The Planning Commission encourages applicants or their representative to be available at the meeting to answer questions so that no agenda item need be deferred to a later date due to a lack of pertinent information. COMMISSIONER COMMENT: None. CORRESPONDENCE None. DIRECTOR'S REPORT City Council will hold a study meeting on February 13 regarding 101 Corridor activity; flood mitigation status (SCWA) ; Proposed North McDowell shopping center will be presented to Council; Riverfront zoning meetings to begin 1/26; McDonald's project update. COMMISSIONER'S REPORT: None. READING OF APPEAL RIGHTS Within fourteen (14) calendar days following the date of a decision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed with the City Clerk. The appeal shall state specifically the grounds for the appeal and the relief sought by the applicant. 1 J75 NEW BUSINESS PUBLIC HEARINGS I. CITY OF PETALUMA - REVISION OF BUS ROUTES. 1: Consideration of Petaluma Transit modification to five current bus routes (to be in operation by March 1) . The public hearing was opened. SPEAKERS: Debbie Lowenthal - Edith Street - should' alter route to get children to Salvadore Anaya - Petaluma resident Bob Williams - Diamond Apartments Diamond Apts? Martha; Conyo - Diamond Apartments daughter rides bus to Cherry Valley, school slightly earlier. - notices too many empty buses. - will route remain on 5th Street for - too long of a wait for buses to Lynch Creek. The public hearing was closed. A motion was made by Commissioner Libarle and seconded by Commissioner Tarr to direct staff to prepare and post a negative declaration for the proposed bus routes based on the findings listed below: COMMISSIONER BENNETT - absent COMMIiSSIONER CAVANAGH - yes COMMISSIONER DOYLE - yes COMMISSIONER READ - yes COMMISSIONER TARR - yes COMMISSIONER LIBARLE - yes CHAIRMAN PARKERSON - yes Findings 1. The proposed routes do not have the potential to degrade the quality of the environment. 2. The proposed routes do not have the potential to achieve short -term environmental goals to the disadvantage of long -term goals. 3. The proposed routes do not have possible environmental effects which are individually limited but cumulatively considerable. 4. The environmental effects of the proposed routes will not cause substantial adverse effects on human beings, either directly or indirectly. 2 X7 6 A motion was made by Commissioner Read and seconded by 'Commissioner Cavanagh to recommend to the City Council approval of the certificate of convenience based on the findings listed below: COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER CHAIRMAN PAP Finding BENNETT - absent CAVANAGH - yes DOYLE - yes READ - yes TARR - yes LIBARLE - yes XERSON - yes 1. The proposed bus routes will conform to the intent of the applicable goals and policies of the General Plan/EDP. 2. The proposed - bus routes will not constitute a nuisance or be detrimental to the public welfare of the community. II. BLAIR ACCESSORY DWELLING, 130 WILSON, AP NO. 007 - 082 -10, (File 1.618). 1. Consideration of a conditional use permit for a residential accessory dwelling. The public hearing was opened. SPEAKERS: Mac Blair - owner, 130 Wilson - Problems with solid wood fence on south and west property lines and planter in front of accessory unit. The public hearing was closed. A motion was made by Commissioner Tarr and seconded by Commissioner Cavanagh to grant a conditional use permit for an accessory dwelling based on the findings and subject to the amended conditions listed below: COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER CHAIRMAN PAP BENNETT - absent CAVANAGH - yes DOYLE - yes READ - yes TARR - yes LIBARLE - yes XERSON - yes Findings 1. The accessory dwelling use, as conditioned, will conform to the requirements and intent of the Petaluma Zoning Ordinance. 3 a77 2. The accessory dwelling, as conditioned, will conform to the requirements and intent, goals and policies of the Petaluma General Plan. 3. The accessory dwelling, as conditioned, will not constitute a nuisance or be detrimental to the public welfare of the community. 4. It, is recognized that the height, size, shape, architecture, use, and location of the building are existing factors, and that legalization will, in no way, cause increased potential for adverse impacts to the surrounding properties. Conditions 1. The following requirements of the Chief Building Inspector shall be met prior to issuance of permits for separate utility service for the accessory dwelling: 1 Show location of building to property line. 2. Show location of utilities. 3. Provide as -built construction plans to scale. 2. Repairs shall be made to the existing patio cover located on the west side of the accessory unit to include shingles or lattice as appropriate, subject to staff approval. 3. The exterior trim of the accessory dwelling shall be repainted to match the primary residence. 4. A planter with live shrubbery shall be installed along the front wall of the accessory dwelling, design subject to staff approval. 