Page 9, ;Item VII, add "The public-hearing was closed." Page 9, 'Item VIII, motion seconded by Commissioner Sobel. Page 9, ;Item IX, motion seconded by Commissioner Sobel. DIRECTOR'S REPORT Director' mentioned distribution of status report regarding accessory dwelling units. COMMISSIONERS' REPORT Commissioner Head asked to be replaced as Commission representative to SPARC. ­ Commissioner Libarle will represent the Commission at SPARC meeting - beginning August 9, 1984. -1- 1; b PUBLIC HEARINGS I. UPHAM STREET AREA REZONING, REZONE FROM R -C TO R -1 5000 (3.318A) 1. Evaluation of EIQ for the following 2. Consideration of Rezoning (Council Referral) . Motion introduced by Commissioner Head to direct the staff to post a negative declaration. The motion died for lack of a second. Motion introduced by Commissioner Tencer, seconded by Commissioner Read to recommend to the City Council that the proposed rezoning for the entire area be denied with the finding that there has been a change in property owner feelings regarding the area, and, the proposed zoning regulations and pattern is inappropriate for the area. AYES: 4 NOES: 1 (Head) ABSTAIN: 1 (Libarle) ABSENT: 1 (Perry) II. VICTORIAN MANOR, ROBERT AND LOURDES CUEVA, 2 -21 KEOKUK, USE PERMIT TO EXPAND HOME FOR THE AGED, A.P. NO. 006 - 271 -12 (1.418) Continuation of Public Hearing of May 22, 1984. 1. Consideration of Use Permit The public hearing was continued: Commissioner Perry arrived at 8:10 p.m. Speakers: None The public hearing was closed. Motion introduced by Commissioner Head,, seconded by Commissioner Sobel that the Commission approve the use permit for a home for the aged containing no more than twenty -three clients, members of the operator's immediate family, and two employees subject to the following findings and conditions: Findings 1. The proposed structures and use., subject to the following conditions, will conform to the intent of the zoning ordinance and policies of the General Plan /EDP. 2. The proposed structures and uses, subject to the following conditions., will not constitute a nuisance or be detrimental to the public welfare of the community. [1 -2- Conditions 1. The proposed wheelchair ramp not be allowed in the side yard but rather install. smaller ramps serving individual rooms along the back of the house and the front northernmost bedroom; said ramps to be subject to staff approval. 2. The exterior stairway to the second floor shall be relocated to the back yard. It shall not extend into any side yard setback nor interfere with the ability to park an automobile in the rear yard i area. 3.. The building additions and modifications shall match the existing structure in terms of colors, materials, trim, roof pitch, gutters, 0 window design, and other such architectural features. 4. Any further expansion of clients, employees, or physical facilities shall require a new use permit. 5. No clients or patients shall store or park an automobile at Victorian Manor or in the immediate environs while residing at 221 Keokuk. 6. The Traffic Committee shall review alternate on street parking situations for allowing more parking for visitors to Victorian Manor adjacent to the site. AYES: 6 NOES: 0 ABSTAIN: 1 (Libarle) III. PETALUMA CHRISTIAN CHURCH, 1160 SCHUMAN, EIQ, USE PERMIT FOR NEW CHURCH BUILDING AND ADDITIONAL PARKING, A.P. NO. 006; 4ll -10 (1.423, 11.808) Continuation of Public Hearing of July 10, 1984. 1. Evaluation of EIQ for the following: 2. Consideration of Use Permit. The public hearing was opened. Speakers: Richard Lieb, 1 Bodega Avenue Stan Moreda, 716 Elm Drive Al Gerhardt., 712 Elm Drive The public hearing was closed. Motion introduced by Commissioner Head, seconded by Commissioner Perry that the Planning Commission authorize issuance of a negative G ' s -3- 11 `11 declaration for the Petaluma Christian Church to construct a 7,300± square foot church building and associated site improvements subject to the following findings. 1. The project as conditionally approved does not have the potential to substantially degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self- sustaining levels, threaten or eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal, :or eliminate important examples of the major periods of California history or prehistory. 2. The project as conditionally approved does not have the potential to achieve short -term environmental goals to the disadvantage of long -term environmental goals. 3. The project as conditionally approved does not have possible environmental effects which are individually limited but cumulatively considerable. 4. The environmental effects of this project as conditionally approved will not cause substantial adverse effects on human beings, either directly or indirectly. AYES: 6 NOES: 0 ABSTAIN 1 (Libarle) Motion introduced by Commmissioner Head, seconded by Commissioner Reed that the Planning Commission approve the revised use permit for the Petaluma Christian Church to construct a 7,300+ square foot Church building and associated site improvements subject to the following findings and conditions: Findings 1. The proposed structure and use, subject to the following conditions,, will conform to the intent of the zoning ordinance and policies of the General Plan /EbP. 2. The proposed structure and uses, subject to the following conditions, will not constitute a nuisance or be detrimental to the public welfare of the community. Conditions 1. Dense solid shrubbery and coniferous tree screening shall be established along the east property boundary to screen the proposed new parking area. 2. All project grading, onsite drainage and erosion control shall be subject to approval of the City staff. -4- 101 3. All west facing windows in the new structure shall be unopenable stained glass or frosted skylights. ® 4.. All parking. and driving surfaces shall be paved. 