I. PROPOSED REVISIONS TO ORIGINAL CONDITIONS OF APPROVAL,
ALAN ROSENBERG, 1302 HOLM ROAD (3.309) .
1.: Consideration of amendment to adopted PUD development plan for
an industrial condominium conversion.
The public hearing on this item was previously closed.
A motion was made by Commissioner Serpilio and seconded by Commissioner
Sobel, to recommend to the City Council that the proposed revisions be
approved with the discussed amendments to original conditions 2, 5 and 13;

the elimination of condition 4; and that the revisions be subject to SPAR;C.
approval.
1.1 A one -way circulation pattern to serve the west side units shall be
required, with the entrance on Scott Street (northernmost driveway).
and the 'exit on Holm Road. Directional arrows and signs shall be
provided to clarify the circulation pattern.
2. 90 Anglei parking stalls shall be required along the western property
line and all parking requirements of the City shall be met.
3: The landscaping along the Holm Street and Scott Street frontages of
the site shall be replaced with landscaped berms and appropriate
landscape materials, subject to SPARC approval.

5. A 53 -foot landscaped parking lot buffer shall be installed on the ' west
side of the site.
6. A 2 -foot - landscaped strip shall be placed along the north face (rear)
of the building.
7. A 3 -foot" landscape buffer shall be placed along the north property line
adjacent to neighboring building.
8. All planting shall be maintained in good growing condition. Such
maintenance shall include, where appropriate pruning, mowing, .
weeding, cleaning of debris and trash, fertilizing and regular
watering. Whenever necessary, planting shall be replaced with other
plant materials to insure continued compliance with applicable,
landscaping requirements. Required irrigation systems shall be :fully
maintained .in sound operating condition with heads periodically cleaned
and replaced. when missing to insure continued regular- watering of.
landscape areas, and health and vitality of landscape materials.
9. All new landscaped areas shall be irrigated by a City - approved
automatic sprinkler system.
10. The utility meters at the northeast corner of the building shall be
fully screened subject to SP-ARC approval.
11. The utility equipment at the southwest corner of the property shall be
fully screened subject to SPARC approval
12. A fully screened trash area shall be required as per City standards
and its location and design shall be subject to SPARC approval

shall be amended to add references regarding the following
development standards
a. Principal permitted, permitted accessory, and conditional uses

Zoning Ordinance.

the unit development plan.

property owners association in accordance with the requirements
of Condition 10 as stated above.
17. The CC &R's shall be -subject to the approval of the City Attorney prior
to the adoption of the PUD rezoning and development plan and the
final map.

The requirements of the California Environmental Quality Act
Guidelines - have' been satisfied and as recommended by - the City
Planning Commission at its meeting of February 27, 1984, hereby
incorporates by reference the Negative Declaration adopted by the City
Council on March 19, 1984, by Resolution No. NCS.

1. Consideration of_ appeal of staff denial of, parcel map._
(This was not a public hearing).

A motion was made by Commissioner Head and. seconded by Commissioner
Read to recommend to the City Council upholding the appeal of the
subdivider per the three conditions listed in the staff report.
Conditions:

1. The dedication of land shall be made for utility easements and street
rights -of -way as required for Casa Grande Road with approval of the
City Engineer.
2.. Engineering Plans and specifications and construction of complete
half - street improvements for the Casa Grande Road frontage shall be
required at such time as Parcel 1 or Parcel 2 is developed or divided.
3. Parcel 1 of the Malnati's Parcel Map shall be merged with Parcel 1 of
the recently approved parcel map No. 191 which splits the lands of
William Hartman.

A motion was made by Commissioner Read and seconded by Commissioner
Sobel to recommend to the City 'Council approval of a negative declaration :'x -
based on the two findings in the staff report.
1. No significant environmental impacts have been identified with the
project.
2. The project-is consistent with all applicable General Plan /EDP policies
and land use designations-; and the proposed pre - zoning designation is
compatible with the General Plan.

A motion was made by Commissioner Head and seconded by Commissioner
Serpilio to recommend to. the City Council approval:: of prezoning of
Assessor's. Parcel Number 19- 232 -01 to R - 6,500 based on the, findings in
the staff report.

1. The proposed prezoning is consistent with the applicable provisions of
the General Plan /EDP.
.2. The prezoning will insure that the future annexation of the subject
properties will represent an orderly and logical extension of the City
Limits.
3. The project will not be detrimental to the health, safety or public
welfare of the Community or surrounding property, owners.

noticed'. The item was taken from the agenda and the public hearing will

V. CAPRI CREEK. SUBDIVISION PUD REZONING., LEONARD JAY AND - T.
DEVELOPMENT,'. 423 NORTH 'MCDOWELL BLVD. (3.333)
1. Consideration of rezoning from R-1-6,500 (FP -C) and C -O (FP -C) to
PUD for 54 -unit condominium project.

A motion was made by Commissioner Read and seconded by Commissioner
Head to recommend to the City Council approval of a negative declaration
based on the-three findings in the staff: report.
1. Focused environmental studies have been completed, in the areas of
traffic, geotechnical and archaeology, and these revealed no significant
impacts of this development.