5. Fencing along the north lot line shall be repaired as necessary or replaced. In addition, one of the following methods of screening of the south and west perimeters of the rear portion of the lot shall be accomplished to staff aAr)roval within 90 days : a. Separate gas and electric meters shall be installed for the accessory unit to the specifications of City staff and PG &E. 7. This project shall be subject to imposition of dwelling construction fees as specified under Section 17.12.010 of the Petaluma Municipal Code, payable at the time of application for utility permits. Any water, sewer and _school facilities fees deemed applicable shall be paid prior to issuance of Hermits. 4 7F 8. All. conditions of approval for the proposed accessory dwelling shall be met within 90 days of the date of approval; otherwise, the use permit shall expire and zoning enforcement proceedings shall be initiated. III. NOR BAY IRONCRAFT, 105 "H" STREET, (FOUNDRY WHARF BUSINESS PARK) , AP NO. 008- 194 -30, (File 1.617) . 1. Consideration of EIQ . 2. Consideration of conditional use permit allowing a steel fabricating operation. The public hearing was opened. SPEAKERS: Clifton 'Gore - Applicant - answered questions regarding loading; agreed with conditions. The public hearing was closed. A motion was made by Commissioner Read and seconded by Commissioner Cavanagh to direct staff to prepare a mitigated negative declaration based on the findings listed below: COMMISSIONER BENNETT - Absent COMMISSIONER CAVANAGH - Yes COMMISSIONER DOYLE - Yes COMMISSIONER READ - Yes COMMISSIONER TARR - Yes COMMISSIONER LIBARLE - Yes CHAIRMAN PARKERSON - Yes Findings a. Due to the developed nature of the existing site, the project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause fish or wildlife population to drop below self- sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal. or eliminate important examples of major periods of California history or prehistory. b. The project as conditionally approved does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. Because the project does not include additional phased development the project as conditionally approved does not have impacts which are individually limited but cumulatively considerable. d. The project as conditionally approved does not have environmental effects which will cause substantial adverse effects on human beings either directly or indirectly. 5 �7`J e. The project site mitigates possible adverse noise effects by its distance from any noise sensitive receptors such- as housing. Conditions of approval include noise attenuation. The proposed use, subject to the conditions of approval, conforms to the intent and requirements of the zoning ordinance and the General Plan. 2. This project will not constitute a nuisance or be detrimental to the public welfare of the community due to the mitigation measures incorporated in the conditions of approval. Conditions i 1. At no time shall future noise levels exceed standards specified in the Uniform Building Code, Section 22 -301 of the Petaluma Zoning Ordinance, and the 1987 General Plan. This is applicable to areas off -site as well as other areas of the building occupied by tenants other then the steel fabrication operation. Any existing or future equipment utilizing condensers shall be provided with noise attenuation. 2. All work - related activities shall take place indoors. 3. No storage of any type shall take place outdoors (i.e., machinery, equipment, parts, materials, items under repair, trash, scrap material, etc.) . To achieve this, a container for trash and a container for scrap material shall be provided indoors immediately. 4. This use permit may be recalled to the Planning Commission at any time due to complaints regarding noise generation or other objectionable operating characteristics. At such time, the Commission may repeal the use permit or add modified conditions of approval. 5. This use permit shall not become valid until the following items are completed (must be completed within 30 days) : ai Existing unenclosed dumpster or other garbage receptacles shall be moved indoors or out of view to staff approval. [: � 90 b. Applicant shall post a $200 cash bond to insure that, at such time as a sign program is adopted, any sign advertising Nor Bay Ironcraft shall comply. 6. All premises, structures, and operating equipment shall be inspected by Building Inspector, Fire Marshal, and EOS with particular attention paid to any potentially hazardous materials. Any corrections deemed necessary shall be completed within 30 days of use permit approval or as deemed appropriate by those agencies. IV. RIVERBOAT CRUISES, 6 PETALUMA BLVD. NORTH, PORTION OF AP NO. 008- 054 -05, (File 1.614) . 1. Consideration of EIQ. 2. Consideration of a conditional use permit for operation of a ticket sales office within the Great Petaluma Mill and for an excursion vessel on the Petaluma River.
