APPROVAL OF MINUTES Minutes of September 26, 1989 were approved
with corrections to page 7.
PUBLIC COMMENT (15 minutes maximum) . The Planning Commission will
hear public comments only on matters over which they have jurisdiction.
There' will. be no Commission. discussion. The Chairman will allot no more
than five minutes to any individual. If more than three persons wish to
speak,! their time will be allotted so that the total amount of time allocated

READING OF APPEAL RIGHTS Within ,fourteen (14) calendar days
following the date of a decision of the Planning Commission, the decision
may be appealed to the City Council by the applicant or' by any other
interested party. If no appeal is made within that time, the decision shall
be final. An appeal shall be addressed to the Council in writing; and shall
be filed with the City Clerk. The appeal shall state specifically the
grounds for the appeal and the relief sought by the applicant..

all items have been worked out to satisfaction of all.

Commissioner Tarr - Questions ,regarding Development Agreement fees.

A motion was made by Commissioner Libar;le and seconded by Commissioner
Parkerson to recommend to the City Council approval of an amended
Development Agreement including - Exhibit "D ", containing all components and
revisions as listed in the staff report dated 'October 10, 1989.

Sylvia McDow - 518 '7th Street objects to this commercial use in a
residential area. Many children playing in street; too much traffic; privacy
being infringed upon; against this use.
Mark Antell - Applicant - 525 7th Street - will not be a boarding house:
questions regarding a few of the conditions - wants to add allowance of two
non -guests for conferences during . regular business hours; feels
administrative SPARC review should be sufficient; what will total traffic
mitigation fee be? Answered questions.

d. No• accessory use of the inn shall be permitted. For purposes of
this use permit, accessory use of the inn shall mean any
commercial use other than the renting of guest rooms and
provision of one meal per day to guests of the inn. Accessory
uses include but are not limited to, use of the inn for
conferences, weddings., fundraisers and similar events attended
by non - guests.
e. City Departments may periodically conduct an inspection of the
inn during regular business hours to determine compliance with
use permit conditions, the Zoning Ordinance and other applicable
ordinances and laws they administer. A warrant shall be obtained
rX I when required by law.
2. Normal operating hours for business - related activities including
•deliveries housekeeping and
maintenance services, and non - resident domestic employees shall be
rn {restricted to the hours of 8:00 AM to 6 :00 PM. No more than one
f non- resident employee or service vehicle shall be permitted on-site, at

3. Approval of this use permit shall constitute a revocation of the prior
City approval to allow a second dwelling at this site. Furthermore no
jfuture conversion of any guest room, addition of a second dwelling
!unit or expansion of the inn use shall be permitted during the life of
!this use permit.
4. !This project shall be subject to 5PARC review, with emphasis on the
;following considerations:
�a.
The
need to reconfigure the parking area in order to achieve
proper circulation on -site, and minimize parking conflicts.
'b.
The
need to minimize the amount of driveway and parking surface
area
in order to preserve existing openspace for landscape
purposes.
C.
The
need for alternatives to standard driveway paving, curbing,
and
striping in order to retain the residential quality of the site,
and
protect yard areas.•
d.
The
need to protect neighboring properties from potential noise
and
glare impacts.
e..
The
need for improvements to existing building exteriors,
landscaping
and other site amenities.
f.
The
need for on -site lighting as a security and safety measure.
g .
The
need for appropriate design and placement of any proposed
signage
given the residential setting.
5. This project shall be subject to imposition of all applicable development
fees, including but not limited to water and sewer connection fees and
storm drainage impact fees.
6. In addition to those fees specified under Condition #5, the project
sponsor shall, prior to issuance of a building permit, pay a . fee of
-$50.00 per daily trip end estimated to be generated by the project.

If the City establishes a Major Facilities Traffic Mitigation Fee prior to
issuance of a building permit, the fee for said project shall
thereinafter be either $50.00 per trip end or the Major. Facilities
Traffic Mitigation Fee,. whichever is Tess.
III. OLD ADOBE SCHOOL DISTRICT LANDS, NORTHWEST CORNER OF
MARIA DRIVE AN. D BANFF WAY, AP NO's 149 - 280 - and 47, (File
No's 8.117 and 3.398) .
1. Consideration of EIQ,.
2. Consideration of a General Plan Land Use Amendment from School
District Lands (Proposed Elementary) to Residential - Urban
Standard (up to 5 du /acre).
3. Consideration of rezoning; from PUD to R -1 '6,500, Single - Family
Residential, - or an amended PUD D:evel'opment Plan to allow
subdivision of a 4,.2 acre site.

