(Mini- Market, Delicatessen, 1.449) , vote was corrected to: AYES: 4, NOES: 1, ABSENT: 2 ( Libarle, Perry). CORRESPONDENCE Handout was given to Commission re: Adoption, City of Novato adult entertainment controls. DIRECTOR'S REPOR Director briefly discussed- court decision re: Sonoma Highlands. Director advised that applicant fore Agenda Item No. VI - Mr. Ken Frankel requested a continuance. COMMISSIONERS' REPORT Councilman Tencer was welcomed'back to service on the Commission. Q. 2. Consideration of Rezoning from C -O (administrative - . and professional office district) to PUD (planned unit district).. 3. Consideration of tentative map for eight -unit office complex. The. public hearing was opened. SPEAKERS: Emil Mogel - Mogel Engineering, applicant's representative. Comments re: Condition 8 of PUD. The public hearing was closed. A- ;motion was made by Commissioner Head and seconded by Commissioner Sobel to recommend to the City Council approval of a Negative Declaration subject to the findings in the staff report. AYES 7 NOES: 0 ABSENT:, 0 Findings For, The Negative Declaration 1. As the project is, at this time., built with applicable landscaping ; , drainage • system, parking and structures, it Js not • expected that an adverse impact will be . experienced in the areas of air pollution, wind or water erosion, absorption rates, plant; animal or wildlife, noise- levels,, transportation, health, safety and/or" general welfare, of those .working or living in the neighborhood. 2. Traffic circulation pattern impacts will be mitigated by conditions of tentative map and PUD rezoning approvals. A motion was made. by Commissioner Head and seconded by Commissioner Libarle: to recommend to the City Council approval of the proposed PUD rezone for this project subject to the findings and conditions in the staff report. AYES: 7 NOES: 0 ABSENT: 0 A motion was made by Commissioner Libarle and seconded by Commissioner Head to recommend to the ; City Council approval of the Tentative Map for this project subject to the 'findings and conditions in the •staff report. AYES: 7 NOES: 0 ABSENT: 0 FINDINGS FOR PUD: 1. That the plan results in a more desirable use of land than would be- possible under any single zoning district. 2. The P.U.D. is proposed on property which has a suitable relationship to one (1) or more thoroughfares; and that said thoroughfare is adequate to carry the traffic currently generated by this project. That the existing development presents a unified and organized arrangement of- buildings which are appropriate in relation to adjacent or nearby properties and that adequate landscaping and /or screening is included to insure , compatibility. 4. That the natural. and scenic qualities of the site are inapplicable in this case. 5.r That the conversion- to condominium units, as proposed by the applicant, will not be detrimental to the public welfare, will be in the best interests of the City and will be in keeping with the general 2. Appropriate signing and pavement marking shall be installed to clearly identify the east side driveway as RENTER - ONLY" ' as originally designed, to the satisfaction of the City Engineer. 5. The site is physically suitable for this type of- conversion. 4. The proposed map, -subject to the following ;conditions, complies - with the requirements of Petaluma' Municipal Code Chapter 20.16 and the Subdivision Map Act. CONDITIONS FOR PUD 1. Conditions, covenants and restrictions shall be. prepared and shall be. subject • to review and approval by the Community Development and Planning Department and the - City -Attorney • ;prior to Final Map approval. 2. Committee (SPARC) . 8. The project shall comply with all requirements as set forth by the Building Inspector, subsequent to the completion of an on -site inspection (cost to be 'borne by the applicant), prior to approval of the 'final map. The public hearing was, closed. �_d A motion was made by Commissioner Libarle and seconded by Commissioner Head to to recommend to the City Council adoption of the :Petaluma Municipal Airport Planned Community `Development Zone and associated District Regulations based on the amended findings in the staff report and' with the three changes to the Zoning District Regulations report as listed below. AYES: 6 NOES :" 1 (.Serpilio) ABSENT: 0 Changes -to the Zoning District Regulations report: 4 197 1. Area on north side:.and at ends of runway designated "Operations" to be redesignated as an . approach protection". 2. Clarify aviation subzone storage areas to specify no new airport related storage. 3. Delete the words "Facing public streets" in paragraph 1, sentence 2, under,-'K. DESIGN GUIDELINES', page 8 Staff Report Findings: 0 1. That the development proposed is in substantial harmony with the General Plan of the City of Petaluma, and is or can be coordinated 00 with existing and planned development of ;the surrounding areas. U 2. That the streets. and thoroughfares proposed are suitable and adequate to serve the proposed uses and the anticipated = traffic which will be generated thereby. 