The Planning Commission encourages applicants or their representative to be available at the - meeting to answer questions so that no agenda item need be deferred to a later date due to a lack of pertinent information. PUBLIC COMMENT (15 minutes maximum) . The Planning Commission will hear public comments only on matters over which they have jurisdiction. There will be no Commission discussion. The Chairman. will allot no more than five minutes to any individual. If more than three persons wish to speak, their time will be allotted so that the total amount of time allocated to this agenda item will be 15 minutes. Speakers None. COMMISSIONER COMMENT None. CORRESPONDENCE Two letters regarding Chevron; letter from Police Chief regarding denial of alc'hohol sales; letter from applicant (Chevron) requesting rescheduling. DIRECTOR'S REPORT Council feedback - Working with. Council on GP amendments Metcalfe and Park. Place 5; additional GP Amendments in future; update on Westridge - LAFCO continued consideration to June 1, additional information will be brought to Commission for review. COMMISSIONER''S` REPORT None. 1 READING OF APPEAL RIGHTS: Within fourteen (14) calendar days following the date of a ecision of the Planning Commission, the decision may be appealed to the City Council by the applicant or by any other interested party. If no appeal is made within that time, the decision shall be final. An appeal shall be addressed to the Council in writing and shall be filed with the City Clerk. The appeal shall state specifically the grounds for the appeal and the relief sought by the applicant. NEW BUSINESS PUBLIC HEARINGS I. The public hearing was opened. SPEAKERS: Joe Ferguson - Applicant - has arranged with EOS to safely dispose of any hazardous wastes to EOSs' satisfaction. The public hearing was closed. Due to the developed nature of the existing site, the project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause fish or wildlife population to drop below self- sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of major periods of California history or prehistory. b. The project as conditionally approved does not have the potential to achieve short term to the disadvantage of long term environmental goals. C. Because the project does not include additional phased development the P roject as conditionally approved does not have impacts which are individually limited but cumulatively considerable. d. The project as conditionally approved does not have environmental effects which will cause substantial adverse effects on human beings either directly or indirectly. e. Conditions of approval mitigate possible adverse effects from potentially hazardous materials. Prior to occupancy or as deemed appropriate, all requirements of the Fire Marshal shall be complied with, as follows: a. Complete declaration of Hazardous Materials Storage Form and return to Fire Marshal as soon as possible. b. Provide fire extinguisher 2 A rated A B C dry chemical type as required by the Fire Marshal. C. Post address at or near main entry door - minimum two inch letters. d. No extension cords. All equipment and appliances shall be direct plug -in. e. Provide metal or flame retardant plastic waste, cans. f. Storage shall be maintained a minimum of eighteen (.18) inches below sprinkler heads. 2. Prior to occupancy, or as deemed appropriate, all requirements of EOS shall be complied with: a. Needs discharge permit and regulations (per ordinance) . 3. This use permit shall not become valid until a Certificate of Occupancy has been issued for the building. 3 The public hearing was opened. The public hearing was continued to the Planning Commission meeting of June'l3th. III. UPS EXPANSION, 3860 CYPRESS, AP NO. 005- 090 -58, 59, 60, 61, (File 1.. 497A) . i. Consideration of Mitigated Negative Declaration. 2. Consideration of Conditional Use Permit to allow a 45,400 sq. ft. addition to an existing 17,500 sq. ft. warehouse and parcel distribution center. The public hearing was opened. SPEAKERS: Jeff Hall UPS - 6662 Hones Drive - Pleasanton - Applicant - East property line needs redesign; landscape architect recommended eucalyptus removal now; ;evergreen trees at rear property line (removal) also recommended by landscape architect; has problems with parking design; problems with conditions 5, 11, 12b, 12d, 12e. The public hearing was closed. 4 4. Per a condition of SPARC approval, no sign shall be erected prior to approval of a sign program for the building. Any future sign shall comply with said program and shall not be installed prior to obtaining a sign permit. 5. No storage of any type shall take place outdoors (i.e., machinery, equipment, parts, materials, items under repair, trash, etc.) . 