the Sept. 16 Parks and Recreation
meeting?
Commissioner Torliatt - Traffic concerns.
The Commission di'r'ected staff to elaborate on the following issues:
1. Cumulative Impacts of the development of the entire Country Club area.
2. Ma_int_enance of the openspace areas.
3. Fire safety.
4. Conflicts between the golf course uses and proposed residential uses.
5. Erosion control measures.
6. Impacts of additional traffic.
7. Impacts on trees from roadways.
The public hearing was continued to the Planning Commission meeting of September 9,
1992.
LIAISON REP ORTS:
1. SPARC - Planning Director Tuft - Announced new member Claudia Cleaver.
2. Tree Committee - Commissioner Parkerson Street Tree List has been created;
working on tree removal questions; tree planting sponsorship.
3. River Enhancement Committee Commissioner Bennett - Final product of
Enhancement Plan close to being presented - Alternatives Report is exciting.
