the meeting to answer questions so that no agenda item need be deferred to a later date

APPROVAL OF MINUTES: Minutes of February 13, 1990 were approved as printed.
PUBLIC COMMENT: (15 minutes maximum).
The Planning Commission will hear public comments only on matters over which they have
jurisdiction. There will be no Commission discussion or action. The chairman will allot no
more than five minutes to any individual. If more than three persons wish to speak their
time will be allotted so that the total amount of time allocated. to this agenda item will be
15 minutes.

CONTINUED PUBLIC HEARING
I. FAIRWAY MEADOWS, DUFFEL COMPANY, AP NO. 17- 040 -50, FILE NO.'S

1. Continued consideration of mitigated negative declaration.
2. Continued consideration of rezone from Agriculture (A) and Flood Plain
Combining (FPC) to Planned Unit Development (PUD) and FPC.
3. Continued consideration of PUD unit development plan.
4. Continued consideration of tentative map for 41 -lot detached. single - family
subdivision.
The public hearing was opened.
SPEAKERS:
Chuck McKee - Applicant representative - offered to answer any questions.
Greg Randall (Guzzardo and Associates) - Project Site Planner - Areas around homes will
not be seeded with native grasses; United Anglers and Fish and Game will be working with
developer to satisfy any problems near the creek.
Frank Bellows Project architect - Answered questions regarding impacts on Lakeville
Square Apartments; described different house plans.
COMMISSIONER COMMENTS
Commissioner Tarr - Lots are too small; too many units; where will storm waters be
diverted; too close to Lakeville Square Apartments.
Commissioner Read - 10% units are not acceptable; need more work on architecture
before SPARC review; would like to see creek landscape plan.
Commissioner Parkerson - Need more side entry garages; creek treatment good;
meandering sidewalk nice.

Commissioner Balshaw - Concerns with treatment of creek - wants it left in a natural state..
The public hearing was closed.
A motion was. made by Commissioner Read and seconded by Commissioner Parkerson to
continue this item to the Planning Commission meeting of March 13 to enable further
clarification from applicant as follows:
- More side entry garage units
- More architectural variety in 10% units
- Creek landscaping
- Larger rear yard setbacks backing Lakeville Square Apartments (minimum 25')
- Explore design opportunities
- Meandering sidewalk at creek

Discussion of draft Tree Preservation legislation.
(This item is not a public hearing).
DISCUSSION:
Don Waxinan - (representing Petaluma Tree People) showed slides of local trees.
Commissioner Bennett - An Ordinance is needed to cover trees on public property.
Commissioner Tarr - Have many trees been removed lately?
Commissioner Balshaw - Would like to see trees protected, but this might be an
administrative nightmare; local heritage trees list should be developed (for protection
now ); all,trees planted per SPARC should be protected.
Commissioner Libarle - Administratively not feasible - would like to see special trees
protected; most people don't want to remove trees.
Don Waxman - This proposed Ordinance would not prevent a person from cutting a tree
on their property.
Commissioner Read - Heritage tree survey should be done.
Commissioner Libarle - Does staff feel there is a problem with tree removal now?
Commissioner Balshaw - Any tree required to be planted ( SPARC, etc.) should be
protected; neighborhood petition process (with property -owner concurrence) should begin;
Heritage; Trees List should be formulated; trees on undeveloped land should be protected;
requirement for public notification of tree removal on public lands.
Warren :Salmons - New policy directives for trees on public property is needed; more
maintenance on street trees should be done; private property trees should be recorded as
deed restrictions; need more protection on developable land (prior to application).
Commissioner Doyle - Policy statements should be made - not as legislation.
Staff is directed to work with Commissioner Parkerson and Don Waxman to review draft
ordinance process. Staff to return to Commission with a paper on policy regarding trees
(within two months). A sign -up sheet was passed around for future public noticing
regarding tree legislation.

