The Commission will hear public comments only on matters over which they have jurisdiction. There will be no Commission discussion or action. The chairman will allot no more than five minutes to any individual. If more than three persons wish to speak their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. NEW BUSINESS PUBLIC HEARINGS I. PETALUMA MARSH ENHANCEMENT PLAN (ky). 1. Receive and review draft Petaluma Marsh Enhancement Plan (presentation by Questa Engineering). �J Public Hearing was opened. SPEAKERS: Jeff Peters, Ouesta Engineering - outlined process to date; spoke of history of study area, existing qualities, goals and objectives, restoration plan, and funding options. Margaret Henderson, Ouesta En ineering - described access and recreational alternatives. Larry Wasem. 5510 Skvlane Blvd., Suite 202 Santa Rosa (Marina Office Park Associates) - perhaps no. excess parking at marina; objects to path on railroad right -of -way which, he believes, would render parcel unusable; objects to public access from Casa Grande Road through upland portion of site; requests that upland /wetland boundary on Darling - Delaware property be drawn at St. Lands, and that landscaped buffer zones be eliminated from this property. Madison, contacted Community Development staff in .August 1990 regarding Zoning Ordinance with reggard to 20 foot rear °yard setback; awnings should be allowed to extend into a portion of required rear yards. Principal Planner Tuft stated that Zoning Ordinance amendments will be on a July agenda and will include discussion of this subject (Mr. Davlinwill be notified). DIRECTOR'S' REPORT: None. CUP91014(hg f ws). 1. Consideration of EIQ. 2. Consideration of a conditional use permit to allow expansion of an existing food processing facility located within the ML Zoning District. A motion was made by Commissioner Bennett and seconded by Commissioner- - Rahman to direct staff to prepare a Mitigated Negative Declaration of Environmental Impact based on the five findings listed below: COMMISSIONER WOOLSEY: Absent COMMISSIONER PARKERSON: Yes COMMISSIONER BENNETT: Yes COMMISSIONER RAHMAN'. Yes CHAIRMAN TARR: Yes COMMISSIONER LIBARLE: Absent COMMISSIONER THOMPSON: Absent Findings 1. The project, as conditionally approved, does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self - sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict thee range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. 2. The project, as conditionally approved, does not have the potential to achieve short - term to the disadvantage of long -term, environmental.goals. 3. The project, as conditionally approved, does not have impacts which are individually limited, but cumulatively considerable. 4. The project, as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. 5. The project is consistent with and further promotes the objectives, goals, and policies of the General Plan. The proposed break room, as conditioned, will conform to the requirements and intent of the Petaluma Zoning Ordinance. 2. The proposed break room, as conditioned; will conform to the requirements 'and intent, goals, and policies of the Petaluma General Plan. 3. The proposed break room will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. The following requirements of the City Engineering Department shall be met: a) Petaluma ,Poultry Processors shall participate in the Lakeville Hwy. b) If necessary Petaluma Poultry Prod improving the roadway. Assessment District. for widening and shall provide additional right of way for the widening of Lakeville Hwy.. The need for and amount of any additional land will be determined following Cal Trans review and approval of the Lakeville Hwy. improvement plans. c) Petaluma Poultry Processors shall pay additional traffic mitigation fees for the plant addition no later then the issuance date of a certificate of occupancy. 2. The following requirements of the City Fire Marshal shall be met: a) Provide one fire extinguisher 2A rated ABC dry chemical type for each 3,000 square feet of floor space. b) Office and break room shall be protected by an automatic fire extinguishing system as required by Section 10.306A of the 1988 edition of the Uniform Building Code. c) Permit required from Fire Marshal's Office for sprinkler system alteration prior to work being started. Two, sets of plans are required. d) No extension cords. All equipment and appliances shall be direct plug in. e) Provide metal or flame retardant plastic waste cans. 3. The proposed addition shall include a parapet that adequately screens all existing equipment on the roof abutting the addition and any proposed roof equipment (air- conditioning etc.) associated with the addition subject to SPARC review and approval. 4. The overall architectural design and choice of exterior finish, materials of the addition shall match the existing facilities and shall be determined at the time of SPARC review. 3 425 5. Any future additions proposed as reflected in the approved master plan or any requested changes /additions to the plan by project proponents shall coincide with parking improvements /additions deemed necessary at such time. 6. Any portion of the existing perimeter fence that is leaning and /or broken shall be repaired /replaced with matching materials .prior to issuance of a certificate of occupancy. 7. The unplanted portion of the existing landscape median that separates the west parking lot from the rear of the site shall be replanted prior to issuance of a CD certificate of occupancy (see attached site plan). Plant types and locations shall be reviewed and approved by SPARC. 0) 0 8. The landscape strip screening the north /east parking lot from view of travelers along South McDowell Blvd. and west bound traffic on Lakeville Hwy. shall be 0 improved prior to issuance of a certificate of occupancy (see attached site plan). Improvements shall include the removal of weeds and dead plant material as well as additional plantings to enhance the visual appearance and screening effectiveness of this portion of landscaping. Plant types and locations shall be reviewed and approved by SPARC. 9. In addition to improving the existing landscaping along the east property line, a minimum eight foot wide landscape strip shall be developed along the east fence line that ties into the existing landscaping and .continues to the rear property line (see attached site plan). Specific plantings and irrigation details to be approved by SPARC.' This landscape area shall be developed within twelve months of the date of approval of this use permit. 10. All special development fees applicable to this facility addition shall be paid. The community facilities development fee and district school facilities fee shall be calculated and paid prior to issuance of a building permit. 11. As development occurs on lands west and south of the processing plant, the planning staff will work to secure additional access through neighboring lands for truck and employee traffic. When this access is secured, the front entrance shall be used by trade people only, and all truck and employee traffic will use the new access to the west or south. 12. In any event, at such time as improvements to Lakeville Hwy. are installed, front access will become right turn in and out only. II. FOODMAKER, INC., JACK -IN -THE -BOX, 1401 McDOWELL BOULEVARD .
