The Planning Commission encourages applicants or their representative to be
available at the meeting to answer questions so that no agenda item need be

administrative decision to allow a setback variance for an addition. Item

approve variance.

DIRECTOR'S REPORT: A Draft EIR on Baywood Village Shopping Center
was distributed to Commission.
COMMISSIONER'S REPORT: Commissioner Read requested an update on
Corona Ely and developments along Old Redwood 'Highway.

READhNG OF APPEAL RIGHTS Within fourteen (14) calendar days
following the date of a decision of the Planning Commission, the decision
may b!e appealed to the City Council by the applicant or by any other
interested party. If no appeal is made within that time, the decision shall
be final. An appeal shall be addressed to the Council in writing and shall
be filed with the City Clerk. The appeal shall state specifically the

1. Consideration of Conditional Use .Permit for a residential accessory
dwelling and associated site improvements.
The public hearing was opened.
SPEAKERS:
James Parthum. - 322 Baranof - Applicant agreed with all conditions.
The public hearing was closed.
A motion was made by Commissioner Bennett and seconded by "Commissioner
Libarle to grant a conditional use permit to allow the conversion of a garage
to an accessory dwelling unit at 322 Baranof based on the findings and
subject to the conditions as listed in the staff' report.

Findings
1. The proposed accessory dwelling *use, subject to the conditions which
have been attached, will conform to the requirements and intent of the
Petaluma Zoning Ordinance.
2. The proposed accessory dwelling, as conditioned, will conform to the
requirements and intent, goals, and policies of the Petaluma General
Plan.
3. The proposed accessory dwelling, as conditioned, will not constitute a
nuisance or be detrimental to the public welfare of the community.
Conditions
1. This project shall be .subject to administrative SPARC review and
approval, including but not limited to the following:
a.. The garage door, frame, and trim shall be removed and replaced

dwelling construction fees, and school facilities fees (if applicable) .
Fees are calculated and payable on a basis established by City
ordinances.

1. Consideration of variance 'for sideyard setback.
The public hearing was opened.
SPEAKERS:
Gary Tmm - 811 D Street - Applicant Explained that a variance `is
necessary for an expansion of use.
The public hearing was closed.
A motion was made by Commissioner Libarle and seconded by Commissioner
Bennett to approve a side yard variance to allow a 12 foot setback along
Madison Street subject to the findings listed below.

Findings
1. 26- 303.1- -That there are, peculiar and unusual conditions inherent in
the property in question sufficient to cause a hardship, and
that such conditions are not common to all or most of the
properties in the immediate area.
The peculiar .conditions are the existing buildings on an industrial
zoned site have been used by the food industry for many years
without great objection from the neighbors. The location of these
buildings with the extension planned are not common to all properties
in the 'immediate area.
2. 26- 303.2- -That a hardship ,peculiar to the property and not created by
any act of -the owner exists. In, this context, personal,
family or financial difficulties, loss of prospective profits,
and neighboring violations are not hardships justifying a
variance.
Hardship is inherent in existing :buildings in relation to. property lines
and granting of variance is not based on financial difficulties.
3. 26- 303.3- -That such variance is necessary for the; preservation and
enjoyment of substantial property rights possessed by other
properties in the same zoning district and in the vicinity,
and that a variance, if granted, would not constitute, a

special privilege of the

property, but will improve the environment in the following ways:
a. Less truck traffic.

C. The proposed building will form a sound barrier between Madison
Street and the on -site truck parking.
d. A five foot sidewalk and continuous landscaped sideyard will be
added along the Madison Street frontage.
This variance will enhance the streetscape and help the public interest
by allowing an important agricultural related industry to expand on
existing industrial zoning within Petaluma.

