APPROVAL OF MINUTES Minutes of the April 23, 1985 meeting were approved as written. CORRESPONDENCE None. DIRECTOR'S REPORT The Shelter Hills Village project failed the Technical Rating Committee; it will be on the Council agenda for May 20. There is a General Plan map included with all Commissioner's packets for this meeting. Planning staff will send a map copy to the public library. COMMISSIONERS' REPORT: The mayor and Commissioner's Hilligoss and bead attended the County meeting regarding the Golf Course project. NOTE :. A . motion was made by commissioner Head and .seconded by Commissioner Libarle to direct staff to prepare a negative declaration for the project based on the four findings in the staff report. AYES: 6 NOES: 0 ABSENT: 1 (Serpilio) Findings a. Due to the developed nature of the existing site, the' project does not have the potential to degrade the quality- of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self. sustaining levels;, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered, plant or . animal or eliminate important examples of the major periods of California history or prehistory. b. The project, as conditionally approved, does not have the potential to achieve short - term, to the disadvantage of long -term, environmental goals. - . C. Because the proposal does not include additional phased development,.'. the project as conditionally approved, does not have impacts which are individually limited, but cumulatively considerable. i d. The project, as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings either directly or indirectly. A motion_ was made by Commissioner Head and seconded by Commissioner Libarle, to recommend approval of a use permit subject to the .findings . .and conditions in -the staff report as amended. AYES: 6 NOES: 0 ABSENT: 1 (Serpilio) Findings 1. The proposed structure and use, subject to the conditions of approval, conforms to the intent and requirements of the Zoning Ordinance, the General Plan, and EDP. 2. This project will not constitute a nuisance or be detrimental to the public welfare of the community due to the ° mitigation measures incorporated in the conditions of approval. Conditions: 1.. No outdoor storage of automobiles in visible need of repair, auto parts, cartons or other materials are allowed. 2. Operating hours are limited to 9:00 AM to 5:00 PM, Monday through Saturday. 2 273 3. This use permit shall be recalled for review -by the . Planning Commission at any tim6 due to complaint or apparent violation of the zoning ordinance, municipal code, or these conditions of approval. After such review, these conditions may be modified or new conditions may be imposed. 4. A motion was made by Commissioner : Sobel and seconded by Commissioner Head to recommend to the City Council conditional approval to the .PUD development plan based . on • the findings and subject to the conditions ..in the staff report as amended. . AYES:. 6 Findings NOES: 0 ABSENT: 1 (Serpilio) 1. The revised plan clearly results in a more desirable use of land and a better physical environment. 2. The revision will not affect the finding that the originally approved . PUD District is proposed on property which has a suitable relationship to one (1) or more thoroughfares; and that said thoroughfares are adequate to carry any additional traffic generated by the development. The revised plan for the proposed development presents a unified and organized arranggment__of buildings and service facilities which are appropriate in relation z to adjacent __or - near -by - properties and-- -that adequate landscaping and /or screening is included if necessary to insure compatibility. 3 274 4. The natural and scenic qualities of the, site - are :- protected, with adequate available public and private spaces designated .on the revised Unit Development Plan. 5. The development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare;, will:.be in. the best interests of the City and' will be in keeping. with he - general intent and spirit of the zoning regulation of the City of Petaluma, with the Petaluma General Plan; and with the E_ nvironmental. Design Plan adopted by the. City. Conditions 1. Setbacks: a. For units with garages: front, set_ back form lot line shall be a minimum of ten (10) feet or twenty .(20) feet or greater. b. For units: with carports with entry steps located in carport area: Carport/ driveway depth shall be a minimum of forty feet long by twenty feet wide t permit at least three off - street parking spaces - in accordance with City standards. Carports without-entry try steps shall either maintain a front setback of ten feet or sufficient setback to achieve an overall length of forty feet. or more, .from the lot line c. In no case shall residential units be located closer than ten feet from front lot line. d. In no case shall a parking structure be located less than three feet from side lot line. e. Carports shall be redesigned to the approval of SPARC with special emphasis on restoration of architectural detail similar to the design approved in the 1983 plan. 3. Maria Drive improvements, landscaping areas and masonry.. wall -to - - match McDowell shall be complete within two years or at such. time ' as Maria. Drive is constructed between project and Sunrise Parkway, whichever occurs first. Bonding for said improvements in the interim is required 2'7.5 4. Revised site plan, landscape and irrigation plans and architectural drawings shall be submitted to SPARC for . approval within thirty days after approval of the PUD development plan revisions by the City Coun cil . 5. All previous conditions. of approval not modified by the preceding conditions shall remain in force. 6. Developer "shall utilize alternative garage roof design to provide architectural appearance variations on Lots 61 through 79. 7. Any modification to' the exterior of this historic building shall be subject to Historic and Cultural Preservation Committee Review according to Section 26 -401 of the Zoning Ordinance. - 2. A motion was made by Commissioner Libarle and seconded by Commissioner Head to direct staff to prepare a mitigated negative declaration based on (� the findings in the staff report. AYES: 5 NOES: 0 ABSENT: 2 (Serpilio, Read) Findings I 1. The project as conditionally approved does not have the potential to substantially degrade the quality of the environment. Given the location of the site, and its present use, no adverse _impacts are anticipated to . animal, plant, archeological value or long -term environmental goals. 1 2. The expansion project and its environmental impacts, as conditionally approved, will not cause adverse effects. on human beings through the- incorporation of specific mitigation measures set forth herein. A motion was made by Commissioner Lib.arle and seconded by Commissioner Sobel to grant the use permit based on the findings and conditions in the staff report as amended. AYES: 5 NOES: 0 ABSENT: 2 (Serpilio, Read) Findings 1. A motion was made by Commissioner Head and seconded by Commissioner Libarle , to approve the negative declaration for a modified rezoning action based on the findings in the staff report. AYES: 2 (Head, Libarle) NOES: 3 (Sobel, Tender, Hilligoss) ABSENT: 2 (Serpilio, Read) NOTE TO COUNCIL: The vote for the negative declaration was voted without.' any- specific project being presented. The . rezoning. will be continued to the Planning Commission meeting of June 11 with the applicant returning with a specific project. VIII. GP /EDP Planning Consultant Selection Sub - Committee.
