The applicant's letter was read as ,part of staff's report to the Commission. The public hearing was opened. 'SPEAKERS: None. The public hearing was closed. A motion was made by Commissioner Head and seconded by Commissioner Woolsey to approve the use permit allowing an accessory dwelling subject to the findings and conditions listed in the staff report. AYES: 7 NOES: 0 Findings : 1. 'The - proposed accessory dwelling use, subject to - the conditions which . have been attached will conform to the requirements and intent of the Petaluma 'Zoning Ordinance. 2. The proposed accessory dwelling, as conditioned, will. conform to 'the :requirements and intent, goals .and .policies of the Petaluma General Plan/ Environmental Design Plan. 3. The accessory dwelling use, . as conditioned, will not under the �circums'tances of this particular case constitute a nuisance or be detrimental to the public welfare of the' community . Conditions 1. All changes, modifications or pursuant to this application shall be subject to review and approval of the Chief Building. Inspector -and Fire Marshall. -2. This use permit shall be of a temporary nature. The second kitchen and all plumbing and electric outlets thereto within the existing dwelling shall be removed whenever the need for the accessory. - dwelling no longer exists or whenever the applicant no longer occupies ;the principal dwelling, whichever occurs first. A restriction shall be recorded with the deed to the property requiring removal of the second kitchen prior to close of escrow in the event : the property sells. 3. Stated that applicant had no problems with the mitigation :measures in the draft EIR. Peter Murga - 1430 Pet. Blvd. S. - concerns re: entryways to project and rainwater runoff on :Pet. Blvd.; traffic problems. Chris Smith - 25 Cordelia .Dr. - concerns re: existing density, alternative uses. Julie Murga - 1430 Pet. Blvd. S. - concerns re: current over abundance of apartments, suggested senior citizen housing, concerned with children crossing Pet. Blvd. for school. :Mary Shearer- Concerns re: density, lack of free space, - changes in uses of Pet. Blvd. S., no views except industrial from hill, EIR geology section was not adequate. The public hearing was not closed. The Commission had the followin.g comments about the draft EIR: Section 4 -5 Traffic mitigation section should be expanded. Section 4 --13 More sewer treatment plant information needed. Section 4 -25 River at project site - more information on Corp of Engineers findings. Section 4 -,27 Erosion. information should be expanded on. Section 4 -44 Explanation on triggering mechanism of new animal control vehicle. Section 4 -12 Density information .needs clarification. Section 4 -16 More public spaces and river access - expansion of design access plans; concerns with structure to be located .on top of hill. EIR and Amendment to the Planning Commission meeting of November time responses to the Commission's comments will be reviewed. PLANNING MATTER: V. DISCUSSION: GENERAL PLAN CONSISTENCY CONCERNING THE' PROPOSED PURCHASE OF VACANT PROPERTY BETWEEN 125 AND 139 PETALU'MA BLVD. NORTH, AP NO. 06- 281 -39�.. After � J a brief discussion, a motion was made by Commissioner Head and seconded by Commissioner Hilligoss to find the acquisition of Assessor's Parcel l. 06- 281 -39 by the City of Petaluma to be in conformance with the goals ' and policies of the General Plan and Environmental Design Plan.
