APPROVAL OF MINUTES OF November 13, 1990 were approved as corrected
(corrections to pages 2 and 11).
PUBLIC COMMENT: None.
DIRECTOR'S REPORT: City has filed Housing Element with State of California - now in
procedural compliance; as soon as State approves, Petaluma will be in full compliance.
COMMISSIONER'S REPORT:. Commissioner Bennett reported that the River
Committee held first meeting - very optimistic of conclusion. Commissioner Tarr thanked
Commissioner Read for her seven years of Commission service.

NEW BUSINESS:
I. DEBRA INVESTMENTS, WESTRIDGE 4 & 5, FILE NO. 6.868(pt).
1. Consideration of request for Tentative Map extension.
Speakers
Chuck Linthicum - Debra Investment - Given the controversy of this project, would like a
full year. Improvements cannot be done a piece at a time. Summarized final map,
improvement plan and bonding requirements (12 months to complete public
Q, improvements). It is their intent to begin as soon as possible.
0 Courtland L. Pelton - 2510 Sunset Terrace, supports denial of extension; promised
improvements as condition of annexation (October, 1989); no fire protection (Petaluma
U has no umper trucks). If extension is granted, improvements should be done now. City is
liable (tort law) if damage occurs. Took over 9 months for Fire and Police to recognize
that he is within City Limits.
Commission Discussion
Commissioner Read - Extension options? Would staff support 9 months?
Commissioner Parkerson - Timing of construction after final map? Extension would allow
conclusion; as soon as possible.
Commissioner Woolsey - Given existing economic market, what if developer doesn't build?
Commissioner Bennett - Who decided to annex before improvements were undertaken and
subdivision developed? (Response by Warren Salmons - City Council.)
Warren Salmons Responding to Commission inquiries - if extension is denied, project is
dead, City should de -annex the project site and other related annexed properties.
Commissioner Libarle - supported extension request to get project- related public
improvements.
Commissioner Thompson - Supports 6 -month extension.
A motion was made by Commissioner Parkerson and seconded by Commissioner
Thompson to grant a six -month tentative map extension for Westridge Units 4 & 5 to June
9, 1991.

1. Consideration of amendment to PUD standards governing the Sousa
Subdivision.

The public hearing was opened.
SPEAKERS:
Merle Avila - Avila Enterprises - project representative - explained need to provide
flexibility in Guidelines - 19 houses have been approved. Don't want to give impression
that lots should be restricted to one -story homes. If SPARC intends to restrict houses to
one -story, then setbacks should be reduced to allow larger, wider single -story homes. All
drainage improvements are in, explained recent water leak from the irrigation system.
Grading should have no impact to adjacent homes or increase sub - surface run -off.
Jeff Gaidos - 751 Paula Lane long history of project - originally requested height
restrictions, urge Commission approval of PUD amendment.
Harry Schl`oetter - 736 Paula Lane - problems with water flowing from Sousa property
(over- watering of trees). If changes are made, new engineering should be undertaken.
Carole Williams - Elm Drive - drainage improvements were never completed (drainage
ditch), concerned with additional cutting potential. If drainage system is not extended, then
her property would receive flow from entire hill.
Jim Bercaw - 717 Elm Drive contacted Building Division (Mark Friedman) took ictures
of debris and uncompleted drainage ditch, work was to have been completed by 11.79/90.
Warren Salmons - Asked Mr. Avila if additional grading was to allow three -story homes.
Mr. Avila stated that two stories, not three was the intent.
Commission Discussion -
Commissioner Read - Can developer agree to wording that would require the buildings to
be set down into the site? Should water problems be addressed now?
Commissioner Thompson - Wants to give SPARC support for requiring less height.
Commissioner Bennett - This gives SPARC a stronger hand.
The public hearing was closed.
A motion was made by Commissioner Parkerson and seconded by Commissioner Bennett
to recommend to the City Council amendment of the Sousa Subdivision Development
Standards incorporating the following language:

The following language shall be incorporated into the Development Standards:
"Grading and building height restrictions shall be evaluated on an individual basis
for Lots 1 through 4, 7, and 13 through 15 (Unit 2). A reduced building height may
be required if deemed appropriate by SPARC. Waivers of grading and /or stricter
height limits may be warranted if reduction in building massing or reduction in
privacy intrusion to neighboring properties is achieved.
Preliminary SPARC review of development proposals on Lots 1 through 4,7, and 13
through 15 is encouraged. Immediate neighbors will be notified of preliminary and
SPARC review. SPARC submittal requirements for Lots 1 through 4,7, and 13

through 15 shall include view corridors and section drawings from project site to
downhill residences; section drawings of proposed residence; and an expanded
representation of surrounding uses (particularly downhill).
Additional engineering is required with SPARC application for each lot, as deemed
appropriate by City staff, to address impact of grading in relation to surface and /or
subsurface drainage to adjacent properties."

