PETALUMA, CA 1 i COMMISSIONERS: Present: Read, Parkerson *, Rahman (arrived at 7:30), Tarr, Thompson, Torliatt Absent: Bennett STAFF: Pamela Tuft, Planning Director James McCann, Principal Planner Chairman MINUTES OF April 13, 1993 were approved as amended. Chairman Parkerson stated his concern that Plamiin� Commission should approve Minutes before items go to City Council for consideration. PUBLIC COMMENT: (15 minutes maximum). The Commission will hear public comments only on matters over which they have jurisdiction. There will be no Commission discussion or action. The chairman will allot no more than five minutes to any individual. If more than three persons wish to speak, their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. DIRECTOR'S REPORT: None. COMMISSIONER'S REPORT: None. CORRESPONDENCE: General Report; Sonoma State University "Cabernet and Vinegar Awards "; letter regarding Svenson Accessory Dwelling; 2 letters regarding Orchard Supply Hardware Conditional Use Permit. 1 APPEAL STATEMENT: Within fourteen (14) calendar days following the date of a decision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed With the City Clerk. Consideration of a request to allow the conversion of an existing guest house to an accessory dwelling in an R -1 6500 zoning district. The following actions are required: 1. A determination that the request is exempt from the requirements of CEQA. 2. ' Approval of a Conditional Use Permit to allow an accessory dwelling. The public hearing was opened. Principal Planner McCann - Presented the staff report. Commissioner Torliatt - Are water and sewer hook -up fees required? Planning Director - Yes, they are required, to pay fees whether they are listed as conditions or not the Municipal Code requires specific fees; we can list them as conditions if the Commission prefers. Commissioner Thompson Describe drainage issue. Principal Planner McCann - Described drainage plans. Dan Svenson - 24 Wallace Court - .explained that drainage will be taken care of on plans; answered questions regarding design of proposed carport; materials of construction. The public hearing was closed. A motion was made by Commissioner Tarr and seconded by Commissioner Torliatt to find this project exempt from the requirements of CEQA and to grant a Conditional Use Permit to allow the establishment of an accessory dwelling. at 24 Wallace Court based on the findings and subject to the amended conditions listed in the staff report. Approval of a Conditional Use Permit to allow an accessory dwelling. 35 36 The public hearing was opened. 37 38 SPEAKERS: 39 40 Principal Planner McCann presented the staff report. 41 Commissioner Torliatt - Would like construction limited to 8:00 AM to 5:00 PM. 42 Commissioner Read -Were hours of construction limited on the PEP project? 43 (Commissioner Rahman arrived - 7:30 PM.) 44 Planning Director Tuft - No complaints from other nearby residents on other projects: the 45 hours recommended are consistent with other short-term projects. 46 Commissioner Thompson - What is the reason for requiring a trellis at the back of the 47 garage? 48 Principal Planner McCann - The area_behind the garage is rather plain; it's not a significant 49 issue with staff. 50 Jim Thomas - 407 K concerns with construction hours; 7AM is very early since wife works 15 1 late at night - gets home at 11PM. - 2 Sandra 'Cooper - 403 K Street; would appreciate hours of construction to be 8AM to 5PM 3 since home is her office. 5 ffe� Don DeJone - Owner /Contractor Could construction hours be 7:30AM to 5PM? Would like to work on Saturdays - 9AM - 4PM; would not really like to build a trellis, it isn't necessary and wouldn't be attractive. Jim Thomas - Construction work on Saturdays would not be a problem with him. Commissioner Parkerson - Concerns with T -1 -11 siding; SPARC policies do not allow T- 111. Principal Planner Jim McCann - Other homes in this area have T -111. Commissioner Parkerson - SPARC policy should be followed regarding building materials. Planning Director Tuft - Clarified recommended hours of construction. The public hearing was closed. Adoption of a Negative Declaration. 2. Granting of a Conditional Use Permit to allow open storage. The public hearing was opened. SPEAKERS: Principal Planner Jim McCann presented the staff report. Commissioner Torliatt : Isn't the condition regarding the trash enclosure (inside building) a possible fire Hazard? Bill Wisely - Applicant /Owner - The trash is placed in a large metal container on wheels and is not brought in at night. Commissioner Read - .Landscaping should be required to be kept in good condition; please don't put furniture on the roof. Bill Wisely_ -Sure, the furniture has been removed; no flammable liquids are stored on the site. Commissioner Tarr - Trash enclosure should be on -site. Bill Wisely - Will call the trash collection people to see if they would come on the site. Planning Director Tuft - Will work with applicant on trash enclosure design and siting. Commissioner Tarr - Is barbed wire a necessity on your fence? Bill Wisely - Yes,. - redwood - his very expensive; also have 2 guard dogs; other businesses have barbed wire surrounding their property in the area. The public hearing was closed. Request for amendment to the Conditional Use Permit for Country West Shopping Center to authorize a 13,000 sq. ft. net building expansion. The following actions are .required: 1. Commissioner Thompson - Please clarify, is the warehouse building a metal building? Principal Planner McCann - Yes, a : metal building is proposed. The project architect is working