5. All existing and new parking lot landscape areas shall be served with an underground 'irrigation system. 6. A six foot high solid board fence shall be built along the rear of lots fronting Elm Drive (700 -720 Elm Drive) where six foot high solid fencing does not now exist if such fencing meets neighborhood approval. 00 7.' DIAMONDHEAD, 718 PETALUMA BOULEVARD SOUTH, PUD DEVELOPMENT PLAN AMENDMENT TO ELIMINATE AGE RESTRICTIONS ON OCCUPANCY, A.P. NOS. 008 - 550 -01 through 53 (3.249B) Continuation of Public Hearing of July 10, 1984. 1. 1 Consideration of PUD Unit Development Plan Amendment. The public hearing was opened. Speakers: G.� 'Graham, Attorney representing applicant. Jeff Lee, representing applicant. Milt Allen, Broker, 720 Petaluma Boulevard South The public hearing was closed. During the Commission discussion, Commission consensus was to add a new condition and revise existing Condition No. 1 to read as follows. Revised Condition 1: The applicants shall provide an additional twenty -seven off street parking spaces designed and constructed to meet the requirements of the Zoning Ordinance and SPARC parking standards subject to approval of SPARC and to be shown on the final development plan prior to Council approval. Where any such spaces may be proposed to be ,created on Zands outside the boundaries of the PUD zone, the PUD -5- 102 zone shaZZ first be amended as required by Zaw (i.e., a rezoning request must be processed) . New Condition 1 . (and renumber all following conditions) All zoning conditions shaZZ be met prior to occupancy by any occupants between 55 years of age and 62 years of age. Motion introduced by Commissioner Head, seconded by Commissioner Tencer that the Planning Commission recommend to the City Council that the revision to the PUD development plan for the Diamondhead r Condominium project to revise occupancy age restrictions be denied based on the following findings:, The developer has not proposed an updated PUD plan showing desired additional parking; there has been no valid justification offered by the developer for reducing the parking requirement or for reducing the age requirement, and a good faith effort has not been made by the developer to meet or accept any of the conditions outlined in the staff report or to offer reasonable alternatives thereto. AYES: 5 NOES: 1 (Hilligoss) ABSTAIN: 1 (Libarle) V. BREWSTER EVANS,, 1298 MC KENZIE AVENUE, USE PERMIT FOR AN ACCESSORY DWELLING, A.P. NO. 007 - 203 -01 (1.428) I. Consideration of Use Permit. The public hearing was opened. Speakers: Marjorie Elvin, 1324 McKenzie Avenue. Mary Straziko, 12:94 McKenzie Avenue Joseph Stranko, 1294 McKenzie Avenue Brewster Evans, Hawaii The public hearing was closed. Motion introduced by Commissioner Head, seconded by Commissioner Tencerthat the Commission approve the use permit for accessory dwelling subject to the following conditions: 1. The project shall be subject to site plan and architectural review according to Section 26 -401 of the Zoning Ordinance. 2. The accessory dwelling shall be built on a slab foundation. 103 3. The accessory dwelling shall be limited to one bedroom and reconfigured to accommodate relocated parking space so that only one driveway cut is used and to shift the parking away from the adjacent property line. 4. The proposed open parking pad shall be reduced to one space for the one bedroom /accessory dwelling per Condition No 3. above and said space shall be relocated closer to existing parking to avoid two driveway cuts. 5. The parking area shall be nine feet wide and twenty feet deep; it shall be located a minimum 'of BIWA twenty feet from the street c side property line and at least five feet from the rear property I line. C) 6. Parking should be situated in such a way `that the two mature trees in the rear yard can remain undisturbed. 7.. All planting shaZZ be maintained in good growing condition. Such maintenance shall include, where appropriate, pruning, moving, weeding, cleaning of debris and trash, fer `lining and regular watering. Whenever necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements. Required irrigation systems shaZZ be fully maintained in sound operating condition with heads periodically cleaned and replaced when missing to insure continued regular watering of landscape areas, and health and vitality of landscape materials. All biti ding walks and grounds shall be maintained in excelZent condition ensuring a high level of maintenance of roofs, walls, downspouts and garage doors, patio decks, yards and landscaping. Driveways shall be kept clean and yards free of rubbish, weeds and stored materials, vehicles and parts thereof. Existing structures and fencing shall be repaired /repainted, etc., to approval of SPARC and permanently maintained in good repair. Consideration of request for nomination as local historic landmark. The matter was not discussed.
