PUBLIC COMMENT None. COMMISSIONER COMMENT: None. CORRESPONDENCE: Letters regarding tonight's agenda were. distributed. DIRECTOR'S REPORT: Staff has been asked to speak on growth management at 3 con erences . COM'MISSIONER's REPORT: Commissioner Libarle questioned whether there was `any information from City Attorney regarding Westridge. READING OF APPEAL RIGHTS Read by staff. 1 --"' NEW BUSINESS PUBLIC HEARINGS I. LA MEXICANITA, 353 EAST WASHINGTON STREET, PART OF AP NO. 007 - 072 -38, (File No. 1.604). 1. Consideration of conditional use permit to allow a specialty retail food store. The public hearing was opened. SPEAKERS: None. The public hearing was closed. A motion was made by Commissioner Bennett and seconded by Commissioner Doyle -to approve a conditional use permit to allow a 1,000 sq. ft. specialty retail food store subject to the following conditions: COMMISSIONER BENNETT - Yes COMMISSIONER CAVANAGH - Yes COMMISSIONER DOYLE - Yes COMMISSIONER LIBARLE - Yes COMMISSIONER READ - Yes COMMISSIONER TARR - Yes CHAIRMAN PARKERSON Yes Conditions 1. Any requirements imposed by the Fire Marshal shall be met. 2. Within 30 days of use permit approval, the rear door shall be painted and the tile roof (front elevation) shall be cleaned, subject to staff review and approval. 3. No signs may be erected without issuance of a sign permit. All signs shall conform with the sign program for the Lakeville Shopping Center. 4. This use permit may be recalled to the Planning Commission at any time due to - complaints regarding traffic congestion_ , noise generation or other objectionable operating chacteristics. At such time, the Commission may repeal the use permit or add modified conditions of approval. II. CARLSEN WAREHOUSE, 15 MAGNOLIA, AP NO 006- 041 -34, (File No. 1.524A). 1. Consideration of conditional use permit to allow a 3,000 sq. ft. warehouse. The public hearing was opened. SPEAKERS: John Carlsen - owner - problems with Condition 1, requested E one foot setback on west' property line. • The public hearing was closed. The proposed building, subject to the conditions of approval, conforms !to the intent and requirements of the Zoning Ordinance and the ,General Plan. 2. Proiect Specific Conditions: 1. ; In order to provide access for maintenance, the side setback on the twest side of the property shall be extended to at least five feet, or a ,maintenance access easement shall be secured from the owner of the iproperty immediately west of the project site, subject to SPARC !approval. 2. `This project is subject to SPARC review with special emphasis on the following : a. Landscaping shall be upgraded-along the north and east building elevations; provided in the west setback area if that option is chosen (see Condition Number 1) and along the east edge of the parking area. b. Landscaping shall be provided between the back of the curb and the building and between the back of the curb and parking area (exclusive of driveway) for the length of the Magnolia Avenue frontage. Any underground utilities and. /or easements in this area shall be shown on plans submitted for SPARC review. C. Architecture shall be improved on the south and west elevations to provide more visual relief. 'd. Trash enclosure design, location-;-et-c.. '.e. Fencing. 3 3. An agreement shall be established which allows cross -over access between this site and the site to the rear (south) . 4. Application for a. Use Permit for "Custom Muffler" :shall be made prior to SPARC approval. 5. All requirements of the City Fire Marshal shall be complied with: a. West and south walls are required to be of one (1) hour construction. b. Install sprinkler head over trash bin area. C. Provide fire extinguishers 2A rated ABC dry chemical type in office and in warehouse. d. Provide KNOX Box for key control located on building as required by the Fire Marshal. e. Post address at or near main entry door - minimum two inch letters. f. Provide metal or flame retardant plastic waste cans. g. No extension cords. All equipment and appliances to be direct . plug in. 6. All requirements of the City Engineer shall be complied with :. a. Recommend against exposed aggregate sidewalk. b Show location of existing curb, gutter, sidewalk and driveway on Magnolia Avenue frontage. C. Show existing PG &E pole and guy wire location in northwest corner. Applicable Standard Conditions: 7. This use permit may be recalled to the Planning Commission for review at any time due to complaints regarding traffic congestion, noise generation or other objectionable operating characteristics.. At such time the Commission may repeal the use permit or add modified conditions of approval. 