2. Consideration of a conditional use permit to allow 375 feet of
floating docks on the Petaluma River at the Foundry Wharf.

Walter Haake - Applicant - addressed question of parking'- will not allow
live- aboard ,; answered questions about project; access to river by this
dock; parking cannot be provided on this site (the extra 6 spaces) .
Ray Tar-rier - neighbor - fishes a lot: - wants this project to be allowed.
Valerie Wa ll - Manager Northwest Title - 515 E. Washington - Riverfront
parking problems can be solved by closing off some streets to cars and
allowing buses.
The public hearing . was closed.
This item was continued to the Planning Commission meeting of October 24
to resolve parking questions.
V. SHELL SERVICE STATION, 900 PETALUMA BLVD. NORTH, AP NO.
150- 01`1 =05, (File No. 1.624) .
1. Consideration of EIQ.
2. Consideration of a conditional use permit to allow a convenience
market and carwash addition to an existing service station.
This public hearing was opened and continued to the Planning Commission
meeting of November 14 due to a request by the applicant's representative.
VI. REDWOOD PLAZA, NORTHEAST CORNER OF OLD RED_ WOOD HIGHWAY
AND NORTH MCDOWELL BOULEVARD, AP NO's 137- 011 -10 and 11 (File
No. 1.631A)
1. Consideration of a conditional use permit amendment to allow an
increased size from 2,240 sq. ft. to 2,859 sq.ft. for a proposed
fast food restaurant.
The public hearing was opened.
SPEAKERS:
Dick Lieb This use will probably be. a Carl's Junior; driveway locations
are as shown on plans.
Keith Jones - Owner, Petaluma Tire and Brake - Sees a problem with larger
square footage (parking).; there are changes in each drawing; litigation is
on -going at this time.

A motion was made by Commissioner Libarle and, seconded by Commissioner
Doyle to find that no additional environmental :review is necessary for this
use permit modification based on the following findings:

1. This use permit shall allow a 2 i 859 sq. ft. fast food restaurant with a
drive- through window. Restaurant location shall substantially conform
with the conditional) y approved attacltcel site plan dated May 9, 1989
(prepared by Park/Abrams).

control plan as part of the SPARC
review application.

be regularly maintained to ensure
that an accumulation
of trash,

or debris does not occur.

3. A sign program. for. the. restaurant shall be developed and submitted as
part of the ,SPARC application package. The restaura_AVs signs must
conform to the center's sign. program.
4.. Parking lot and accent lighting shall conform to the lighting program
for the center.
5. The is project is subject to SPAR.0 approval. Special items, of concern
that SPARC shall address include, but are not limited to:
a. Berms and /or heavy landscaping to screen the' :drive - through lane
from the street.
6. All conditions of approval of use permit 1.632 to allow a shopping
center shall be in full force for the development and operation' of this
f acility.
7. This use; permit may be recalled. to the Planning Commission for review
at any time due to complaints, regarding traffic congestion, noise
generation, or other potentially objectionable operating' characteristics.
At such times, the Commission may repeal fhe use permit or
add /modify, conditions of 'approval.
8. Traffic Impact Mitigation fees of $50.00 per added daily vehicle trip
shall be paid prior to the issuance of a b;uildin ermit. The project
contribution, based upon the ex added restaurant floor area, is
10, 000 200 primary trips x 50.00 A separate fee was 'required as
a condition of approval for the entire center
VII. DEVELOPMENT AGREEMENT FOR CERTAIN PROPERTTES IN THE
CORONA /ELY SPECIFIC PLAN AREA.

and 23.

SPEAKERS:
Matt Hudson - Representative of developers in Corona /Ely area; has, been
working with City Attorney on development agreement: final agreement
should. be ready by October 24 meeting.
The public, hearing was continued to the Planning Commission Meeting of
October 24, 1989.
