APPROVAL OF MINUTES :. Minutes of August 9, 1988 were asked to be
researched and' resubmitted at the August '3.0 meeting.
PUBLIC COMMENT Greg Smith - 635 Baker St. - felt parking for
DeSchmire Restaurant should be paved at both lots.
COMMISSIONER COMMENT None.
CORRESPONDENCE Only pertaining to this agenda.
DIRECTOR''S_ REPORT Mr. Salmons will attend the APA Growth
Management Session in San Diego.

Continued Consideration:
I. ; WESTRIDGE UNITS 4 &5., "I" STREET, AP NO. 019 - 240 -04 and portion
of 019- 401 -02 (Files 11.864, 3.373 and 6.868) .
1. Consideration of PUD, Prezone and Tentative Map for 177 .
single- family lots (public hearing was opened and closed July 12,
1988).
In attendance:
Chuck Linthicum - Applicant - Answered questions regarding status of the
project; felt a 60 day delay would allow the project to move forward
quickly.
.,A continuance was requested by applicant and was granted. Meeting
was rescheduled with renoticing to Planning Commission meeting of
November 22, 1988.

1.602).

1. Consideration of EIQ.
2. Consideration of Conditional Use Permit to legalize non - conforming
use for, and allow expansion of, an auto body repair shop.
The applicant has withdrawn this proposal.
III. MARCELLUS PREZONING, 984 BODEGA AVENUE, AP No. 019 - 070 -41,
(File 3.362A) .
1. Consideration of EIQ.
2. Consideration for prezoning of a two -acre parcel to R -1, 20,000.
The ,public hearing was opened.
SPEAKERS:
Tom' Nowak - 982 Bodega Avenue -: Long range plan for this area should
be drone; excessive traffic noise, etc., road extension will cause loss of
open; areas; drainage problems have not been addressed; how can access be
gained for a driveway?
Roses Nowak- 982 Bodega Avenue Traffic very heavy already onto
Bodega; drainage major concern; also road maintenance responsibility.

Joe Billing - 240 Paula Lane .Feels the same as the two previous speakers;
traTFITproblems already exist`) density too high.
Ace M'arcellus - Applicant - Traffic problems may be alleviated by this
project;; drainage is not a problem. '
The public hearing was closed.
.A motion was made by Commissioner Libarle and seconded by Commissioner
Tarr to recommend to thei City Council approval of a Mitigated Negative
Declaration based on the findings listed below.

CHAIRMAN PARKERSON - NO - All concerns are not satisfied.
Findings
1. The proposed "project is consistent with the applicable provisions of the
General Plan and the Zoning Ordinance.
2. The prezoning leading to a future annexation. is consistent with
applicable State law ('Government Code 35012) and Sonoma County
LAFCO.
3. An initial study has bee_ n prepared and has determined, that anticipated
.adverse impacts can be satisfactorily mitigated through 'incorporation of
specific mitigation measures set forth herein.
4. The .project will not necessarily trigger growth - inducing impacts due to
the restrictions on the use of subject and adjacent- properties as
contained in current City policies regarding development in the vicinity
of the site.
5. The identified impacts concerning traffic and emergency vehicle access
will be lessened to an acceptable level by provision of .improvements as
.required by the Fire Marshal:
a. Provide fire hydrants each 300 feet..
b. Provide access road minimum twenty feet (20 in width and
thirteen :feet six inches (13' - vertical height, unobstructed all
weather, hard surface, with a turn' - around.
6. The identified impacts concerning public access will. 'be mitigated
through dedication of public right -of - way at time of land division
and 1 or development .
7. The identified impacts concerning, storm drainage and sanitary sewer
facilities will be mitigated by extension and /or improvement of existing

facilities, and the participation in payback agreements, as required
and subject to approval of City staff, as a condition of any
development or land division.
A motion was made by Commissioner Tarr and seconded by Commissioner
Libarle to recommend to City Council prezoning AP NO. 019 - 070 -41 (984
Bodega Avenue) to R -1, 20,000 based on the following findings listed in the
staff 'report.

COMM" ISSIONER READ — NO - Should be a cohesive plan for the area.

CHAIRMAN PARKERSON NO - Environmental concerns in area need to be
satisfied.
Findings
1. The prezoning is in the best interest of the City of Petaluma.
2. The prezoning shall not constitute an expansion of the existing Sphere
of Influence or water service boundary line.
3. That the proposed prezoning is in general conformity with the Petaluma
;General Plan.
4. That the public necessity, convenience and general welfare require or
clearly permit the adoption of the proposed prezoning.
5. ,That the incorporation of mitigation measures to address identified
.environmental impacts will insure that the prezoning and subsequent
'annexation occurs consistent with City Standards.

IV. TREE PRESERVATION - DISCUSSION OF POSSIBLE TREE
PRESERVATION ORDINANCES.
General Commission discussion:
Who has liability if tree falls and does damage after City has denied tree
removal?
City does not want to become involved in private disputes over trees.
This is not a tree ordinance proposal - only an item for discussion.
Hesitation to enact a tree ordinance.
Should a fee be charged to obtain a permit?
People in Petaluma should be more aware of tree preservation.

City's" policy regarding trees on public property needs reworking.
Staff to bring City tree ordinance covering public areas to Commission for
discussion".
V. TOUR LIST (TOUR DATE: TUESDAY, SEPTEMBER 20th, 3PM).
Discussion of tour route.
It was : felt that all projects could be seen on an approximately 3 hour trip.
All Commissioners are scheduled to attend..
VI. DISCUSSION OF 'DEPARTMENT OF FISH AND GAME POLICIES AND
PROCEDURES.
Bill Cox from. Fish and Game, will speak at the September 27, 1988 Planning
Commission .meeting. A representative from Sonoma County Water Agency
will be scheduled for the same meeting if possible.
A "Xeroscape" presentation is planned for the Site Plan and Architectural
Committee meeting of September 22 - all Commissioner's are invited to
attend.
