Popp that the Commission recommend to Council approval of tentative
map based on the following findings and conditions:
FINDINGS
1. The proposed tentative map subject to the following- conditions,.
will conform to, the• intent of the zoning ordinance: and policies of
the General: Plan /'EDP:
2. The proposed map,. subject to the following conditions, will 'not
constitute a nuisance or be detrimental to the public welfare of
the community.
3. The proposed map, subject to the following conditions complies
with the requirements of Municipal Code Chapter 20.16 and the
Subdivision Map Act.
4. The proposed map provides adequate solar exposure for future
active and/or passive solar heating and cooling due to the large
parcel, sizes within the constraints of respecting the natural
topography of the land and desired circulation pattern.

3.;.{ A ten foot public utility easement is .required fronting on both
sides of the; public streets.. This would enable the utility
companies to. install and maintain their' joint trench facilities under
the sidewalk and also provide the area required, for the splice
boxes, subsurface transformers., street lights, etc. behind the
sidewalk area (Code Section 20.23.340) .
From the Police Department:
4.. A street light shall be located at the common driveways of Lot

fencing and/or walls. Landscaping and fencing must be installed

Planning Commission requests a positive statement from the Fire
Department regarding adequacy of turn around space..
Upon request of the Planning Commission, the Assistant City Engineer
clarified repairs required in Statement 1. of his letter dated
April 30, 1984 to specifically include those recommendations for slide
repair, drainage and .maintenance as contained in pages five, six and
seven respectively . in the Donald Herzog Geotechnical Investigation
dated April 7, 1984.

V. CONSIDERATION OF REVISION TO COMMISSION RULES OF ORDER

The following revisions will be made to the Rules of Order:
1. Add provision to; allow the Chairperson to limit the amount of time
an individual can speak at a public hearing, with consent of the-
Commission.
2. Amend Section 702 to permit. the Chair to alter the order 'indicated
on agenda,, with consent of Commission..
3. Add provision that. any Commissioner who was absent. from all. or
part of a public "hearing shall be allowed to participate in the
decision if .he- or she has reviewed all materials including listening
to, the tapes of missed meeting or hearings.
4. Add provision that any Commissioner abstaining: due to� a conflict
of interest must announce his or her abstention at the time the
item is first introduced and indicate nature of conflict:.
Motion introduced by Commissioner Head to table the discussion of
abstention until full Commission was present.
The motion died for lack of a second.
Motion introduced by Commissioner Read, seconded by Commissioner
Sobel to approve recommended revisions 1 through 4 and that the
following revision also be made to the Rules of Order.
5. Commissioners must vote unless a conflict of interest is stated.
Conflict of interest is defined as a financial interest

Condition #6 states "A drainage study shall be conducted to determine if
the Mt. View Road' drainage system will be overtaxed as a result of this
project Necessary improvements shall be reflected on the tentative map.
Study to be. completed: prior to tentative map submittal and be subject to
appr.oval1by the Community Development and Planning Director and Planning
Commission." The Engineering Division has reviewed the drainage study pre-
pared for Mr. Nizibian by Hudis� & Associates of Santa Rosa. We are in
agreement with the conclusions of the study that the existing downstream
storm drainage system from Halsey to the River is inadequate without addi-
tional development and that - there will be a. small, i.e., 11 approximately,
increase.: in runoff as a° result of the proposed Nizibian Development.

Recent discussion with the SCWA indicates that the first ,reach of their pro
. � .;
posed Zone 2 - A. project. along Mt. View Ave. will be budgeted during tine
coming year with. construction slated for the summer of 1984... This first
phase of, storm drainage improvement will greatly relieve the flooding along
Petaluma; Blvd. at Mt. View. With this in minds I would suggest that it
would be;� inappropriate• to require Nizibi.an Development to make the maior
off site improvements as a condition of his development with its
minor ririoff increase. However, I would recommend that the final map and
improvement plans for Nizibian, Subdivision not be- approved until the SCWA
has budgeted funds available for the first phase of tPe Mt. View storm:
drainage;' project.
