Commissioner Head to recommend approval of the variance to
accessory dwellings to exceed, the 640 ,square foot - limit by
square feet based on the following findings:

There are peculiar and unusual conditions inherent in the
property in question sufficient to -cause hardship in that- the, rest
of Alma Court contains; a substantial number of duplexes and
many of such. duplexes: exceed 8.95 square feet- per unit: in,. size..

That a hardship peculiar to the property and. not created by any
act of the owner exists in that it is the: sole property on the
street zoned R -1 6500, a zoning which restricts the size of the
second unit by requiring a: much longer lot area per unit than the
remainder of the block (.where- a second -. unit is requested) and
restricts the size of the second unit in a manner which is much
more restrictive than the remainder of the block.
Section 26- 303.3
That such variance is necessary for the preservation and
enjoyment of substantial property rights, possessed by other
properties in the vicinity in that these properties have over
641 square feet in size and can cover up to forty percent of their
lots; and that a variance., if: granted, would not constitute a
special privilege of the recipient not enjoyed by his neighbors in
that this . proposal would cover no more than thirty percent of the
two lots.

Department of Community Development prior to installation and
shall conform to the Zoning Ordinance performance standards
for glare as specified in Sections 22- 304.1 and 22- 304..2.
13. All on -site: cranes or booms shall.. be stored in a horizontal
position.
