CITY HALL PETALUMA, CA COMMISSIONERS: Present: Bennett, Parkerson*, Rahman, Tarr, Thompson, Torliatt; Absent: Read STAFF: James McCann, Principal Planner Kurt Yeiter, Principal Planner Chairman MINUTES OF April 27, 1993 were approved with corrections. PUBLIC COMMENT: None. IDIRECTOR'S REPORT: None. COMMISSIONER'S REPORT: Commissioner Parkerson distributed a pub_ lication by the Petaluria Tree Planters: CORRESPONDENCE: None. APPEAL STATEMENT: Was read. LEGAL RECOURSE STATEMENT: Was noted on the agenda. NEW BUSINESS PUBLIC HEARINGS I. VOGEL, 520 WEST STREET, AP NO. 006-07141, FILE NO. CUP93020(dh). Request for consideration of an accessory dwelling at 520 West Street. The public hearing was opened. SPEAKERS: Jim McCann presented the staff:report. James Vogel - Applicant - Had no concerns with conditions. Discussion centered around upgrade of driveway material, saving trees, drainage, addition of asphalt /concrete driveway apron. 1 Em The public hearing was closed. A motion was made by Commissioner Bennett and seconded by Commissioner Rahman to find this project,.exempt from the requirements of CEQA and to grant a Conditional. Use Permit to allow construction of a detached accessory dwelling at 520 West Street based on the findings and subject to the following amended conditions: COMMISSIONER READ: Absent COMMISSIONER BENNETT: Yes COMMISSIONER RAHMAN: Yes CHAIRMAN PARKERSON: Yes COMMISSIONER TORLIAT17: Yes COMMISSIONER THOMPSON: Yes COMMISSIONER TARR: Yes Findings: 1. The proposed accessory unit, as conditioned, will conform to the requirements and intent of the Petaluma Zoning Ordinance. 2. The proposed accessory unit, as conditioned, will conform to the requirements and intent, goals, and policies of the Petaluma General Plan. 3. The proposed accessory unit will not constitute a nuisance or be detrimental to the public welfare of the community. 4. This project is Categorically Exempt under CEQA Section 15303, New Construction of Small Structures. Conditions 1. . All requirements of the Chief Building Official shall be met, including: a. Grading must be certified when completed to indicate compliance with approved plans and will be required for occupancy. b. Soils with expansion index greater than 20 requires special design foundation per Uniform Building Code 2904(b). c.. All retaining walls shall meet the requirements of the 1991 UBC, and shall comply with Petaluma Standards Ordinance No. 1727/1988. d. Show site drainage and' grading topography. e. Indicate all utilities on site plan. f. Driveway gradient shall comply with Ordinance No. 1533/1982. g. Responsible party to sign plans. h. Submit soils report to verify foundation design. Plans must also show compliance to current Title 24 Energy Code. j. Provide structural calculations for all non - conventional design items. k. Demolition permit required to remove any structure. 2. All requirements of the City Engineer shall be met, including: a. Provide more accurate topography with spot elevations at property corners and existing structure comers. Also show spot elevations at new unit corners, doors and stairs. b. Repair broken sidewalk along frontage and install driveway approach to new unit. C. Provide information required for site plan (see attached). d: Show treatment of on -site drainage. e. Provide protection from excavation to adjacent property. 3. All requirements of the Fire Marshal shall be met, including: a. All roof covering material shall have a Class B rating or better, treated in accordance with the Uniform Building Code Standard 32.7. b All roof covering materials applied as exterior wall covering shall have a fire rating of class "B ", treated in accordance with UBC Standard 32.7, as per Ordinance 1744 of the City of Petaluma. C. Provide fire suppression system at normal .sources of ignition. These areas are specifically at clothes dryers, kitchen stoves, furnaces, water heaters, fireplaces, and in attic areas at vents and chimneys for these appliances and equipment. d. Post address at or near main entry door - minimum four (4) inch letters. 4. The three mature oaks at the northern (rear) end of the lot shall be preserved. Temporary protective fencing shall be erected five feet from dripline prior to any grading /construction activity and subject to staff inspection prior to grading permit issuance. 5. A qualified soils engineer shall be consulted regarding excavation, retaining wall and drainage issues. 6. Administrative Site Plan and Architectural Review shall be required prior to (or concurrent with) submittal for building permit. The following issues shall be addressed and resolved. a. Windows for proposed accessory dwelling /garage shall be redesigned to be more consistent with those of the principal structure in regards to style, dimension and placement. 3 Em b. Two -foot wide planter strips shall be installed along either side of the driveway prior to Certificate of Occupancy. Dead plant materials in front yard shall be replaced. 7. Separate gas and electric meters shall be installed for the proposed accessory dwelling to the specifications of PG &E prior to issuance of a Certificate of Occupancy. 8. Construction activities shall comply with applicable Zoning Ordinance and Municipal Code Performance Standards (noise, dust, odor, etc.). 9. This project shall be responsible for the payment of Special Development Fees adopted by the Petaluma City Council for sewer and water connection, Community Facilities Development, Storm Drainage Impact, Dwelling Construction, School Facilities (Petaluma School District) and Traffic Mitigation fees. 10. Driveway area shall match (new and existing) in materials; apron at street shall be non - gravel to eliminate gravel from driveway from being spread onto sidewalk and street. PLANNING MATTERS II. STATUS REPORT FROM PLANNING COMMISSION SUBCOMMITTEE. DISCUSSION: General discussion centered around: Consent Agenda should be utilized, staff reports and minutes should be much briefer; conditions should be in 7 point type to. save paper; are two meetings per month necessary?; more brief reports would allow time to work on longer range projects; staff "can be contacted if there are unanswered questions after reading staff reports; staff to bring a list of items that could be handled at administrative level; noticing will still take place; request by Commission to begin abbreviated staff reports and minutes at next meeting; essence of. ideas should be reported, not individual comments; majority and minority, opinions should be addressed; if these ideas work and allow more "spare" time, what should Commission discuss? some ideas were: status of projects, study sessions, long range planning questions, Zoning Ordinance revision and Zoning General Plan update. Consensus was reached on the following . Begin brief staff reports /minutes next meeting; utilize Consent Calendar; investigate which items can be handled administratively, which cannot and report back to Commission; staff to return with listing of recommended actions to implement suggestions. PROJECT STATUS 1. General Plan Workshops - Kurt Yeiter reported that a more scientific survey should be completed before the first workshop. 2. CEQA Guidelines - Approved by City Council on May 3rd. 3. Cardroom Ordinance - Reintroduced to City Council with population limitations. 4.
