The Planning Commission encourages applicants or their representative to be available at the meeting to answer questions so that no agenda item need be deferred to a later date due to a lack of pertinent information. They will -be distributed prior to the February 28th meeting. Minutes of January 24, 1989 were approved. PUBLIC COMMENT None. COMMISSIONER COMMENT Commissioner Bennett suggested that the Commissioners be allowed to' give a consensus for a presentation before it is placed' on an upcoming agenda. CORRESPONDENCE Pamela Tuft distributed site plans relative to an appeal scheduled for this evening's meeting that arrived at the Planning Department today. DIRECTOR'S REPORT: None. COMMISSIONER'S REPORT: None. READING OF APPEAL RI_ GHT_ S : Within fourteen (14) calendar days following the date of a decision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall, be addressed to the Council in writing and shall be filed with the City Clerk. The appeal shall state specifically the grounds for the appeal and the relief sought by the applicant. 1 q NEW BUSINESS PUBLIC HEARINGS I. Edward Chin, Applicant,, 708 Bassett - opposes staff's plan of where to situate the accessory dwelling as opposed to his plan. 2. Tom Andrade, 716 Bassett wants to preserve his view of the hills, to know height of the accessory dwelling. 3. Norm Richtik, 715 Bassett - questioning construction materials (2x6's vs. .2x4's) , separate meters, etc. The public hearing was closed. A motion was made by Commissioner Doyle and seconded by .Commissioner Read to deny a Conditional Use Permit for a residential accessory .dwelling at 708 Bassett. THOMAS BAKER, "K" STREET AND PETALUMA BOULEVARD, AP NO. 008 - 281 -35, (File No.'s 1.620 and 6.930) . 1 Consideration of three Conditional Use Permits for an accessory dwelling unit on each of three lots. The public hearing was opened. 4 ''L SPEAKERS: 1. Arthur Hagopian, 34 Laurel Avenue owns adjacent property to applicant, and" questioned height of the accessory dwellings, drainage (and, resulting flooding problems) , ground elevations, developability of his lot. 2. Linda Kade, Project Architect, 149 Kentucky St.. (office) felt these were affordable units making optimal use. of the the lot; trying to be a good neighbor; chose accessory dwellings over PUD because of time frame involved; existing grade will be maintained. 3. Tom Baker, 64 Century Lane drainage problem has existed for over 40 years; feels 'PEP (.building 24 units) should share costs of drainage improvements or else his project be granted some type of relief; feels he has gone out of. the, way to offer diversity in the design of the homes to be compatible with West Petaluma. The public hearing was closed. A motion was made by Commissioner Li'barle and seconded by Commissioner Bennett to grant three conditional use permits for an accessory dwelling unit on each of three lots on "K "- "Street" at Petaluma Boulevard South (Lots 2, 3, and 4 of the Baker Parcel .Map), based on the findings, and subject to the amended conditions .listed in the staff report, along with a recommendation that storm drainage fees" be . addressed by the City Council. The proposed accessory dwelling use, subject to the conditions which have been attached, will conform to the requirements and intent of the Petaluma Zoning Ordinance 2. The proposed accessory dwelling, as conditioned, will conform to the requirements and intent, goals and policies of the Petaluma General Plan. 3. The proposed accessory dwelling, as conditioned, will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. Use permits shall only be valid after recordation of the proposed parcel map. 2. This project shall be subject to SPARC review and approval, with emphasis on the following a. Revised site plan to reflect adjustment of curb lines to allow for easier vehicle maneuvering and reduced pavement area 5 b,. All six units shall be compatible with each other and with the neighborhood, but shall include ample diversity between them as well. Diversity sha-1 may be achieved through provision of a variety of rooflines on the two -story units; of garage doors; and of accent treatments. C : Side and rear yard fencing and a fenced private yard area for the accessory unit shall be provided on each lot. d;. The location of the accessory unit as it relates to the privacy of 6. This project shall be subject to imposition of all applicable development fees, including but not limited to, water and sewer connection fees, storm drainage impact fees, dwelling construction fees, and school facilities fees. Fees are calculated and payable on a basis established by City ordinances. 7. Proposed accessory units shall conform to Section 21 of the Petaluma Zoning Ordinance which restricts heights of accessory dwellings to one story or 16 feet in height. 8. Any future commercial use of the sites must comply with all applicable zoning ordinance and Uniform Building Code requirements. PLANNING MATTERS III. Appeal of Administrative Decision. 1. Consider appeal of administrative denial of building a retail hardware store in light industrial (M -L) zone - McDowell Boulevard North at Commerce. adjoining neighbors. e: If the right -of -way width allows (as determined by Planning and Engineering staff) , a street tree planting strip shall be provided which shall include trees at maximum spacing of 25 O.C. and lawn and /or groundcover. 3. Construction and any grading for development of these lots shall be such that any stormwater runoff drains onto "K" Street or into an , appropriate storm drain, subject to review and approval of City Engineer. 4. Construction activities shall comply with all applicable zoning ordinance and municipal code performance standards (noise, dust, odor, etc.) . 5. Separate gas and electric meters shall be provided for the accessory unit. 6. Allen Henderson, petitioner - stressed this is a home -town store, wants to build a first -class building, needs a larger facility, serves a large clientele, both retail and commercial accounts.. 2. Paul 'Henderson, petitioner - desires use permit for - light- industry. as opposed to retail„ however, would not refuse to sell retail if customer not a commercial account. Department of Water Resources - Urban Stream Restoration 'Program. Ann Riley, Hydrologist with the Water Resources Department of the State of California gave a slide presentation. Grant proposal deadline is .February 28, 1989. V. Election of alternate SPARC representative. A motion was made by Commissioner Bennett and seconded by Commissioner Tarr to appoint Chairman Parkerson, as an alternate SPARC representative.
