A. motion was. made by Commissioner Libarle and- seconded by- :Commissioner Serpilio to approve the issuance of a mitigated - negative declaration per the findings in the staff report. AYES: 6 NOES: 0 ABSENT: ,i (Head) Findings for EIQ: , a. The project as conditionally approved does not have, the ;potential to degrade the quality of the environment., substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or, animal or eliminate 'important examples of the major periods of .California history or prehistory. b. The project as conditionally approved does not have the potential to achieve short- term, to the disadvantage of long -term, environmental goals. C. The proposed structure and use, as conditionally approved, conforms to' the requirements , *and intent of the Petaluma Zoning Ordinance and General Plan/EDP. 00 2. Relocation of the existiing coin shop within the proposed building does not constitute an_, 'expansion, extension or movement of this pre- existing non = conforming use. Conditions For Use Permit 1. Each ingress /egress*,. driveway to Petaluma Boulevard will - be widened and improved to accommodate two -way traffic to the satisfaction of the City Engineer. 2. The easternmost ingress /egress to Petaluma Boulevard shall be further removed from the adjacent driveway to the Veterans' Memorial Building to the satisfaction of, City Engineer. 3. All parking areas shall be lighted to City standards. The design of all exterior lighting s,'subject to SPARC approval. 4. All exterior doors ; shall remain . closed (i.e. --doors shall not be propped open for' ventilation or other. purposes) . No public doorways shall be located on the-building's western elevation (access to screened nursery area and emergency - exits excepted) 5. A soils and grading /drainage report shall be prepared by the applicant and be subject to approval by the City Engineer prior to issuance of building permits. 6. From the Fire Marshal: a. Addition shall be equipped with an approved automatic fire sprinkler system in accordance with Section 10.309A of the Uniform Fire Code. (See attached) . b. Two on -site fire hydrants shall be provided.. Located as marked on site plan, at N.E. and S.E. corners of building. C. Fire flow 1,500 GPM required from two hydrants ( 750 GPM each) at 20 psi minimum residual pressure uniform. i 3 236 d. Building would be required to be completely 'protected by. fire sprinkler system in order to accommodate 43,070 square feet area." 7. All existing and future, roof or ground mounted mechanical equipment shall be fully architecturally screened subject to review_ and approval of SPARC. 8. Barriers shall be designed, subject to SPARC approval, to prohibit vehicular access to the unimproved portions of the site, '. including access from the Veterans' Memorial Building parking lot. 9. All areas used for driveways and parking shall be fully paved, paving to be repaired where deteriorated. The edge of all paving shall be curbed per SPARC standards. 10. A solid heavy wood. fence_ six . feet high shall be installed along the entire western property line from the southernmost, portion of ° : m . . residential properties abutting the property site to Petaluma Boulevard- - _ - right -of -way, except that said fence shall step down.. to 42 • inches. height in the northernmost 20 feet of the property. Said fence is subject to SPARC approval. 11. A landscape plan shall be prepared for SPARC'.review. Said plan shall depict heavy screening treatment along the western property line and behind the building. 12. All planting shall be maintained in good growing condition. Such maintenance shall include,, where appropriate, pruning, mowing, weeding, cleaning of - debris . and trash, fertilizing and regular watering. Whenever necessary, planting" shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements., " Required irrigation . systems shall be ..fully maintained in sound operating condition with heads periodically cleaned' and replaced when missing to insure continued, regular watering of landscape areas, and health and vitality of landscape materials. =a 13. At least one security guard shall be retained on the premises Saturday and Sunday morning_ s between the hours of 2:00 AM and 6:00 AM. Said guard shall prohibit whenever possible ' loitering, littering, exhibitions of speed, driving of unauthorized vehicles on unimproved portions of the site, and other undesirable or deleterious activities on the grounds. This guard(s) is to be in addition to the two guards normally employed from 8:00 PM and 2 :00 AM Fridays and Saturdays. The security situation shall be reviewed at end of six months 14. Any ex_ pansion to any of the uses described herein or uses shown in the submitted plans are subject to review of this use" permit by the Planning Commission. '15.• Uses within the "rentable space" portion of the new " building shall comply with the regulations of the C -H zone district as determined by the Director of Community Development. 