PUBLIC COMMENT: None DIRECTOR'S REPORT: None COMMISSIONER'S REPORT: None CORRESPONDENCE: Residential Development Map; Revised Engineering Department letter re: Sonoma Glen Phase 4; Greensheet; updated list of elected and appointed City Officials. APPEAL STATEMENT: Was read. LEGAL RECOURSE STATEMENT: Was noted on Agenda. CONSENT AGENDA Items recommended for consideration under, the Consent Calendar are considered, to be routine in nature by staff and are recommended to be acted upon by a single motion by the Planning Commission at the beginning of the meeting. with no further discussion. SONOMA PARKWAY SONOMA MOUNTAIN TSM92008(dd). COMPANY; SONOMA GLEN IV; ELY ROAD AND PARKWAY; AP NO. 137 - 060 -86 (Portion); File No. Request for approval by the Sonoma Parkway Company of a Tentative Subdivision Map application to divide a single 38.3 acre parcel into a 20 acre parcel and a 18.3 acre parcel. The following actions are required: a. Determination that the certified Corona Ely EIR adequately addresses - environmental issues relating to this project. b. Approval of a Tentative Subdivision Map. The public hearing was opened. SPEAKERS: Jim McCann presented the staff report. To Mershel - Sonoma Mountain recommendations. Commissioner Torliatt - No approval aesthetics. The public hearing was closed. Parkway Company - no problems with staff of 209 units implied by this map; concerns with A motion was made by Commissioner Thompson and seconded by Commissioner Rahman recomm'e'nd to the City Council that the Environmental Impact Report prepared and certified, in conjunction with the Corona Ely Specific Plan adequately addresses any potentialimpacts that may result form the approval of this proposed Tentative Map. The proposed Tentative Subdivision Map, as conditioned, is in general conformity with the provisions of the General Plan and with the policies of the Corona /Ely Specific Plan which permits the eventual development of the site with residential lots. 2. No development of the lots is proposed with this application. The design goals of the City's General Plan, Specific Plan and Zoning Ordinance will be insured through the Planned Unit Development Rezoning which must be processed concurrently with any future development proposals for these parcels. 3. The proposed. Tentative Subdivision Map as conditioned does not conflict with the provisions of the Zoning Ordinance and the Planned Community District requirements because no development is proposed at this time. 4. The proposed Tentative Subdivision Map as conditioned is in conformity with the City's subdivision ordinance. 5. It has been found that the Environmental Impact Report prepared and certified in conjunction with the Corona Ely Specific Plan adequately addressed any potential impacts that may result from the approval of the proposed Tentative Map to create a 20 acre parcel and a 18.3 acre parcel from the 38.3 acre "remainder lands" of the Sonoma Mountain Parkway Company. Conditions 1. The applicants/ developers shall defend, indemnify, and hold harmless the City or any of its boards, commission, agents, officers, and employees from any claim, action or proceeding a &ainst the City, its boards, commission, agents, officers, or employees to attack, set aside, void, or annul, the approval of the project when such claim or action is brought within the time period provided for in a plicable State and /or local statutes. The City shall promptly notify the applicant. evelopers of any such claim, action, or proceeding. The City shall coordinate in the defense. Nothing contained in this condition shall prohibit the City from participating in a defense of any claim, action, or proceeding if the City bears its own attorney's fees and costs, and the City defends the action in good faith. 2. This approval is contingent upon the recordation of the Final Map for the Sonoma Glen Estates rural residential subdivision. The Final Map for Sonoma Glen Estates must be recorded prior to or concurrent with the recordation of the Final Map for Sonoma Glen IV. 3. The general circulation and related improvements of the two proposed parcels in Sonoma Glen shall be coordinated throughout the Planning process and development stages when necessary, as determined by the City.
