Commissioners.
Staff has distributed copies of material regarding
regulations governing adult entertainment outlets;
property maintenance; and, bed and breakfast inns.

1. Approval of Tentative Map.

Motion introduced by Comm. Head, seconded by Comm. Sobel that the City
Council adopt a Negative Declaration based on the following findings:
Findings
1. Mitigating measures for potential future archaeological finds and means
for the preservation of the on -site windmill are required as a condition
of the Tentative Map.
2. No earthquake faults are believed to be active on the site.
3. Additional air pollution generated by the project is not expected to
exceed permissible standards.
4. Proposed development is not expected to have a significant impact on
the adjacent marsh wildlife habitat. The proposed row of evergreen
trees which would separate the site from the marsh will provide a
buffer. Design approval of the Adobe Creek improvements by the Fish
and Game Department should insure proper consideration for the fish
and wildlife.
5. Additional demand for public services will be compensated for by
anticipated property tax revenues and required impact fees.
6. Projected traffic generation is not expected to impact neighboring
streets beyond' their planned capacity.
7. Future improvements in the flood plain will be required to conform with
all pertinent flood safety ;regulations.

Motion introduced by Comm. Head, seconded by -Comm. Tencer to
recommend to the City Council that the tentative map for Lakeville
Business Park be approved subject to the following conditions:
Conditions
1. The applicant shall comply with all requirements of the City Engineer:
A. Public improvements along Lakeville Highway frontage should
include dedication for a 100 foot right -of -way and improvements to
provide four lanes and left turn lanes; (96' shown) plus
deceleration lanes.
2. Street improvement plans shall contain a cautionary note near the
Pacific Telephone cable, instructing the contractor to call the U.S.A.

against Community Facilities Development Fees as set out in Petaluma
Municipal Code Section 17.14.060,
14. The developer shall apply for an amendment to the existing PCD
development plan in order to more clearly detail development standards
and land uses for the project including review and inclusion of items
as, identified in the CC &R's.
15. Prior to approval of the Final Map, the owners shall work with staff to
develop overall design criteria for Lakeville Business Park. Such
criteria shall include but not be limited to landscaping, architectural
style, exterior building materials, screening and fencing, and parking
and loading areas, and shall meet minimum City Standards where

III. USE PERMIT FOR FITNESS CENTER, 170 PETALUMA BOULEVARD
NORTH (BEHIND GRAZIANO'S RESTAURANT) , JAIN STEWART

1. . Consideration of Use Permit.

forty -eight hours prior to starting excavation work.
3. Lakeville Highway street improvement plans shall be subject to review
and approval by CALTRANS prior to Final Map approval.
4. During the course of development, if archaeological materials are
found, all work in the vicinity of the find(s) shall be stopped and a
qualified archaeologist contacted to evaluate the materials and make
recommendations for mitigation, as deemed necessary. The existing
on -site windmill_ shall be restored and permanently preserved by the
developer, or restored and offered to the City for dedication as
proposed by the applicant.
5. Grading and drainage design shall conform with the Sonoma County
Water Agency and the State Department of Fish and Game
requirements.
6. The conditions, covenants and restrictions drafted for the park shall
be subject to approval by the Community Development Department and
City Attorney prior to Final Map approval.
7. Future building construction in the project shall take place in strict
conformance 'with all applicable earthquake resistant construction .
standards.
8. The front yard sidewalk system shall be designed in accordance with
the specifications of the City Engineer and installed prior to
acceptance of the project street system by the City.
9. The applicant shall provide a program of perpetual maintenance for the
front yard landscaping and rear yard screening. The program shall
be enforceable by a property owner's association and the City of
Petaluma, and subject to content approval by the City Attorney prior
to Final Map approval.
10. Adobe Creek shall be improved to flood control standards as a "natural
waterway" subject to approval by the State Fish and Game Department,
the Community Development Department,, and the Sonoma County Water
Agency. In addition, the creek landscaping shall be maintained in a
manner deemed acceptable by the City Council.
E. The conditions., covenants and restrictions drafted for the park shall
indicate the existence of the neighboring rendering plant.
12. Applicant is - advised that the development may be subject to future
charges for a Public. Improvement Benefit District pursuant to
Chapter 13.34 of the Petaluma Municipal Code, in order to provide
needed future improvements to Lakeville Highway.

Motion introduced by Comm. Tencer, seconded by Comm. Libarle
recommending approval of the proposed use permit, subject to the
following findings and conditions:
Findings
1
1. The proposed structures and use, subject to the following conditions,
will conform to the intent of the zoning ordinance and policies of the
General Plan /EDP.
2. The proposed structures and uses, subject to the following conditions,
will not constitute a nuisance or be detrimental to the public welfare of
the community.
3. The necessary findings required by State law for a denial could not be
made due to the lack of any substantial evidence- in the record of
public health or safety problems which could not be otherwise
mitigated.
Conditions
1. That the proposed improvement plan shall be modified prior to SPARC
review in the following manner:
a. State that all garage areas measure . a minimum of 17 X 23.5 feet
in area.
b. Driveway entrance widths shall be minimized and combined, where
possible to minimize driveway cuts through the sidewalk.
C. Provide twenty -five foot rear yard (abutting Lot 15) on Lot 10.
d. Provide twenty -five foot rear yard with no more than three foot
encroachment by balconies on Lot 11.
2. The proposed project, site plan, building elevations, and landscaping
shall be subject to :SPARC approval in accordance with Section 26 -400
of the Zoning Ordinance. All conditions of design approval shall
become conditions of the use permit.
3. A landscape plan shall be submitted for SPARC approval which depicts
fence locations ground cover in all front yard and street side yard -
areas, and assurance that all tall shrubs and trees shall be located in
such a manner so as to preserve views to the extent possible for
buildings located uphill from the project site.
4. All planting shall be maintained in good growing conditions. Such
maintenance shall include, where appropriate; pruning,, mowing,
weeding, cleaning of debris and trash, fertilizing and regular
watering. Whenever necessary, planting shall be replaced with other
plant materials to insure continued compliance with applicable
landscaping requirements. Required irrigation systems shall be fully
maintained in sound operating condition with heads periodically cleaned
and replaced when missing to insure continued regular watering of
landscape areas, and health and vitality of landscape materials. .All
building walks and grounds shall be maintained in excellent condition
with private deed restrictions to be recorded ensuring a high level of
maintenance of roofs, walls, downspouts and garage doors, patio
decks, yards and landscaping. The CC &R's shall also ensure clean
driveways and yards free of rubbish, weeds and stored materials,
vehicles and, parts thereof. The private CC &R's shall contain a
provision which permits backup City enforcement of their maintenance
provisions.