1. � I 4 fV 237 16. A minimum 10 foot wide landscaped area shall be provided between the 4 paved portions of the parking lot and Petaluma Boulevard with 20 foot wide area adjacent to each ingress /egress to maintain stacking ability. The property owner shall maintain all landscaping within the public right -of -way. A . maintenance agreement with the City shall be recorded with the property deed for such areas. Landscaping shall be t: appropriate for a major entrance to the City and be subject to SPAR 6 review. 17.. During the course of development, if archaeological materials are found, all work in the vicinity of the find(s) shall be stopped and a qualified archaeologist contacted to evaluate the materials and make ' recommendations for mitigation as deemed necessary. 18. This use permit is subject to review by the Planning Commission one year from date of occupancy of the expanded facility or at such time as the Commission determines review is necessary in order-to preserve the peace, safety, and welfare of the neighborhood. At this time, conditions of approval may be added or modified, ` including review ana possible limitation of hours of operation 22. The rear parking area shall be chained off from public vehicular access in the evening and nighttime hours. The parking area located to the rear of the building shall not be striped until required by the '.° Director of Community Development or the Planning Commission. 23. Full frontage improvements (e.g., subterranean drainage, etc.) are required to the satisfaction of the City Engineer. A motion was made by Commissioner Read and- seconded by_, Commissioner Sobel to recommend to the _City Council approval of a negative declaration based on the findings in the staff report. AYES: 6 NOES: 0 ABSENT: 1 (Head) Findings 1. The project is consistent with the applicable provisions of the zoning ordinance and the General Plan /EDP. 2. The subject subdivisions are completely built -out so _ there will be -- no change in land use; and the development- standards will mitigate any potentially significant environmental effects. A Motion was made by Commissioner Read and seconded by . Commissioner Sobel to recommend to the City Council that it rezone the area known as Westridge Unit III from . PCD to PUD and that it adopt. „the respective amendments to the PUD Unit 'Development Plans for Westridge I, .II and -III, Shelter Hills I and` Village East ,I and II based on the findings and subject to the conditions listed in the staff report. AYES: 6 NOES: 0 ABSENT: 1 (Head) Findings I. Said plan clearly results in a more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of districts. 0 239 2. The P.U.-D. District is proposed on property which has a suitable relationship to one (1) :or more thoroughfares; and said are adequate to carry any additional traffic generated by the development. 3 The plan for the proposed development presents a unified and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent properties, and adequate landscaping is included to insure compatibility. 4 The natural and scenic, qualities of the site are protected with adequate available public and private spaces designated on the Unit Development Plan. 5.: The development of the subject property, in the manner proposed (., by the applicant,. will not be detrimental to the public welfare, co will be in the best interests of the City and: will be in keeping with the general ..intent and spirit of the • zoning regulation :of the City of Petaluma,: with. the Petaluma General - Plan,• and with the Environmental Design Plan: Conditions 1.F All original conditions of approval of the existing PUD unit development plans shall be re- adopted as part of this development plan amendment. 2. The proposed project, site plan, building elevations; and landscaping shall be subject to ;SPARC approval in accordance with Section 26 -400 of the Zoning Ordinance. All conditions of. design approval shall become conditions of the use permit. 2. Site plan for proposed project shall include sturdy , fencing for sound reduction along rear property lines facing residential areas to staff approval. 8 3. Any proposed use of the remainder of the proposed building must be such as to be compatible in nature to the gymnastics school including no uses which involve. hazardous substances or hazardous operations which could negatively impact the people- oriented operation of the gymnastics school. 4. The rezonings will not result in a more intense use of the land that would lead to any significant environmental impacts. 2. The rezonings are consistent with all applicable General Plan policies and land use designations. A motion was made by Commissioner Sobel and seconded by Commissioner Read to recommend to the City Council that Assessor's Parcel Numbers 8- 151 -4, 13 and 14 be rezoned from PUD (Planned Unit District) to R- 1- 6,500 (Single - Family Residential) .