Findings
1. The proposed use, subject to the conditions of approval, conforms to the intent and
requirements of the Zoning Ordinance and the General Plan.
2. 'This project will not constitute a nuisance or be detrimental to the public welfare of
the community due to the mitigation measure incorporated in the conditions of
approval.
Conditions
1. Landscaped areas shall be supplemented where sparse or dying prior to
commencement of use, subject to staff review and approval.
2. Pallets and other existing outdoor storage shall be relocated indoors prior to
commencement of use, subject to staff review and approval.
3. Any rooftop equipment shall be fully screened to the satisfaction of staff prior to
commencement of use.
4. A bond in the amount of $500.00, to insure compliance with Conditions 1 through 3
shall be posted prior to issuance of a building permit for tenant improvements.
5. This use permit may be recalled to the Planning commission for review at any time
due to complaints regarding operating characteristics. At such time the Commission
may repeal the use permit or add modified conditions of approval.
6. No signs may be erected on the site without issuance of a sign permit. All. sign
must comply with the approved sign program for Rancho Arroyo Business Park.
7. There shall be no open storage of equipment, materials, trash, litter, pallets,
packaging or containers.
8. All requirements of Fire Marshal shall be complied with, including:

a. (Applicants) must comply with UBC and UFC requirements for equipment
installation and application.
1. Consideration of Tentative Subdivision map for sixteen - single-family
residential lots.

Jonathan Houk - Designer hired by Old Adobe School District - School Board choose
design submitted; desenbes project - subjective design contest between staff and consultant;
has findings and conditions to suggest..
Dr. Don Brann - Superintendent, - Old Adobe School District - has worked with neighboring
residents; homes should be upscale (equal. to or equivalent to existing neighborhood).
Bob Parr 276 Banff has had no contact with School District; entrance should be on
Maria Drive; Bond Park should be more open to existing neighborhood; has not been
treated fairly by school district.
Dr. Don Brann - Notices were hand- delivered to 75 homes in this neighborhood; two -story
homes are not mentioned in,this presentation.
The public hearing was closed.
A motion was made by Commissioner Parkerson and seconded by .Commissioner Tarr to
recommend to the- City Council denial without prejudice of the Tentative Map with the
following findings:
1. The subdivision does not recognize existing neighborhood layout
2. Bond Park is not recognized
3. Subdivision. turns its back on existing neighborhood
4. All traffic is routed onto Banff Way.

Mad Miller - 308 Kentucky Street - Answered questions regarding organization of district.
Todd Gragyk - Described organization of district standards; overwhelming majority of
owners signed petition.
Ken Graham - 247 Keokuk Property owner in support of district; Heritage Homes in
support and, supplied money-for survey.,
Rose Silva - 500 Howard Street - Property is a rental - does not want to be in the district.
Greg Smith - 339 Howard - does not want to be in the district.
Jim Webb - 327 Howard Street - definitely wants to remain in the district; there are no
restrictions that will cause a hardship.
Margaret Gambonini - 409 Kent Street - There are already too many rules to follow - does
not want to be in the district.
Carol Mann - 520 Walnut - wants to be excluded from district.
Tom Ward - (no address given) - Absentee landlord - wants to be included in the district.

recommend to the City Council issuance of a Negative Declaration based on the following

recommend to the City Council the designation of H -2, Oak Hill /Brewster Historic
Overlay Zoning District and the adoption (with deletions and additions to perimeter
properties as discussed) of the Preservation Guidelines and Standards based on the

Findings
1. The intent of Article 17 of the Zoning Ordinance has been met by the incorporation
of Preservation Guidelines and Standards for the Oak Hill/Brewster Historic
District and by the preparation of an architectural inventory of existing buildings.
2. The proposed map amendment designatin& the Oak Hill/Brewster Historic District
is consistent with the City of Petaluma Zoning Ordinance.
3 The proposed map amendment is consistent with the City of Petaluma. General Plan
and its goals, policies and objectives.
4. The public convenience and general welfare require or clearly permit the adoption
of the proposed historic district overlay designation.
A concensus was reached to return with an Ordinance Amendment to delete the Planning
Commission from the review process for any permits submitted in this Zoning District.