Doyle to deny the appeal, thereby denying the requested variance for a ten
foot rear yard setback at 2241 Aaron Court, based on the following

II. RIVERBOAT CRUISES., PETALUMA RIVER TURNING BASIN AT JACK
CAVANAGH, SR. PARK, (File No. 1.614) .

2. Consideration of Conditional Use Permit for Riverboat Cruises
The public hearing was opened.
SPEAKERS:
Frank Prim - Public Works Supervisor - Answered . questions regarding
Turning Basin operations; revenues; existing boats may have to leave
turning basin, Chamber of Commerce. River Committee supports this type of
project.
Pat Miller - Public Works Director - Yacht Club in favor of this project;
how will this boat be moored? All transient mooring will be lost.
Gene Peale - 749 Bantam Way - Who will be responsible for washouts caused
by waves from cruise boat?
William Barker 1470 Lawndale, Kenwood - Applicant - Boat does not create
a. wake-; vessel can maneuver in its own length; boat designed by Bill
Preston.; fully equipped kitchen; bridge openings may coincide with
openings already arranged; boat will be anchored at end of dock with bow
loading.
Bob Martin 171 Payran St. - Would like to see Sea Scouts become' involved
in this and other river projects.
The public hearing was closed.
This item was continued to the Planning Commission meeting of April 11 to
allow further discussion between the applicant, the Chamber of Commerce,
Yacht Club and staff.
PLANNING MATTERS:
III. BODEGA AVENUE DEVELOPMENT POLICY.
SPEAKERS`:
Walter Sorensen - 1002 Bodega Avenue - does not want policy to force
annexation of unwilling properties or the installation of frontage
improvements on properties not developing.

Sarto Rocheleau - Vallejo Street - is currently designing subdivisions in
area that can conform to policy; hopes to have proposals 'before COmmission
in less than one year.
Fred Tarr- Commissioner = Encourages connection, even if its only for
pedestrians, between Cherry Valley and Bodega Avenue.
A motion was made by Commissioner Read and seconded by Commissioner
Libarle to recommend to the City Council approval of the proposed Bodega
Avenue Development Policy.

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF PETALUMA hereby adopts the following policy:
As conditions of approval, all new development projects, building
permits, subdivisions of land, and projects requiring a discretionary
permit or approval from the City within the Bodega Avenue Corridor,
as shown in Exhibit "A", shall do all of the following:
1 Reduce to the extent possible existing driveway access points and
prohibit to the extent possible all new driveway access points to
Bodega Avenue.
2: Install improvements (or contribute the project's pro rata share
for future installation) along the project's. Bodega Avenue
frontage, including, but not necessarily limited to, storm drains,
water and sewer lines, curbs, gutters, streets, sidewalks, and
street lights to City -Standards as determined by the City
Engineer.
3. Widen and dedicate for public use Bodega Avenue to accommodate
projected traffic levels.
4. Underground all utilities fronting or traversing the site unless
otherwise provided by City Ordinance or waived by the City
Council.
5. Contribute fair share funding (as determined by the City
Engineer) towards off -site traffic and storm drainage
improvements (e.g.; traffic signals at Bantam Way and Webster
Street) .
6'. Provide parallel or "loop" streets for vehicular access.
A. On the northern side of Bodega Avenue, this loop street
shall connect to Bodega Avenue only at North Webster Street
and Bantam Way, as conceptually shown on the General Plan
Circulation Map, and possibly Ruth Court.
B. On the southern side of Bodega Avenue east of Bantam Way,
street connections may occur only at Louken Street and
Panda Place.

C. For areas currently outside the City limits, annexation
proposals must be accompanied by a master street plan that
will utilize Bantam Way for access `to Bodega Avenue.
7. Provide access to a permanent public 'road (or private road if
approved by the City Council.) prior to issuance of any building
permits for a given project. New temporary roads are not
permitted to provide direct access to Bodega Avenue in lieu of
permanent access described in Policy No. 6, above.
NOW, THEREFORE', BE IT' FURTHER RESOLVED that the policies adopted
hereinbefore are not intended to affect existing parcels or homes with
driveway(s) providing direct access to Bodega Avenue unless' said parcels
or homes are associated with, a subsequent development or subdivision
proposal through which alternate access can be provided in conformance
with these policies.
