Chairperson Hilligoss welcomed Commissioner Serpilio. APPROVAL OF MINUTES Minutes from the meetings of September 11 and September 25, 1984 were approved as submitted. CORRESPONDENCE Warren Salmons referenced an unsigned letter received in the Planning Department regarding relocation of the police facilities. DIRECTOR''S REPORT Warren. Salmons' ,advised that two projects have been submitted for- Technical Rating. The earliest scheduled date is November 6 aL 7:30 PM (scheduled .for'.t-he Law Library, City 'Hall). The architect for the downtown, parking ` facility will make a presentation to SPARC on October 18 (special meeting) at 3:00 PM. The Commission is welcome to attend. Mr. Salmons welcomed Commissioner Serpilio on behalf of Planning staff. Mr. Salmons advised that a "study session has been scheduled for October 30 to discuss among other _items; adult entertainment ordinance and bed and breakfast ordinance. He advised that a representative from the City Attorney's office would be present to :make a presentation and to answer questions, COMMISSIONERS' REPORT No report. Continuation of action of September 25 on: 1. Consideration of E.I.Q. 2. Consideration of Rezoning to PUD. A motion was made by Commissioner Libarle and seconded by Commissioner Sobel to recommend to the City Council denial of a rezoning to PUD from Light Industrial based on the following findings and the inability of the Commission to make the mandatory PUD findings. oo 1. The housing development project would have a specific, adverse impact q, upon the public health or safety unless the project is disapproved or approved upon the condition that the project be developed at a lower U density. 2. There is no feasible method to satisfactorily mitigate or avoid the adverse impact identified pursuant to subdivision (1) , other than the disapproval of the housing development project or the approval of the project upon the condition that it be developed at a lower density. Examples of adverse impacts upon the public health or safety which cannot be adequately mitigated include . the additional number of automobiles brought to the neighborhood by Valley Mist residents and the resultant noise and congestion; exposure of - dwelling units, particularly those on the third story, to inhospitable surrounding land uses and noise due to poor interfacing of residential and industrial land uses; reduction in neighborhood privacy due to the proposed building heights; or removal of land traditionally used for fairground parking. Commissioner Perry arrived - 8:10 PM at the outset of discussion on this item. 1. Continuation of action on adequacy of Environmental Impact Report for Lakeville Homes and Golf Course (Continuation of Meeting of 10125.) A motion was made by Commissioner Read and seconded by Commissioner Libarle to recommend to the City Council certification of the adequacy of the Environmental Impact Report for Lakeville Homes and Golf Course as noted and addressed. 2 146 1. Addition of information regarding cost of services to golf course and pros and cons of annexation of same. VOTE: AYES: 4 NOES: 0 ABSTAIN:. 2 (Perry, Serpilio)" ABSENT: 1 (Head) III. A motion was made by Commissioner Sobel and. seconded by Commissioner Read to recommend to the City Council approval of a negative declaration based on the findings in the staff report as ;follows: 1. The proposed use is consistent with the applicable provision of the General Plan and Zoning Ordinance. 2. Any potentially significant environmental effects will be mitigated by 'the conditions of approval. VOTE: AYES: , 6 NOES: 0 ABSENT: 1 (Head) A motion was made by Commissioner Sobel and seconded by Commissioner Read to: recommend to the City Council approval of a use permit for a wholesale lumber storage yard subject to the conditions in the staff report as follows: 1. All-lumber storage areas must be filled to 12" above the level of the base flood elevation specified on the Flood Insurance Rate Map. 2. Fill placement shall be completed prior to building or operation of the facility. 3. Frontage improvements for the property shall be in acc_ ordance with the requirements of the City Engineer. 4. The proposed lot line adjustment between the subject parcel and the,' neighboring parcel along Payran which is the proposed location of Bay Cities Concrete Pumping,., (AP No. 5-0 must be completed. before SPARC approval and issuance of building permits. 5. The perimeter of the parcel shall be heavily landscaped to provide for screening to the adjoining parcels to the approval of SPARC and staff. Minimum 15 gallon Redwood trees shall be planted at. minimum ten foot on center along the rear and' northwest property lines inside the screen. fence. The trees must be protected by either a continuous wood curb five feet inside the fence line, or by individual wood curbed enclosures, designed subject to staff approval.' These trees must be irrigated for at least the first 2 years, to ensure establishment.,. Irrigation system to staff approval. Landscape screening shall be designed to screen at least to the height to which the lumber will!'be stacked. 6. Landscaping in street setback areas along Payran and Lindberg shall be bermed, to a height of at least three feet and include trees and "shrubs on the berms and approved. ground cover. Street setback landscaping ' shall have an automatic irrigation_ system, design subject to approval of SPARC and Staff. 4 7. Unpaved portion of - storage= area, shall, be covered with a durable, dustless surface (:such, as crushed rock) graded and drained to satisfaction of the City Engineer.. 8. All cyclone fences ' and gates s "ha "ll be fitted with redwood slats or other screening material approved by SPARC. Overall fence height shall be approved by SPARC. 9. The proposed project, site plan„ building elevations, and landscaping shall: be, subject to SPARC approval in accordance with Section 26 -40'0 of` the Zoning Ordinance... All conditions' of design approval shall become conditions of the use permit. 