FINAL MINUTES
1. CALL TO ORDER
Chair Benedetti-Petnic opened the meeting at 7:00 pm
2. ROLL CALL
PRESENT:Gina Benedetti-Petnic, Bill Wolpert, Heidi Bauer, and Scott Alonso.
ABSENT: Diana Gomez, Richard Marzo, and Council Member Healy.
3. PUBLIC COMMENT

The Commission will hear public comments only on matters over which it has jurisdiction. There
will be no Committee/Commission discussion or action. The Chair will allot no more than three
minutes to any individual. If more than three persons wish to speak, their time will be allotted
so that the total amount of time allocated to this agenda item will be 15 minutes.
Chair Benedetti-Petnic opened the General Public Comment period. Seeing no speakers,
General Public Comment was closed.
4. COMMISSION COMMENT
A. Council Liaison — Mike Healy
Chair Benedetti-Petnic stated that there was no report since Council member Healy was absent.
B. Pedestrian and Bicycle Committee — Bill Wolpert

Commissioner Wolpert stated that there was no report since the committee has not met.
C. Tree Advisory Committee — Gina Benedetti-Petnic
Chair Benedetti-Petnic stated that there was no report since the Tree Advisory Committee has
not met.
D. Other Committee Comment
Chair Benedetti-Petnic requested an update on the Altura Apartments tree situation.
Heather Hines, Planning Manager, gave an update on the Altura Apartments project which is
currently under construction and gave some background on the project approval process,
including the landscape plan and the preservation of trees. She also reported that a number of
oak trees were recently removed without approval and stated that staff was working with the
impacted neighbors in addition to working with staff and the property owner to develop a
mitigation correction plan with alternative screening, and incorporating potential fines. It is still
in process, but staff is working diligently for the best remedy.

5. STAFF COMMENT
A. Planning Manager's Report
Ms. Hines, Planning Manager, reported that staff would like to look ahead to determine if there
are quorums for future meetings and requested that the Commissioners respond to staff
request for availability.

A. SID Commons Apartment Project. Draft Environmental Impact Report for an amendment to
the Oak Creek Planned Unit Development, a Zoning Map Amendment, and a Vesting Tentative
Parcel Map to accommodate a 278 -unit apartment complex on approximately 15.45 net

The public comment period was opened.
Harold Matzen, Bernice Court resident, was concerned about traffic impacts on Bernice
associated with the proposed EVA and the surrounding areas. He was also concerned about a
traffic study performed during spring break and believes that the area cannot handle the
additional traffic.
Taryn Obaid, Greylawn Avenue resident, noted that Greylawn Avenue is more of a cul de sac
than a street and believes it is smaller than portrayed in the environmental report. It is a nice
neighborhood where children and neighbors are active. She is concerned about the current
traffic issues of speeding. She believes that the data of the EIR report was collected before the
housing crunch and there has been an increased number of people per household with legal

and illegal second units. She stated that the livable street standards don't seem to be working
now and suggested that the numbers be reviewed again.
Kallie Kull, Jess Avenue resident, and a planner with Marin County Flood Control District. She
was concerned about the density of housing at the location of the proposed project. She stated
that this proposed project is in a living flood plain and noted that active floodplains act like
sponges and removing them creates impermeable surfaces and sends the water directly into
the river downstream into downtown causing flooding and increased sediment load. She feels
that the EIR does not sufficiently analyze the hydraulics and flooding.(time ceded by Laurie Ann
Barber).

Motion: Approve the recommendation to the City Council that the Draft Environmental
Impact Report for the SID Commons Apartment Project adequately discloses
potential impacts and identifies mitigation measures and direct staff to move
forward with preparation of the Final EIR and that the Planning Commission
reviews the Final EIR prior to Council review made by Scott Alonso, seconded by
Gina Benedetti-Petnic.
Vote: Motion carried 3 - 1.
Yes: Gina Benedetti-Petnic, Bill Wolpert, and Scott Alonso.
No: Heidi Bauer.
Absent: Diana Gomez, Richard Marzo, and Council Member Healy.