IV. DISCUSSION ITEMS:
1. Sonoma State University - Seventh Annual Planning Seminar. Six
Commissioners plan on attending seminar.
2. Draft language for Heritage Tree Ordinance. Forwarded to Joint Tree
Committee for consideration.
DISCUSSION:
1.
Commissioner Woolsey - Owners won't nominate their own trees. Trees on developable
land should also be addressed.
Commissioner Parkerson - Neighborhood might see trees as an important part of their
environment - a neighborhood could nominate (with owner's permission). Future
legislation on trees required as conditions of approval. We are not giving up on a tree
inventory. Will Tree Committee be told of future legislative ideas?
Commissioner Read - Would this project dovetail into Main Street Tree Program?
Commissioner Bennett - Neighborhood could agree to recognize value and act to preserve.
This is an introductory format, may change.
Commissioner Libarle - What if one neighbor doesn't agree - can he be forced?
Commissioner Thompson - Charge for permits to activate?
Warren Salmons - Fee to handle paperwork and record document.

DIRECTOR'S REPORT: Introduction of Jane Thomson; Firestone Project will be
renoticed and will be presented at the Planning Commission meeting of January 23;
Commission decision regarding Cherry Street Partners Parcel Map was overturned by City
Council; Sonoma State Planning Workshop was well attended.
COMMISSIONER'S REPORT: Commissioner Bennett requested addition to January 23
agenda - Election of Vice- Chairman.
CORRESPONDENCE: Flyer regarding River Enhancement Guided Tour was distributed.

co report.

threaten to eliminate a plant or animal community, reduce the habitat of a fish or

restrict the range of a rare or endangered plant or animal or eliminate important
examples of the major periods of California history or prehistory.
2. The project, as conditionally approved, does not have the potential to achieve short -
term to the disadvantage of long -term, environmental goals.
3. The project, as conditionally approved, does not have impacts which are individually
limited, but cumulatively considerable.
4. The project, as conditionally approved, does not have environmental effects which
will cause substantial adverse effects on human beings, either directly or indirectly.
5. The project is consistent with the General Plan.
A motion was made by Commissioner Libarle and seconded by Commissioner Bennett to
grant a Conditional Use Permit based on the findings and subject to the conditions listed in
the staff report.

Findings
1. The Proposed use, subject to the conditions of approval, conforms to the intent and
requirements of the Zoning Ordinance and the General Plan.
2. This project will not constitute a nuisance or be detrimental to the public welfare of
the community due to the mitigation measures incorporated in the conditions of
approval.
Conditions
1. All requirements of the Chief Building Inspector shall be met before a certificate of
occupancy may be issued.
2. All requirements of the Fire Marshal shall be met before a certificate of occupancy
may be issued.
3. All work related activities shall take place indoors with doors closed at all times,
except when materials are being delivered to and from the business.
4. No storage of any type shall take place outdoors (i.e. machinery, equipment, parts,
materials, items under repair, trash, etc).
5. Three (3) additional parking spaces shall be provided by the owner to Molema
Enterprises at such time as any additional employees are hired. Notification to the
City of additional employees is the responsibility of Molema. Enterprises, who shall
provide the City with an agreement, co- signed by the property owner provide such
spaces. The agreement shall be filed before a. certificate of occupancy may be
released. Parking area shall be striped at this time for a minimum of 10 spaces.
6. The Community Development Department shall be notified of any new equipment,
operations changes, etc.
7. Hours of operation to be limited to 7 A.M. to 6 P.M. Monday through Friday, and 8
A.M. to 5 P *M. 'Saturday in deference to the surrounding neighborhood. Deliveries
to be restricted to Monday through Friday, within authorized hours of operation.
8. No signs *may be erected on the building without issuance of a sign permit.
9 All trash, wood waste (pieces of wood, sawdust etc), to be bundled and disposed of
in the dumpster as provided on site by the property owner.
10. Missing or dead shrubs on north side of driveway outside existing wood-slatted. fence
shall be replaced, and an irrigation system shall be installed before the certificate of
occupancy may be released.
11. Fence to be converted to a side -to -side rolling type within one month after
commencement of operations so as to not block walkway area on Second Street or
parking inside fenced area.
12. This use permit may be recalled to the Planning Commission for review at any time
due to complaints regarding noise generation or other operating characteristics. At

such time, the Commission may repeal the use permit or add /modify conditions of
approval.
II. AKRON WEST, 331 KELLER STREET, AP NO. 006-213-04, FILE NO. 1.691(gb).

recovery program and to house the administrative staff for the program.

