CORRESPONDENCE: None. DIRECTOR'S REPORT Mr. Salmons reported that - the 83 -84 SPARC design awards; are to be presented at the June 17 Council meeting. Mr. Salmons reminded Commissioners of the June 18 Technical Rating meeting. COMMISSIONERS' REPORT Commissioner Read distributed a report regarding the May 15 Commissioners Conference she attended in Sacramento. CROWLEY PREZONING (Continued from May 14), 510 CLEARVIEW PLACE, PORTIONS OF AP No's 019 - 120 -27 and 29. 1. Consideration of EIQ . 2. Consideration of prezoning a 1.01 acre site to R1 -40, 000. Note: This public hearing was closed at the previous meeting; however, two property owners were allowed to speak. SPEAKERS: Mr. Dennis Brogan - 420 Clearview Place - Stated that he was the property owner whose land contains the road easement. He spoke re: concerns about the anticipated heavier useage of the roadway. Dee Fedrick - 424 Clearview Place - Comments re: stop sign, speed bumps. Chairman Hilligoss requested a letter from the developer (Martin 1 WE • Gavriloff) to the property owners who will be affected stating what measures will be taken to alleviate any speeding problems. , A was: made by Commissioner Libarle and seconded by 'Commissioner Read to recommend approval of a negative declaration % per, . the -amended conditions and findings in the staff report. The project is consistent with all applicable General Plan and EDP policies and land use designations and the proposed zoning designation is compatible with the General Plan. A e motion was made by Commissioner .Libarle and seconded by ;Commissioner Read to recommend approval of the prezoning per the amended findings 'as follows: Findings 1. The proposed prezoning is consistent with the applicable provisions of the General Plan/EDP. 2.' The prezoning will insure that the future annexation of the subject property will represent an orderly and logical extension of the City. limits. 4 3.' The project will not be detrimental to the health, safety, or public welfare of the community or surrounding* property owners. 4. Applicant to supply letter of intent to affected - property I owners regarding speed mitigation measures to. be undertaken . on roadway easement. PLANNING MATTER II. CHEVRON USA, 4999 PETALUMA BLVD. NORTH, AP No. 07- 422 -32 (File 7.109) . 1. Determination on remodeling non - conforming service station use to self service gasoline and mini - market in Floodway Zone. General discussion was held . by the Commissioners.. Mr. Crispen - Chevron USA representative spoke regarding the operation of the food service area. A ..consensus vote was taken on-the following: "Is the proposed self - service station plus mini- market a "different use" from that of a full service station in the opinion of the Commission "? K 285 The consensus vote. was yes on- the above question A consensus vote was also taken on the following: "Is the proposed use of the same or of a more restricted nature than the existing full service - facility °? The consensus vote was that the building would be smaller and the use may be more restrictive. A motion . was made by Commissioner Libarle and seconded by Commissioner Hilligoss that the proposed use would be of the same or of a more Co restrictive nature. AYES:' 2 NOES: 3 ABSENT: 2 (Head, Serpilio) Motion was defeated'; hence the proposed - modification ..cannot be approved per Zoning Ordinance Section 25 -402. DISCUSSION ITEM III. MOBILEHOME REZONING 1. Discussion of informational report. A general discussion of mobilehome parks in Petaluma was held. Councilman Davis and Mr. Art Willis (Youngstown Mobilehome tenant) spoke. Staff was directed to gather information from other cities regarding mobilehome zoning. (The following item was listed as item no. 5 on the agenda) . PLANNING MATTER IV. DISCUSSION: SHELTER HILLS VILLAGE DESIGN - REFERRAL -FROM CITY COUNCIL. After a brief discussion by the Commissioners, it was decided that all members of the Technical Rating Committee who turned in scores on Shelter Hills Village would make written statements to be summarized by staff for the developer regarding their scoring. PUBLIC HEARING V. ZONING ORDINANCE TEXT AMENDMENTS. 1. General discussion regarding miscellaneous . --zoning ordinance text amendments. The public hearing was opened. 3 r-M There were no speakers. The public hearing was closed. A motion was made by Commissioner Sobel and 'seconded by Commissioner Read to recommend approval of a negative declaration per' the staff report. AYES: 5 NOES': 0 ABSENT: 2 : (Head, Serpilio)�_ -. Findings for Negative Declaration 1. The proposed amendments will have no significant adverse 'effects on the environment. 2: Special environmental affects applicable to a particular site . through the application of these changes will- have further environmental review on a case by case .basis. "bed and breakfast inns. rooming and boarding houses or lodging- houses. 