entertainment center.

The public hearing was opened.
SPEAKERS:
Joe Forest - City Attorney - Gave an overview of the agreement created by
the City and the applicant; procedures to be followed after this public
hearing.
Bill Brotman - 2009 Willow Drive (Owner of Dodge City) - Concerns with
problems which might be caused by this operation which would reflect
negatively on other video arcades; feels hours of operation should be
limited.
Kenneth Frankel - Applicant - answered questions regarding serving of
alcohol; 'method of separation of over and under 21 year -olds; agrees with
all items 'as presented.
(Police) Chief DeWitt Comfortable with the agreement and negotiations with
the applicant.
Neil Bloomfield - Applicant's attorney - requested minor wording changes to
agreement on pages 3 and 15.
Commission concerns included: separation of alcohol from under 21
year - olds; hours of operation; transfer of use permit to new owner.
The public hearing was closed.
A motion was made by Commissioner Doyle and seconded by Commissioner
Read to issue a mitigated negative declaration based on the following

1. The project, as conditionally approved, does not have the potential to
degrade the quality of the environment, substantially reduce the

animal community, reduce the habitat of a fish or wildlife species,
cause a fish or wildlife population to drop below self- sustaining levels,

2. The project, as conditionally approved, does not have the potential to
achieve short -term, to the disadvantage of long -term, environmental
goals.

are individually limited, but cumulatively considerable.

effects which will cause substantial adverse effects on human beings,
either directly or indirectly.
5. The project is consistent with and further promotes the objectives,
goals, and policies of the General Plan through the incorporation of
conditions of approval to restrict intensification.
A motion was made by Commissioner Bennett and seconded by Commissioner
Tarr ;to grant the conditional use permit for a multi -use recreational center
at 201 Washington Street based on the following two findings and subject to
the terms and conditions contained in the settlement agreement between
Kenneth Frankel and the City of Petaluma signed on August 16, 1988
including the minor changes to wording contained on pages 3 and 15 of said
agreement.

Findings
1. The proposed uses, subject to the conditions of approval, conform to
the intent and requirements of the Zoning Ordinance and the General
Plan.
2. This project, subject to the conditions of approval, will not constitute
a nuisance or be detrimental to the public welfare of the community
due to the mitigation measures incorporated in the conditions of
approval.