10. A trash enclosure on the site shall be designed and constructed according to City trash enclosure standards and subject to staff approval. 11. There shall be no truck parking on the street. 12. Unless servicing a property located on these streets,, all trucks travelling to or from the project site shall be prohibited from Payran, Street northerly of the" project site or Lindberg Lane easterly of the project site. 13. Per the applicants description this facility shall be used for wholesale transactions only. 14. All planting shall be maintained in good growing condition. Such maintenance sha'll'' include, where appropriate,, pruning, mowing, weeding;, cleaning" of debris and trash, fertilizing and regular watering. Whenever :necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements. Required irrigation, systems shall, be fully maintained in sound operating condition with,, heads periodically cleaned and replaced when missing; to insure continued regular watering of landscape areas, and 'health and Vitality of landscape materials. 15. Location and design of exterior" lighting fixtures shall be shown on plans and be subject to approval of the Community Development and Planning Department..,, Such lighting; shall, be of a low level type: and conform to the City's performance standards. . FIRE DEPARTMENT CONDITIONS: A. Fire Department access shall be provided to the yard from Lindberg Lane at, the. south corner of the property. This access shall be by a minimum 12 foot w'id'e driveway and gate. Driveway shall be capable of supporting 16 tons in all weather and, shall have the necessary curb cut to accommodate fire "app'aratus . B.. All areas, of yard shall be within .1.50 feet of an all- weather 2 "0 foot wide access roadway;.. C. Yard shall be grided by 15 .foot wide driveways into areas 50 feet 5. LEK by 150 feet. D. Storage building shall. comply with the applicable sections of Article 81 of the Uniform Building Code. Tndustrial Subdivision. Public Hearing was opened. There were no speakers. Public Hearing was closed. A motion, was made by Commissioner Read and seconded by Commissioner Serpilio to recommend to the City Council approval of Tentative Map subject to the recommended conditions as revised. Staff will submit written policy to the City Council regarding architectural design on properties backing on to US 1.01 in support of condition number 14. Conditions: 1. Any proposal for grading or excavation in the Floodway related to the development of any lot in Rancho Arroyo Unit I shall be accompanied by : ,certified engineering calculations prior to approval of Final Map that, said excavation and /or grading will not have a detrimental effect on hydraulic capacity either upstream or downstream from the site. All ; ,grading and excavation in the Floodway shall be subject to the approval of City staff, the Sonoma County Water Agency and the State Department of Fish and Game. 2. No fill shall be permitted in the floodway. C. 150 3. A buffer zone of not seventy -five feet (75') extending the entire established subject to City of Petaluma prior parking areas shall not less than fifty (50') feet and not more than from the top of the bank of Petaluma Creek and length of the subject property shall be the approval of City staff and dedicated to the to approval of the final map. The developer shall dedicate an access easement from .Industrial Drive by which the City can reach the maintenance road in the creekside buffer subject to City staff approval and prior to approval of the Final Map. 7. All future development. shall be subject to approval of the Sonoma County Water Agency to insure setback and floodplain fill requirements. 8. That portion of Rancho Arroyo Unit I presently outside the City Limits - approximately ..25 acres shown as part of lot 8 - shall either be annexed or a lot line adjustment, shall be completed to remove that portion of property from the project site and append it to the neighboring lot AP# 48- 080 =26 prior to development of lot number 8. 9. The pending minor lot line adjustment between Redwood Oil Company and Rancho Arroyo Racquet Club shall be completed prior to final map approval. 10. The developer shall pay Flood Mitigation fees per City ordinance for increased runoff from those areas of development not covered by the storm water detention pond system. 11. Combined access (i.e., one driveway serving two or more properties) shall be used wherever possible. 12. Landscaping in the Floodway zone shall be subject to the approval of the Community Development and Planning Department. 1.3. A master landscape plan consistentt with the landscape guidelines established by the .PCD Zone shall be developed for street frontage areas and for undeveloped creek frontage areas, including dedicated areas, subject to SPARC approval. 7 151 1.4. . WILLOW CREEK, SONOMA FINANCIAL CORP., OLD REDWOOD HIGHWAY AND HIGHWAY 101, (6.477A) . CD Consideration of Tentative Map for a 2.0 -lot Industrial/ Business 00 Subdivision. U Public hearing was opened. There were no speakers. Public hearing was closed. A motion made by Commissioner. Perry and seconded by Commissioner Libarle that the Planning Commission recommend 'to the City Council approval of Tentative Map subject to the findings and conditions listed in the staff report and using language from; the Village 'ivi'eadows Townhome Tentative Map in place of wording for Condition No. 10. Findings 1. The proposed subdivision together with provisions for its design and' improvement, is consistent with the General Plan. 2. The proposed subdivision is compatible with the objectives, policies, general land uses, and programs specified in said General Plan. 3. The site is physically suitable for the type of development proposed. 4. The site is physically suitable for the proposed density of development. 5. The design of the Subdivision and the proposed improvements therefor will not' cause substantial environmental damage, and no substantial or avoidable injury will occur to fish or wildlife or their habitat. 