dedication to the City, automatic fire extinguishing system in new building.

all plan to participate, but all at once after plan has been agreed upon.

Findings for Use Permit
1. 'This project, as conditioned, is consistent with the Light Industrial
Zoning District and the City of Petaluma Zoning Ordinance.
2. ;The provision of an open space /pedestrian and river maintenance
; easement is required for consistency with General Plan goals, policies,
,and objectives.
3. This project, as conditioned, is consistent with the City of Petaluma
General Plan.
4. 'No significant land use or environmental impacts will result from this
project. A negative declaration has been adopted.
Conditions
1. This project activity shall substantially conform to the approved
project description provided in the staff report dated September 26,
1989. Minor revisions which do not increase project impacts may be
approved by the Community Development and Planning Director.
2. All broken public cux+b, gutters, and sidewalks shall be repaired prior
to the issuance 'of building permits, subject to the approval of the City
Engineer.
3. Building plans shall be signed by responsible party, subject to the
approval of the Chief Building Inspector.
4. The following requirements shall be met, subject to Fire Marshal
approval:
a. Building `shall be protected by an automatic. fire extinguishing
system as required by section 10.308A of the 1985 Edition of the
Uniform Fire Code.
b. 'Permit required from Fire Marshal's Office for sprinkler system
alteration prior to work being started. Two sets of plans are
required.

5. In the event prehistoric or historic period materials are encountered,
work in the immediate vicinity of the find shall be halted until they
can be evaluated by a qualified archaeologist. Buried. prehistoric
archaeological materials might include obsidian and chert flakes and
tools., groundstone tools, thermally altered rock., dictary remains of
shell or bone, human graves, and locally darkened trash. Historic
materials might include backfilled privies or trash. pit containing
square nails and ceramics or -glass, structural remains or foundations,
and human graves. The archaeological recommendations shall be
subject to staff review and approval.
6. Prior_ to the issuance of a building permit, clearance, shall be provided
from the State Lands Commission, to City staff satisfaction.
7. This use shall comply with Article 22 of the Zoning Ordinance,
Performance Standards.
8. in the event demolition is proposed for the building .in the northeast
corner of the site labeled "Petaluma Yacht Club," prior- to the issuance
of a demolition permit the Yacht Club and the Petaluma Museum
Association shall be contacted and given. an opportunity to inspect the

9.46: Prior to the issuance of a building permit, revised plans shall be
submitted for SPARC review and approval. In addition to the
standard areas of SPARC review, review shall focus on the following
areas:
a. Minor. architectural touches shall be considered for SPARC review
of the addition and /or the long expanse containing the existing
and proposed building shall be enhanced through the use of
accent color(s), such as painting the roll -up doors.
b. A landscape plan /site plan shall be submitted for SPARC review
and approval which includes the following:

1. Native vegetation (trees.),, such as oak or willow, shall be

location., type and spacing. ( Tree spacing may be varied
due to existing development and boat building activities. )

Findings
1. The proposed accessory dwelling use, subject to the conditions which
have been attached, will conform to the requirements and intent of the
Petaluma Zoning Ordinance.
2. The proposed accessory dwelling, as conditioned, will conform to the
requirements and intent, goals, and - policies of the Petaluma General

nuisance or be detrimental to the public welfare of the community.
Conditions
1. This use permit shall not be valid until a floor plan is submitted to
Planning staff which confirms that the accessory dwelling unit does not
include more than one bedroom or other room suitable for sleeping
purposes.
2. All requirements of the Engineering Department shall be complied with,
within 90 days of the granting of this use permit including:
a. Repair driveway approach.
b�. Existing cobblestone curb must be preserved.
3. All requirements of the Chief Building Inspector shall be complied
with, in conjunction with the proposed addition to the main dwelling
including:
a. All roofing shall be "B" rated or better per Ordinance No.
1744/1988.
b. Show site drainage and grading topography.

d% Verify utilities are adequate for building (i.e., size of water,
electric and gas service and size of sewer) .
e. Responsible party to sign plans.
4. Approval of this use permit confers legal non - conforming status upon
the accessory .dwelling unit. All regulations governing non - conforming
u'ses /structures shall be applicable. This includes prohibiting

restoration or reconstruction (if damagged to an extent greater than 50%
of its value) except in conformance with current zoning standards.
5. Validity of this use permit is contingent upon completion of the
following:
a. Replacement of perimeter fencing where needed as determined by
staff (Property lines must be agreed on by neighbor and
apulicant prior to 'issuance of building permit for fence .
b. Provision of privacy fencing for the . two rear yard' areas as shown
on plans. Design and location shall be subject to staff' approval.
C. Driveway gate shall be painted to match th& residences, subject
to staff approval.
d. Foundation planting shall be provided along the east elevation of
the accessory dwelling,. subject to staff approval.
e. All items shall be completed within 90 days of use permit
approval.
6. The proposed addition to the main residence shall be subject to
Administrative SPARC review.

design as distance.
Commissioner Tarr -- Doesn't feel setbacks are necessary in downtown area.
Commissioner arkerson - Setbacks should be a function of building
heights.
Commissioner Tarr - SPARC is doing fine.

Marge- Miller_ - Kentu'cky. Street - proponent of historic district majority of
owners are in agreement with forming this district.
A motion was made. by Commissioner Libarle and seconded by Commissioner
Read to authorize .Planning staff to allocate $2,.000 from Consultant Budget
and to ask Heritage Homes for a like donation to have a photo 'inventory of
this area prepared.