3. The. facts submitted with the application and presented at the tiering„ establish that the airport PCD meets the . general provisions of Section 19 -200 of the Zoning Ordinance. 4. SPEAKERS: Jerry Evans - National Advertising Company, applicant representative. Jim Cook - 812 Sartori, concerns re: too .many billboards. The public hearing was closed. A motion was made by Commissioner Head and seconded by Commissioner Serpilio to approve the use permit based on the following findings : - 1. ..The proposed sign and sign location is not _ contrary to the goals and policies of the General Plan and Environmental Design Plan. 5 'e; i 2. The proposed sign is not detrimental to the public health., safety and general welfare and it would not detract from the attractiveness and orderliness of the City's appearance and detract the vision motorists in a detrimental manner. AYES: 2 NOES: 5 ABSENT: 0 A motion was_ made by Commissioner Read and seconded by Commissioner Libarle to deny the use permit based on the findings in the staff - report._ -:. AYES: 5 NOES: 2 ABSENT: 0 Findings 1. The proposed sign and sign location is contrary to, the goals and policies of the General Plan and Environmental Design Plan :because it -77 would, detract from the attractiveness of a City gateway, the Lakeville K.= Highway corridor, g 2. The' proposed sign is detrimental to the public health, safety` and general we because . it would detract from the attract_ iveness and - orderliness of the City's appearance and detract the vision of motorists in a detrimental manner. IV. CAPRI CREEK SUBDIVISION 'TENTATIVE MAP, LEONARD JAY AND T DEVELOPMENT, 423 NORTH MCDOWELL BLVD. (3.333) . 1. Consideration of tentative map for 53 -unit condominium project. . The public hearing was opened. 3. 4. The proposed sign is located so as to have the advertising thereon viewed._pr-imarily from a main traveled roadway, of a landscaped freeway or the ingress or egress ramps thereto. No Conditional Use Permit may be granted for the proposed outdoor advertising structure pursuant to Zoning Ordinance Section 26 -505, because it does not conform to, the requirements or intent , of the Zoning Ordinance and the Petaluma General or Environmental Design Plan pursuant to Zoning Ordinance Section 26 -505. A - motion was made by Commissioner Libarle and seconded by Commissioner. Head to - suggest that the City Council' consider a partial credit of -impact fees toward off -site improvement costs for McDowell. AYES: 5 NOES: 1 (Serpilio) ABSTAIN: 1 (Tencer, further I 6 consideration at Council) . NOTE: Commissioner Serpilio voted -to, abstain, then. voted noe when informed he could only abstain if there was a financial conflict of interest. A motion was made by Commissioner Head and seconded by Commissioner Sobel, , to recommend to the City Council approval of the Tentative Map for Capri 'Creek based on the findings and conditions listed in the staff report and the letter from the City Engineer with recommendations as listed. AYES: 6 NOES: 1 ( Serpilio) co Staff Report Findings U 1. The proposed subdivision, together with provisions for its design and improvement; is consistent with the General Plan. i 2. The proposed. subdivision . is compatible. with the objectives, policies, general land uses, and programs specified in said General Plan. 3. The site is physically suitable for the type of development proposed. 4. The site is physically suitable for the proposed density of development. 5. The design of the Subdivision and the/ proposed improvements therefore will not cause substantial environmental damage, and no substantial or avoidable injury will occur to fish or wildlife or their habitat. 6. The design of the Subdivision and the type of improvements will not cause serious public health problems. 7. The design of . the Subdivision and the :type - of improvements proposed will not conflict with easements, acquired by the : public at large, for access through or use of property within the :. proposed subdivision. 8. The discharge of waste from the proposed subdivision into the existing community sewer system will not result in violation of, the existing requirements prescribed by the Regional Water Quality Control Board Conditions 1. Tentative map approval is subject to approval of the PUD rezoning by the City Council. 2. The tentative map shall be revised to include all changes recommended by the conditions of approval of the PUD rezoning. 3. A revised - sepia of tl e_ tentative map,_ reflecting all - applicable conditions of the tentative map and the' PUD' rezoning shall "be submitted to the Community Development and - Planning Department within 60 days following approval by the City Council. 7 01 4. The- comments of the . City Engineer as set forth in the letter dated January 3, 1985, shall become conditions of approval of the tentative map. - PLANNING MATTER: V. DISCUSSION OF POLICY ON EXPANSION OF NONCONFORMING USES AND EXPANSION OF CONDITIONAL USES. THIS PLANNING MATTER WAS CONTINUED TO THE JANUARY 22, 1985 MEETING. PUBLIC HEARING: VI. A motion was made by Commissioner Head and seconded by Commissioner Libarle to continue action on this item per the applicant's request to the - Planning Commission meeting of 22 January, 1985.