6. The design of: the Subdivision and the type of improvements will not cause serious public health problems. 7. The; design of the Subdivision and the type of improvements proposed will: not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 152 8.. The discharge of waste from the proposed subdivision into the existing community sewer system will "not: result in violation of the existing requirements prescribed by the Regional Water Quality Control Board. Conditions ( "* "denotes conditions which were imposed on original map, 1981) . 1. The tentative map shall be revised to meet the concerns and conditions of the Fire Marshal, including turn radius at McDowell and Roger Road planter island to accommodate C -50 design vehicle. 2. A grading and drainage plan shall be submitted to and approved by the City Engineer.. Said plans shall include measures for bank stabilization along Willow Creek which shall also be :subject to approval by the Water Agency. *3. The Willow Creek improvements including a maintenance roadway, are' subject to approval by the Water Agency, city staff and Department. of Fish and Gam_ e, Said, improvements may include where :required, revegetation of the stream bank and a temporary chain link fence around the drip -dine of all .off -site trees on the north western bank of Willow Creek for protection during channelization. 4. A hydrology study shall be provided which shows to the ;satisfaction of City staff and ,Sonoma, County Water Agency that the proposed stream improvements will not cause adverse effects or exacerbate flooding condition's either up or downstream from the project site. 5. Design guidelines subject to. SPARC approval shall be prepared for this subdivision and recorded concurrently with the CCU &R's. 6. A master landscape plan shall be submitted to SPARC for review and approval prior to final map approvah: Said plan shall-contain provisions for the vegetation iof. Willow Creek as may be required by Condition 3, above:, evergreen tree screening along Willow Creek on all lots abutting the creek, and coordinated landscape treatment for all street front yard areas. Vegetation along Willow Creek shall be installed concurrently with other public improvements. 7. An improved maintenance easement. shall be provided along Willow Creek to the satisfaction of the Sonoma County Water Agency. 8. A ten foot wide public utility easement shall be, provided along all . street frontages. All utilities shall be placed underground. 9. No Certificate of Occupancy shall be given for a building unless all Public improvements in the phase containing said, building, are. first completed and dedicated to the city. All public improvements shall be completed no later than Unit II of development. 10. The conditions, covenants and. 'restrictions drafted for the park shall be subject to approval. by the Community Develo pment and Planning Department and. the City Attorney prior to Final Map . approval . Such 9 153 approved and recordable CC &R's shall be forwarded by the Director of Planning to the City Engineer for recordation prior to issuance of building permits. Changes to the proposed CC &R's which shall be incorporated therein prior to staff approval shall include provisions for City approval of development standards allowable uses, and any future changes thereto, .. and perpetual maintenance of. all landscaped :areas. * 11. The project shall be subject to the pavement of storm drainage impact fees as provided in Resolution No. 9565 N.C.S. , and as calculated in Chapter 17.30 of the Petaluma Municipal Code. * 12. All building pad elevations shall meet City Floodway and Floodplan Combining District regulations which requires finished floor levels to 00 be at least 12 inches above the base flood elevations. * 13 . During the course of development, if archaeological materials are C) found, all work in the vicinity of the find(s) shall be stopped and a qualified archaeologist contacted to evaluate the materials and make recommendations for mitigation as deemed necessary. * 14.In the event any grading or improvements extend within the 101 Freeway right -of -way, grading plans shall also be submitted to Cal`Trans for approval. * 15. The bus pull -out and shelter shall be subject to design approval by City Staff and SPARC. * 16. Street names shall be subject to approval by the Street Naming Committee. Street yard setback lines shall be shown on the tentative map for each parcel at a minimum of twenty -five (25) feet except for the McDowell Boulevard frontage. of Parcel 5. * 17. Turnarounds for fire trucks are, required at the ends of stubbed streets shown in Phase II to the approval of the City Engineer and the Fire Marshal. 18. A copy and sepia original of the revised tentative map satisfactorily depicting changes required herein shall be submitted to the Director of Community Development within 60 days after Council approval of the tentative map. 19. Consideration of rezoning, from PUD to R- 1,6500 of Hinman and Fair Streets PUD. * *Staff suggests that this item be continued to meeting of 11/13/84. Public hearing was opened. RAINBOW TAXICAB SERVICE - AUTOMOBILE FOR HIRE PERMIT REQUEST - Nick Navarra (9.192) Speakers: Jim Patterson ( Yellow Cab) Margie Flood Nick Navarra A motion was made by Commissioner Sobel and seconded by Commissioner Perry to recommend to the City Council approval of the permit request based on the findings and subject to the conditions of the staff report as amended,: FINDINGS 1. The proposed taxicab service will have no significant adverse effect on traffic in the City. 2. The pick -up and delivery location is appropriate for this use. The dispatch location is outside the jurisdiction of the City. CONDIT;,IONS 1. Thee applicant satisfies the remaining vehicle related requirements of th6i Police Department prior to issuance of the permit. 2. The dispatch, storage and maintenance must be at an appropriately zoned location whether in the City or the County. 3.
