APPROVAL OF MINUTES Minutes of October 24, 1,989 were approved as
printed.
PUBLIC COMMENT (15 minutes maximum) . The Planning Commission will
hear public comments only on matters over which they have jurisdiction.
There will be no Commission discussion. The Chairman will allot no more
than five "'minutes to any individual. If more than three persons wish to
speak, their time will be allotted so that the total amount of time allocated
to this agenda item will be 15 minutes.

for Bea uty College been met? ( Response by W . Salmons: Yes, City is
holding a $25,000 bond.) .

1. Continued consideration of a proposed amendment to conditions of
approval for a Use Permit allowing addition of a carwash to an
existing service station.

is built, ` what would costs be?

Commissioner Parkerson - Agrees'. with staff's recommendations.
Commissioner Balshaw - Exit only from driveway nearest Washington
concrete median was originally at' Washington and Lauren.
The public hearing was closed.
A motion was made by Commissioner Parkerson and seconded by
Commissioner Read to deny the request to delete Condition #1 from the
adopted use permit conditions based on the findings in the staff report.

A motion. was made by Commissioner Doyle and seconded by Commissioner
Libarle to deny without prejudice the request to delete Conditi on #1 from
the adopted use permit conditions based on the findings in the staff
report. *

Findings
1. Due to the potential adverse impacts of increased traffic congestion
both on -site and at the intersection of McDowell Blvd. and E.
Washington Street, the proposal may constitute a nuisance and /or be
detrimental to the public welfare of the community.
2. The proposed amendment to the use permit and conditions �of approval
may not necessarily be considered a matter of public convenience or
public necessity due to the availability of other driveway accesses that
can adequately serve the site.
Note: Disposition of this request confirms expiration of original use
permit grant upon which no progress has been made by applicant.
II. SHELL OIL, 900 PETALUMA BLVD. NORTH, AP NO. 150 - 011 -05, (File
No. 1.624) .
1. Continued consideration. of EIQ.
2. Continued consideration of a conditional use permit to .allow a
convenience market and addition to an existing service station.
The public hearing was continued.
SPEAKERS'-:
Greg Freitas 620 Washington - Applicant representative - (Urban Planning
Associates) - introduced Herb Weiner - operator of Shell; concerns with
conditions 3,4,,,
Herb Weiner 315 4th Street, Sausalito - Operator of gas station described
operation of proposed project; answered' questions; wants to have card
readers at pumps.
Roy Frym 15.05 Golf Course Drive, Rohnert Park - Concerns with operation
of proposed car wash (is a car wash owner) should not be allowed to have
chain conveyor system and blower.
Jim Watt - Lucky ,Stores - San Leandro - felt, there will be an overflow of
cars onto Lucky property; objected to proposed cross - access.
Herb Weiner - Answers questions concerning .conveyor system.; very few
breakdowns; no one will want or need to park in Lucky Center°.
Mike Ahbed - owner - Kwk iStop - Cherry Center- - might have employees
parking in his parking lot enough convenience stores in area already.
Greg Freitas - Condition could -- be added requiring use permit review if
parking problems develop.
The public hearing was closed.
°. Commission Discussion
Commissioner Read Questions as to whether development as proposed is
best use of site.
Commissioner Parkerson Driveway and parking issues seem to call for
redesign of the site. Need to be carefully considered. Important factor is

that development of this site will start from scratch since existing
structures proposed to be demolished.
Commissioner Tarr Request for clarific of conveyor vs roll -over type
of carwash. Feels that the site is too small to accommodate all uses
proposed.
Commissioner Libarle Is the possibility of an alternative combination of
uses (i.e. service station and market with no carwash,, etc.) a better use
of site given proposed intensity of use?
Commissioner Parkerson Carwash has been main difficulty of proposal in
terms of site and site plan.
A motion was made. by Commissioner Parkerson and seconded by
Commissioner Tarr to deny the project as proposed, based on the following
finding:

Finding:

1. Thee, intensity of the proposed uses on the site ( carwash, service
station and convenience, market) in relation to the size of the site and
the {complexity of traffic patterns, render the project inappropriate for
the Gsite .

M. DEVELOPMENT AGREEMENT FOR CERTAIN PROPERTIES IN THE
CORONA /ELY SPECIFIC PLAN AREA.
1. Consideration of Development Agreements :for AP No.'s 137- 060 -01,
19; 137 - 070 -06, 07,, 08, 10, 11; 136 - 120 -09, 10, 15, 18, 21, 22
and 23.
The public hearing was continued.
SPEAKERS:
Van Logan - Spokesman for developer group; explains Assessment District
formation.
Matt Hudson - Attorney for- developers - thanks staff - would like two
additions proposed, answers questions.
The public hearing was closed.
A motion, was made by Commissioner Tarr and seconded by Commissioner
Read to, recommend Council approval of the development agreements as
amended °based on the one finding and subject to the one amended condition
listed in the staff report dated November 14, 1989.

Finding
The provision's of this Development Agreement are consistent: with the
General Plan, .Corona /Ely Specific Plan, and other applicable plans, 'policies,
ordinances,, and regulations of the City of Petaluma.
Condition:
The development agreement shall be amended to state " Developer shall,
develop funding mechanisms to ensure acquisition of sites and_ .construction
of additional school facilities to meet the needs of the proposal to the
satisfaction of school districts and the City of Petaluma prior to Final Map
approval.
Staff was also directed by the Commission to review the two amendments
proposed by Mr. Hudson prier to City Council action on this matter.

IV. EXXON., 5153 OLD REDWOOD HIGHWAY, AP NO. 47- 211 -16, (File No.
2.389) .
1. Consideration of variance to . permit retention of illegal
non - conforming free- standing sign .
The public hearing was opened and this item was continued to the Planning
Commission :meeting of November 28th, 1989.

V. OAK HILL /BREWS'T'E'R HISTORIC ZONE.
1. Direction to staff to commence Historic Zoning process.

A motion was made by Commissioner - Parkerson and seconded by
Commissioner Read to direct staff 'to initiate the zoning process for the
creation of the Oak Hill Brewster Historic Zone.