6. This use permit may be recalled to the Planning Commission at any time due to complaints regarding objectionable operating characteristics. At such time, the Commission may repeal the use permit * or add modified conditions of approval. T- II. CHEVRON CONVENIENCE MARKET, 2 PETALUMA BLVD. Potential impacts related to earth /' water, traffic, aesthetics, noise, light and land use will be mitigated by the conditioning of this project. 2. No other potentially significant environmental or land use impacts were identified. 3. This project is consistent with the objectives, goals, and policies of the General Plan. This project is consistent with the Light Industrial Zoning District and the City of Petaluma Zoning Ordinance. 2. This use permit is consistent with the Industrial designation and the objectives, goals, and policies of the General Plan. 3'. No significant environmental or land use impacts will result from this project. A Negative Declaration, with mitigations, has been recommended. Conditions 1. The applicant shall execute an, agreement to participate in the Lakeville Assessment District for Lakeville Highway corridor improvements. 2. No truck repair shall be - performed on site. 01 3.21 a. Move existing fire hydrant from present location to location next to dumpster as we discussed. bi. Permits required for tank removal and tank installation. c. Install additional fire hydrant as shown on plan. d. Install fire hydrant as shown on plan. 10. This project shall conform to the master landscape and irrigation plans and to the Conditions, Covenants and Restrictions approved for the Oakmead - Northbay Industrial Park, except where required by SPARC to be more extensive. 11. A revised parking plan shall be submitted for SPARC review - and approval which incorporates the following requirements: a,. A mix of handicapped and standard parking spaces shall be provided at the customer entrance. b. A total of 282 parkings spaces shall be provided or it shall be illustrated that these spaces could be provided c-. Plans shall be submitted to Chief Building Inspector indicating path of travel from handicapped spaces to entrance. 12. Plans shall be provided, for SPARC review and approval which shall, as close as possible attempt -to meet the following guidelines: a Provide landscape islands, including trees, along building north and east elevations in areas not featuring roll-up doors. 6. 3. No outdoor storage of materials or handling equipment other than functioning delivery vehicles shall be permitted on -site. 4. The four lots of the proposed project site shall be merged, prior to issuance of a building permit. 5. Truck washing facilities shall be shown on the plans, location, and design subject to review' and approval of City staff. 6. All on -site drainage systems, particularly the truck washing area, are subject to approval by the City Engineer and Envirotech to insure that no inordinate or unacceptable amount of materials or rain water enter the waste water treatment plant. 7. The developer .shall pay storm drainage impact fees as set forth in CO Petaluma Municipal. Code Chapter 17.30. 8. No permanent structures shall be installed in the sanitary sewer easement across the rear of the property. 9. The following requirements of the Fire Marshal shall be met: a. Provide a 20' landscaped strip with berm on east property line (may be reduced in. width in areas where applicant can, demonstrate that expanded strip would constrain circulation` /truck access to building. c.. Carry the wrought iron fence_ around, east and west property lines for 50' before transitioning to chain link. d. Provide additional landscape screening along Cypress Drive and around building mechanical equipment. e. Incorporate architectural relief details on north ;elevation.. At a minimum, plans shall be submitted for SPARC review illustrating alternate. canopy treatment including varied pitch /.height,, breaks in canopy length, and other treatments to avoid 400 foot: uniform canopy. The application of reveals, accents, and /'or varied building setbacks on the .north elevation shall be considered. 13. The evergreen trees on the south property line shall be preserved and protected. Additional redwood trees shall be provided, as necessary, to provide a continuous screen between the site and - adjacent agricultural land. 14. The Eucalyptus trees in the landscape median next to the tractor staging area shall be preserved. Parking lot layout shall attempt to preserve the existing Eucalyptus trees. The three or .four evergreen trees at the west end of the Eucalyptus row shall be preserved. 15. Parking design shall be submitted for SPARC review to attempt to increase the landscape strip between the site and agricultural land to the south. The landscape strip shall be expanded, if necessary, to preserve and protect existing pine trees. 