1 for each guestroom plus . 1 additional space for the inn owner/manager. 1 for. each guestroom and 1 additional space for the resident owner/ manager. " Section, 3 . Article 21, Section 21= 204.4(D) of Zoning Ordinance No. 1072 N.C.S. is hereby amended as follows: . "D. Wall- Sign One (1) wall identification sign not directly lighted, not. exceeding twelve ('12) square feet in area on the site of a church, school, community center, bed and breakfast inn or other public or institutional building." Section 4. Article 21, Section 21 -409 through 21- 409.9 is hereby added to oning rdinance No. 1072 N.C.S. to read, as follow: 21- 409 .Bed and breakfast inns. Bed and breakfast inns as defined in Section 1 -203 are permitted as conditional uses in districts specified in Zoning Ordinance No. 10.72 N.C.S. 293 subject. to ; the provisions' .of Article 21 and Section 26 -500 governing conditional use - permits and . the following additional requirements and criteria: 21- 409.1 The inn owner or manager must reside at the inn. 217409,:'.2 Off - street parking shall be required at a ratio of one parking space ' =for each guest room plus one parking space for the _inn owner or manager- in -accordance with Article 20 of the Zoning Ordinance unless establishment is located in parking assessment district. 21- 409.3 Fire and life safety requirements may be imposed as a condition o� r use permit issuance including requirements for installation of approved smoke' 3detectors in each guest room, the installation of a fire extinguisher at the,; inn, the posting of an evacuation plan in each guest room, or an approved fire sprinkler system. co 21- 409:.4 The inn- owner shall. obtain. any required Sonoma County Health Department approvals., prior, to the. issuance -of the use permit 21- 4091 Low intensity on -site lighting be required as a `security and safety: Peasure . 21 7 4091 �6 No signs shall be permitted for inns located in an R (residential) district; excepting a wall sign as authorized in Section 21.404.4 (d) of the Zoning Ordinance.. 21- 409!.'7 Each use permit approval shall specify the maximum of rooms* which' be let to guests of the inn. • = - I __.t . - " - _- 21.409.;.8 No accessory use of . the inn is permitted except *as specifically authorized in the use permit,. For purposes of this section an accessory use of, an inn is any commercial use of the inn other than the renting of guest rooms and provisions of one meal per day to guests. Accessory uses includei but are not limited to use of the inn for conferences, weddings, fundraisers and similar events attended by non - guests: - The use permit may allow such accessory uses of the inn subject to restrictions, including but not limited to the frequency and timing of accessory uses, the maximum number of persons who can attend an event, and the provision of additional off- street parking. In determining whether to deny , permit, :' or conditionally permit accessory uses of an inn, the. general standards use permit issuance specified in Section 21.300 of the Zoning Ordinance shall apply. In addition, the following special standards and considerations are applicable: 1) whether the planned accessory use is compatible with the characteristics,: of the zone district and neighborhood where the - inn is located; 2) the availability of additional off - parking facilities for accessory uses; 3) whether off - street parking can be provided for accessory uses which will not alter the residential character of the inn in R (residential) districts; 4) the planned frequency and timing of accessory events; 5) the number of persons expected to attend the accessory events. 21.409.9 City Department may periodically conduct an inspection of an inn whi cF -been .issued a use permit during regular business hours to determine compliance with use permit conditions, the Zoning Ordinance and 0 r other applicable ordinances and laws they administer. A warrant shall be obtained when required b'- law. 4 Section. 5 . Article 7, Section 7 -400 of Zoning Ordinance No. 1072 N.C.S. is hereby amended by adding a new Section 7 -403 as follows: "7 -403 Bed and Breakfast Inn in accordance with the provisions =pf. ..Section 21 -409" . Section 6 . Article 8, Section. 8 -400 of Zoning Ordinance No. 1072 N.C.S. is hereby amended by adding a new Section 8 -410 as follows: "8 -410 Bed and Breakfast Inn in accordance with the 'provisions of Section 21 -409. " Section 7 . Article 12, Section 12 -400 of Zoning Ordinance No. 1072 N.C.S. =_ is hereby amended by adding a new Section 12 -411 as follows: "12 -411 Bed and Breakfast Inn in accordance with the provisions of Section 21- 409." - The public hearings were opened and the questions of ADULT ENTERTAINMENT and, TEMPORARY USESIZONIN:G .PERMITS were voted to be continued to the Planning Commission meeting of June 1985.
