1 A RESOLUTION OF INTENTION TO ORDER THE LEVY AND
2 COLLECTION OF ASSESSMENTS PURSUANT TO THE
3 LANDSCAPING AND LIGHTING ACT OF 1972 FOR
a LANDSCAPE ASSESSMENT DISTRICTS

9 WHEREAS, pursuant to that certain Resolution ,Describing Improvements and
10 Directing Preparation of Engineer's Report for Fiscal Year 1997-98. Landscape Assessment
11 Districts ,adopted by the City Council of Petaluma, pursuant to the Landscaping and Lighting
12 Act of 1972, the Engineer of Work of said City has prepared and filed with the City Clerk of this
13 City the written report for the Districts, listed in Exhibit A on file, called for under said Act and by
14 that certain Resolution., which said report has been submitted and preliminarily approved by this
15 Council in accordance with said Act:

17 NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND
18 ORDERED, as follows:

20 1. In its opinion the public interest and. convenience require and it is the intention of this
21 Council to order the levy and collection of assessments for Fiscal Year 1997-98 pursuant to the
22 provisions of the Landscaping and Lighting Act of 1972, Part 2, Division I S of the Streets and
23 Highways Code of the State of California, for the construction or installation of the
24 improvements, if any, including the maintenance, more particularly described for each and every
25 District in Exhibit B on,file:

28 2. The cost and expenses of said improvements, if any, for each Assessment District,
z9 including the maintenance, are to be made chargeable upon the said assessment district the
3o exterior boundaries of which district are the composite and consolidated area as more particularly
3l described on a map thereof on file in the office of the City Clerk, to which reference is hereby
32 made forfurther particulars. Said map indicatesby a boundary line the extent of the territory
33 include in each of the districts and of any zone thereof and the general location of said districts.

35 3. Said Engineer's Report for the Districts prepared by the Engineer of Work of said City,
36 preliminarily approved-by this Council, and on file. with the City Clerk is hereby referred to for a
37 full and detailed description of the improvements, the boundaries of the assessment district and
38 any zones therein, and' the proposed assessments upon assessable lots and parcels of land within
39 the districts.

a1 4. Notice is hereby given that Monday, August 4, 1997 at the hour of 7:00 PM, in the
42 regular meeting place of said Council, Council Chambers, City Hall, 1'1 English Street, Petaluma,
43 California, be and the same are hereby appointed and. fixed as the time and place for a hearing by
44 this Council on the question of the levy and collection ofthe proposed assessments for each
45 District for the construction or installation of said improvements, if any, including the
46 maintenance, and when and where it will consider all statements and all written protests made or
47 filed by any interested person at or before the conclusion of said hearing, against said
48 improvements, the boundaries. of each assessment district and any zone therein, the proposed
49 diagram or the proposed assessments, to the Engineer's estimate of the cost thereof, and when and
5o where it will consider and finally act upon the Engineer's Report for the Districts.

I 5. The City Clerk is hereby directed to give notice of said hearing by causing a copy of
2 this resolution to be published once In a newspaper of general circulation circulated in said Clty,
3 and by conspicuously posting a copy thereof upon the official bulletin board customarily used by
4 the Council for the posting of notices, said posting and publication to be had and completed at
5 least ten (10) days prior to the date of hearing specified herein.

7 6. The Director of Parks and Recreation and/or the Director of Finance said City is
8 hereby designated as the person to answer inquiries regarding any protest proceedings to be had
9 .herein, .and may be contacted during regular office hours at the Petaluma City Hall, 11 English
1o Street, Petaluma, CA 94952; or by calling 707-778-4380.