16. The landscaped strip on Cypress Drive shall be augmented by the addition of trees both along the, top of the berm and near existing trees to create tree 'clusters. Additional shrubs shall be planted along the fence line to create a shrub screen. 17. A g- rading. plan /drainage plan shall be submitted for SPARC review,, which: minimizes the amount of required cutting_ /filling. Plans shall indicate the location of existing, pine trees and provide a taper from cut banks or filled land to natural contour which protects existing vegetation.. Calculation of the total, amount of cutting and filling shall be provided. 18. All exterior light fixtures, including lights on the existing `building, shall be subject. to SPA -RC review and approval. Manufacturers specifications shall 'be ,provided for all lights. Light' standards and concrete pedestal elevations shall be submitted for SPARC review. All lights attached to buildings shall provide a soft "wash" of light against the wall. All lights shall conform to. City performance standards (e..'g. , no direct glare, no poles in excess of 20! height, etc.) and shall complement building .architecture. Lighting shall be designed to be minimum intensity necessary for its intended use. 7 323 Is i IV. A motion was made by Commissioner Tarr and seconded by Commissioner Bennett to recommend to the City Council issuance of a Mitigated Negative Declaration based on the following findings: COMMISSIONER BENNETT - Yes COMMISSIONER CAVANAGH - Absent COMMISSIONER DOYLE - Yes COMMISSIONER LIBARLE - Absent COMMISSIONER READ Yes COMMISSIONER TARR - Yes CHAIRMAN PARKERSON - Yes Findings 1. Potential impacts related to circulation will be mitigated by precluding vehicular access to Bodega Avenue for future development. 2. Potential impacts related to land use and aesthetics will be mitigated by SPARC review of any multi - family development to ensure compatibility of site design and architecture with surrounding development. 3. No other potentially significant environmental or land use impacts were identified. 4. This project is consistent with the objectives, goals and policies of the General Plan. A motion was made by Commissioner Tarr and seconded by Commissioner Bennett to recommend to the City Council approval of a General Plan amendment for AP No's 006 - 302 -02 and 03 from Mixed Use to Urban Diversified based on the following findings: COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER COMMISSIONER BENNETT - Yes CAVANAGH - Absent DOYLE - Yes LIBARLE - Absent READ - Yes E:3 M COMMISSIONER TARR - Yes CHAIRMAN PARKERSON - Yes Findings 1) The Urban Diversified General Plan. designation will allow development compatible with surrounding development'. 2) This amendment is consistent with the objectives, goals, and policies of the General Plan. 3) No significant environmental or land use impacts will result from this project. A Negative Declaration has been recommended. A motion was made by Commissioner Tarr and seconded by Commissioner Bennett to recommend to City Council approval of a rezoning from Neighborhood. Commercial to Compact Single- Family Residential' based on the following findings COMMISSIONER BENNETT - Yes COMMISSIONER CAVANAGH - Absent COMMISSIONER DOYLE - Yes COMMISSIONER LIBARLE - Absent COMMISSIONER: READ - Yes COMMISSIONER TARR - Yes CHAIRMAN PARKERSON - Yes Findings 1) This rezoning will make the zoning consistent with the proposed Urban Diversified General Plan designation. 2) The Compact Single- Family 'Residence District will allow development compatible with surrounding development. 3) This amendment is consistent with the objectives, goals and policies of the General Plan. 4) No significant environmental or land use impacts -will result from this project. A Negative Declaration has been recommended. V. CITY OF PETALUMA, ZONING ORDINANCE TEXT AMENDMENTS (Continued from 4/25/89 meeting). 1. Consideration of 'Negative Declaration. 2 Consideration of View Corridors from Major Thoroughfares. The public hearing, was opened. SPEAKERS: None. r The public hearing was, closed. 9 After 1 discussion, this item was continued to a future Planning Commission meeting (most probably June 22) PLANNING MATTERS VI. DISCUSSION OF ACCESSORY DWELLING ORDINANCE POLICY. After - discussion, the following items were deemed important to include in revised Zoning Ordinance language: 1. Four or fewer accessory dwellings will be allowed to be constructed at CD same time as development of main unit. 2. Conversion of existing covered parking to supply an accessory unit will not be allowed. co 3. No restrictions on occupancy of accessory units. 4. Neighborhood objections 'should be decided on a case -by -case basis. 5. Second story accessory units will be allowed. 6.