Q her property; empty liquor bottles thrown into her yard; lights very bright; lots of noise.
(, Paul Kilbright - Madison Street - Continental Arms Apartments owned by Laurie Margolis
(Mr. Kilbright's sister); Ms. Margolis is in favor of this project.
Rhonda Gerhard - 322 Liberty Street - Noise comes into her house; meetings begin before
6AM; meetings on Sundays early in mornings; obscene language being used; violent
incident in October on a. Sunday morning at 8AM; turning left onto Liberty Street from
parking lot causes near accidents; hours of operation are unacceptable.
Dan Mayer - 311 Keller Street - Should this program be allowed (does it fit into the
community ?); concerns regarding safety of neighbors in area; hours of operation.
Bernice, Callahan - 342 Keller Street - Differences between tonights presentation and
meeting ai Sweed School last year; how can this program be monitored?
Lu Cook - 1437 Baywood Drive - Co- Founder of Akron West - would like neighbors to
meet participants; landscaping will be planted around perimeter to deaden sound; low
incidence of problems.
Rhonda Gerhard - 322 Liberty Street - there was a violent incident last October.
Dan Mayer - 311 Keller Street - Presented list of people who are against project; won't be
compatible with the neighborhood.
Dr. Glaze - 200 -206 Prospect Street - has spent lots of money on his buildings; does not
want this project in his neighborhood; should be downtown, not in a nice neighborhood;
will not spend any more money on his property if this project goes in.
Steve Leavitt - 1527 Cerro Sonoma Circle - Clients are not throwing beer bottles, etc. onto
neighboring properties; this neighborhood not exactly "Beverly Hills "; cannot do any
landscaping; etc. until use permit approved; noise levels not high now; no problems with
most of conditions except hours of operation need to be 6:30 AM to allow pre -work classes;
no parking will be allowed on streets; needs 6:30 AM meeting to continue.
Commissioner Woolsey - Can window coverings be put up? Can landscaping be added
immediately? Can some members be "policemen" in parking lot?
Commissioner Parkerson - Classes no earlier than LOAM Saturday and Sunday and no later
than 4PM.�
Commissioner Libarle - Wants background on Akron West.
Steve Leavitt - Spiritual program designed to prevent drug and alcohol abuse, participants
can stay for one year; will apply for grants, etc.; will be a lot of volunteer staff; people
involved in this program for last 2 years; 80% success rate; benefit to community.
Commissioner Thompson - How many participants are there now? Will there be more
attendees after a use permit is issued.
Steve Leavitt - Most referrals are from Petaluma area: will be no charge to participants; no
other activities will be allowed in building other than disclosed to staff.
Commissioner Woolsey - Where would people go at 6:30 AM if not to this facility?

Lu Cook - Mr. Costenza and Mr. Mullens and self are in partnership in lease option of this
building.
Paul Krlbright - People in neighborhood will be educated by Akron West about problems
associated with alcohol and drug abuse.
Commissioner Woolsey - Would staff live in the building? Answer - No.
Commissioner Bennett - Ready to vote against; project -wants more. information on use..
Commissioner Parkerson - Wants more information on use - Clarification of 6:30AM
starting time; neighborhood compatibility.
Commissioner Tarr Main issues are whether they will be able to grow, will hours be a
problem, and can noise be mitigated?
Commissioner Woolsey - Wants more information - who is responsible party? How will it
be monitored?
Director Salmons - Building owner - Wolfson (and Mullens) talked to applicants earlier -
asked for clarification regarding intended uses; presentation by applicants.
Lu Cook - Applicant - Parking monitor idea good; will put landscaping plans on. paper.
Commissioner Thompson - What -are other types of programs - would like more
information on these programs; more information on expansion potential.
Commission is requesting a continuance to allow the applicants to return with more
detailed information.as follows and to consider revised AM starting hours:
- What measures will be incorporated in the project to address the potential impacts
of noise and lights (particularly in the early morning and evening periods)?
- How will Akron West regulate the number of people who arrive for an event to
-limit attendance to the maximum number specified by the use permit? What
happens if more people arrive than are permitted by the use permit?
- How will Akron West ensure that other 12 -step programs using the building will
comply with the conditions- of approval?
- How is the program funded at present? How will it be funded in the future? Will
attendees be charged for the program?
- Will any of the program classes be attended by individuals with more serious
addition problems as part of a post- treatment release program ?* Provide more
information about the likely attendees.
- Who will be responsible for ensuring compliance with the conditions of approval?
How will the .group responsible for compliance with conditions monitor the
operation to ensure compliance?
What other types of uses and programs will be conducted in the building in addition
to the Akron West program?
How will clients be referred to the facility? What other means will be used to
publicize the program and to inform people of its availability?
Recognizing that the program will grow if successful, how will Akron West reconcile
future growth with the proposed limitations in. class size? How will limitations on
the number and time of classes be reconciled with future growth of the program?