8. No signs may be erected on the site without issuance of a sign permit. The existing sign on the site which advertises Custom Muffler shall be removed within ten (10) days of 'Use Permit approval. 9. There shall be no open storage of equipment, materials, trash, litter, pallets, packaging, or containers -. CORONA /ELY SPECIFIC PLAN 1. 'Consideration of EIR. 2. Consideration of Specific Plan for 650 acres northeast of Petaluma City Limits (hearing will be continued to Sept. 13, 1988) . Naphtali Knox - Consultant, presented overview of Specific Plan. The public hearing was opened. SPEAKERS: Judy Hillery 17 E. Madison - Will there be sound walls around new homes on Ely? Larry Nelson - 1736 Kohoutec Ct. - Very far easterly house in Specific Plan area; Condition of Ely Blvd. very bad, will it become 4 -lane road?. John Matelli - 470 Corona Road - traffic on 101 very bad; water problems; owns commercial hog ranch - can it continue? Tim Taffe - Corner of Corona and Ely - picturesque quality cannot be maintained; end of Petaluma as we know it with more building. Glen Horton - 100 Rose Petal Court - Concerned with construction truck routes.. Duane Bellin - 464 Ely - Population should be broken down by area to enable growth planning for school sites; significant traffic down Corona; access from Old Adobe ?; potential mass transit in some aeras; should be more urbanized. Nanette Nelson - 1736 Kohoutec Court - traffic problems will be created by Jr. College; flooding on Ely. Victor De Carli - Adobe, Road - more flooding will occur on west side of freeway; more flooding problems should not be created. Bill Kortum - Compliments on handling of: Ely Road and overall Corona /Ely Specific Plan; comments regarding feathering; higher density should be out near g- reenbelt; Jr. College very large traffic generator; road to Old Adobe from back of Jr. College is needed. John 'Troup - Corona Road and N:. McDowell - operator of J &D Automotive - concerns regarding road changes - how much land may be taken. The public hearing was continued to the Planning Commission meeting of September 13, 1988 in order to give sufficient time to review the draft EIR (the EIR was distributed to the Commission on August 9 and was distributed to the public the following day) . L PLANNING MATTERS V. 1988 -89 CONFERENCE SCHEDULE Attendence plans discussed. VI. CORRECTION OF MINUTES FOR MARCH 22, 1988 MEETING REGARDING DAWN PLACE TENTATIVE MAP. 8 Due' to staff error, after public hearing and Commission discussion regarding the Dawn. Place 9 -lot tentative map, changes to the conditions of approval were not made. A motion was made by Commissioner Tarr and seconded by Commissioner Bennett to direct staff to make the following corrections to the Planning Commission Minutes of March 22, 1988 pertaining to Dawn Place Tentative Map: Condition 8d shall be deleted: 1 8. The tentative map shall be revised to reflect the following i building setbacks. a. Lot 2 shall have a 'front yard setback of 30 feet. E b. Lots 3, 4 and 6 shall have a front setback of 25 feet. C. The setbacks from the property line adjoining lots 4 and 5 shall be a minimum of 10 feet for each lot. d. The east (side) setback on Lot 1 shall be 30 feet for the length of the building envelope. Condition 24 shall be revised as follows: 24. Building envelope on Lot shall not extend closer than 160 150 feet from the south . property line or 35 feet from the east property ! line, subject to staff approval. VI. DISCUSSION OF POSSIBLE PLANNING COMMISSION FIELD TRIP I DATES. Date chosen of September 20, 1988 at 3:00 PM, potential sites will be brought to Commission for discussion.
