Due to the developed nature of the existing site, the project does not have the potential . to degrade the quality of the environment, substantially reduce, the habitat of a fish or wildlife species;, cause fish or wildlife population to drop below self, - sustaining levels, threaten to eliminate a plan or animal community,, reduce the number or restrict the range of a -rare or endangered plan. or animal or eliminate important examples of major periods of 'California history or prehistory. b. The project as conditionally approved does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. The project, as conditionally; approved, does not have environmental effects which will cause. substantial adverse effects on human beings either directly or indirectly. 3 21 d. Because the project does_ not include additional phased development the project as conditionally approved does not have impacts which are individually limited but cumulatively considerable. A motion was made by Commissioner Doyle and seconded by Commissioner Parkerson to approve a conditional use permit subject to the following findings and conditions: 1 COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER BENNETT - YES DOYLE - YES PARKERSON - YES READ - YES SOBEL - YES TARR -ABSENT LIBARLE - YES Findings 1. The proposed use, subject to the conditions of approval, conforms to the intent and requirements of the zoning ordinance and the General Plan . 2. This project will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1 1. The six parking spaces along the east side of the building shall be reserved for pick-up/drop-off of children using the Northbay 'Performing Arts facility. This shall be accomplished through signing or painting of parking spaces, subject to staff approval. 2. )All conditions of SPARC approval for original building shall be :complied with prior to occupancy by Northbay Performing Arts, subject to staff approval: a. Existing outdoor storage of equipment along west property line shall be removed. b. Weeding of landscaped areas. C. Replacement of dead tree along the west property line. 3. Damaged frame of roll -up door serving Northbay Performing Arts shall be repaired to staff approval. 4. 'Prior to commencement of any future use (or change in use) in the !rest of the building, the building owner shall provide to the Planning ,Department a written certification of the following: ;a. Number of employees (by type of use) for the lease space in question. 'b. Number of square feet per type of use (office, manufacturing, warehouse, etc.) for the lease space in question. ;c. Remaining lease space area available. 4 22 d. Cumulative total of • a and b above for any previously approved use on the site. 5. Class size shall be limited to a maximum of 15 students at any one time. 6. There shall be no outdoor storage of materials or equipment. 7. No signs shall be erected on the site without issuance of a sign permit. 8. This use permit may be recalled to the Planning Commission at any time due, to complaints regarding operating conditions. At such time, the Commission may 'repeal the use permit or add modified conditions of approval. 9. All requirements of the Building Inspector shall be met: a. UBC Chapter 5 - Separation in buildings of °mixed occupancy - shall be followed. 10. All requirements of the Fire Marshal shall be met: a. Tenant improvements' and fire sprinkler alteration plans shall be submitted to Fire Marshal's Office. ADJOURNMENT 7:20 PM.