on design elements of metal building (discussion at SPARC centered around metal building and it will be returning to SPARC). Comrrnssioner Torli'att - Can Allan Tilton expand on traffic /circulation? Allan Tilton - History of traffic analysis for shopping center; to maintain adequate levels of service at buildout in the area a median would be necessary; ISTEA (Federally funded improvements) will add additional improvements to; make circulation work before General Plan buildout occurs. Commissioner Tarr - What is the tune -frame for retail building. improvements? Will all exteriors include a. stucco facade? Commissioner Read - When Burger King /7 -11 uses carne in, there was debate at SPARC regarding integration of two architectural styles; 'I have no conflict of interest, but work in an office overlooking the existing site and have concerns with roof -top (existing and future) screening. Principal Planner McCann - More consistent design theme, will be achieved with this project; rooftop screening concerns will be addressed through SPARC. Plammng'Director Tuft - Architect will address screening questions. Harry Fisher - OSH Construction Manager - looking forward to being part of Petaluma; condition regarding easement is unnecessary, can. tie maintained without an easement; when median is put in, there ma be a turning problem with OSH; left turn question will need to be readdressed later when `the! overpass is widened); met with Mr. White (Redwood Business Park) screening questions are 'being resolved. 10 455 1 Commissioner Parkerson - Planning Commission can't make. changes to SPARC 2 conditions. 3 Commissioner Torliatt - Will abstain due to possible conflict of interest. 4 Assistart`_City Manager Salmons - Has been tracking this project for several reasons, one is 5 economic concerns; architecture of metal storage warehouse can be addressed by SPARC 6 to everyone's satisfaction, building is set back at least 100' from street, this setback exceeds 7 that required by the Zoning Ordinance and is very generous,; mature landscaping exists 8 along Redwood Way; with respect to future median, Planning Commission will probably 9 not be involved; encouraged approval of this project. 10 Richard. iSambucetti - OSH Project Manager - Design will tie into existing (newer) 11 building's;; OSH requirements and existing design can be merged satisfactorily; metal building -can be designed to satisfaction of all; met with Mr. White regarding screening of future rooftop equipment - believes all neighbors will be happy with the project. Commissioner Tarr - How will a metal building appear to blend in with rest of buildings in 0 the center? RichardiSambucetti - Metal building will be made as presentable as possible (color will be tied -in to other buildings). Commissioner Tarr - Will metal building be strictly used by OSH? Is Redwood Way exit essential? Richard; Sambucetti - Yes, only OSH will use metal warehouse; would like to be able to use 21 Redwood Way for warehouse users to exit more easily (will need an easement to use). 22 Commissioner Tarr - Wants trees to remain in Redwood Way area; will most material be 23 delivered to the loading dock? 24 Harry Fisher - Yes, deliveries will be to the loading docks. 25 Planning Director Tuft - Staff is supportive of Redwood Way exit; I believe Bill White is 26 also in support. 7 Allan Tilton - Discussed safety of Redwood Way exit. 8 Harry Fisher - Exit on Redwood Way would be for customers exiting only, it would be 9 gated when OSH not open. 30 Planning. There is no substantial evidence that the project, as conditioned, would have a significant effect on the environment. The proposed shopping center expansion will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. Conditions of approval adopted under this Use Permit Amendment shall supersede previously adopted conditions of .approval for the original use permit issued in 1978 and all prior amendments pertaining to Country, West . Shopping Center. The approval shall permit a total buildout of the shopping center of 59,000 'sq.ft. of retail building area, including the proposed net addition of 13,000 sq.ft. 2. All conditions of the April 22, 1993 SPARC approval pertaining to the shopping center expansion and Orchard Supply Hardware building are incorporated as conditions of the Conditional Use Permit. A minim parking ratio of 1 stall per 300 sq. ft. of utilized retail area shall be 3 maintained within the Country. West and Redwood Plaza shopping centers, 4 including enclosed outdoor nursery space, warehouse space, and all restaurant, 5 retail sales and office space. Ratio of compact and handicapped parking stalls to 6 standard size parking shall be subject to City staff approval at time of building 7 permit application for the expansion. 8 9 5. Stacking of materials within the yard area shall not exceed 10 ft. in height, and shall 10 be subject to the requirements of the Fire Marshal. Sufficient room shall be 11 reserved to achieve unimpeded vehicular turning movements through the site, and 12 emergency service access. (M - 6. Any loudspeakers proposed for use within the project site shall not be audible within the interiors of nearby office and restaurant uses. Monitoring of complaints shall be conducted by City Police and Planning Departments, and shall constitute sufficient basis for future review and possible amendment to project conditions of approval by the Planning Commission. 7. No outdoor display of merchandise shall be permitted within the shopping center, 21 unless approval of a Zoning Permit is granted by the Planning Director. 22 23 8.