2. The project: complies with applicable policies .of. -the General.'..Plan /EDP
and requirements of the .Zoning Ordinance.
3. Potential environmental impacts of development will be mitigated by
conditions of approval of the rezoning.

7.9 acre portion. of AP No. 137- 060 -30, known as -Capri Greek,'. from
Sin gle-Family -.Residential/ Flood Plain Combining and Office Commercial . to
Planned Unit District based on the findings and . conditins of. staff
report with the discussed changes to Conditions 1, .2 and 4.
Findings
1. Said plan clearly results in a more desirable use of land and a better
physical environment than would be possible under any single zoning M
district or combination of zoning districts.
2. That any PUD District is proposed on property which has - .a -suitable
relationship to one (1) or more thoroughfares; and ' that said
thoroughfares are adequate to carry any additional- traffic generated
by the development.
3. That the plan for the proposed development presents a unified and
organized arrangement of bui °ldings, and service facilities- which are
appropriate in relation to adjacent or nearby properties and that
adequate landscaping and /or' screening is included if necessary to
insure compatibility.
4. That the natural and scenic qualities of the site are protected, with
adequate available public and private spaces designated, on the Unit .�
Development Plan.
5. That the development of the; subject property, in the, manner proposed,.
by the applicant, will not be detrimental to the public welfare, will be,
in the best interests of the City and will be in keeping with the
general intent and spirit + of the zoning regulation of the City of .

Environmental. Design Plans adopted by the City.

3. The multi -use area shall be re- located along Capri Parkway.
4. Paving materials used for .parking cut -outs and the so- called "soft
pathways" along the private streets shall be j Akkd l "f1/ ltluhtfl /1GYddk
subject to the approval of SPARC.
5. The sidewalk along Capri Parkway shall be redesigned to undulate
G) through the . adjacent landscaped areas to establish a -more informal
0 pathway as well as provide landscaped areas (and particularly trees)
closer to the street. In addition, contrasting paving stones or
textured concrete shall be used to demarcate crosswalks on private
streets subject to the approval of SPARC.
6. The design. and materials • of the. play - structure in the multi -use area
shall subject to: approval of SPARC.
7: Building architecture, exterior materials and colors shall be subject to
approval of SPARC.
8. Landscaping and irrigation design and materjals shall be subject to
approval of SPARC.
9: Driveway lengths shall be either less than 'five C5' feet or greater
than twenty (20 feet so that cars are discouraged from being parked
in, too short drives or have sufficient room to park in a driveway.
10. The project CC & R's shall include the following provisions:
1. Garage conversions are prohibited.
2. No recreational vehicles, boat trailers. 'or. .disabled vehicles are
permitted in private open parking areas `or common parking areas,
except temporarily areas expressly designated -'on approved unit
development plan or driveways and then not to exceed 48 hours.
3. Home occupations . permitted subject to the regulations of . the
Petaluma City Zoning Ordinance and provisions of the CC & R's.
4. All landscaping and irrigation systems in the public right -of -way
and in common parking or yard areas shall be maintained by a
homeowners association, and shall be designed and 'maintained to
standards acceptable to the City of Petaluma.
11.. The CC & R's shall be approved by City staff prior to - approval of the
Final Map.
12. The project shall pay flood mitigation fees subject to the provisions of
the .Petaluma Municipal Code.

13. The project sponsor shall be required to pay low and moderate income
housing in -lieu fees of an amount to be determined according to. the
schedule established by City Council Resolution No. 84 -199 N.C.S., or
make alternative arrangements to meet the low and 'moderate income
housing provision requirements of the Housing Element subject to
approval of the City and prior to approval of the Final Map.
14. The developer shall provide an engineered - detail showing. that , " taridard
cars or trucks can routinely move in and out of the L- shaped
driveways shown for some units.

Note: This vote does not constitute approval. At - a future meeting, -the
Council will consider the proposed rezoning. The two Commissioners voting
noe wished to note for the record that their disagreement with Condition 3,
the reversal of the park area location, was the reason for their noe votes,.

Conditions:
1. The accessory dwelling is subject to SPARC review.
2. Shall vacate dwelling until Condition No. 3 is completed.
3. T;he access_ ory dwelling is subject to inspection by - the Building'
Department and must secure any additional permit, complete additional
improvements required by the Building Inspector . and pay applicable
utility or other fees as determined by the Building Inspector prior to

1. Consideration of appeal of administrative decision to deny
reestablishment of a discontinued non - conforming use.
This item was not a public hearing.
Speakers: The appealant, Steven Shain, spoke in his behalf.
A motion was made by Commissioner - Head and seconded by Commissioner
Serpilio to deny the appeal but to recommend' that City Council reassess the
zoning. ordinance policy toward current non - conforming land uses.

MOTION
In order to uphold the basic underlying principles of the Zoning Ordinance
and insure a consistent policy' toward phaseout of non - conforming land uses
and occupancies, the appeal is hereby denied.
AYES: 5 NOES: 0 ABSENT: 2 (Libarle, Perry) .
The Commission also directed staff to pre-sent for Commission consideration
options for Zoning Ordinance amendments to revise phase-out of
nonconforming use regulations.
