Petaluma Planning Commission November 12, 1985
Regular Meeting 7:30 p.m.

PRESENT: Commissioners Head, Hilligoss, Libarle, Read, Serpilio,
Sobel, Woolsey
ABSENT: None.

APPROVAL OF MINUTES Minutes of October 22, 1985 were approved
with a correction to page 4 noting that the public Bearing for Item IV was
not closed.
CORRESPONDENCE None.
DIRECTOR'S REPORT Director Salmons reported that the General Plan
-community survey results from the Bay Area 'Council were available through
the Planning Department. Commissioners were asked to contact -staff if they
plan to - attend the 'Sonoma State Planning Workshop on 'Saturday, December
7. -Director Salmons advised that the Planning Department will be sending
out large numbers of sign abatement notices soon.

1. Consideration of request for a stay on tentative map expiration period,
to exclude period of litigation activity.
City Attorney Joe Forest discussed his answers to the two questions listed
in the 22 October staff report.
Tom Jones - (Brelje and Race) - applicant - answered Commission
questions .
A motion was made by Commissioner Woolsey and seconded by Commissioner
Head to deny without prejudice the stay request.

SPEAKERS: John Strong - applicant - answered questions from
Commission.
The public hearing was closed.
A motion was made by Commissioner Serpilio and seconded by Commissioner
Libarle' to recommend granting of a use permit per the findings and
conditions listed in the staff report as amended.

1. The proposed use is subject to the following conditions, will conform to
the intent of the Zoning Ordinance and the- policies of the General
Plan /EDP .
2. The proposed use, subject to the following_ conditions,, will not
constitute a nuisance or be detrimental to the public welfare of the
community.
Recommended Conditions.:
1. fences of the perimeter of the lot shall be repaired and /or replaced as
necessary to provide a solid six foot high privacy barrier to adjoining
lots . Design of fence subject to SPARC approval,.
2. The route of the access driveway shall be sited to preserve the
existing free standing garage and small evergreen trees and 31 foot
high cross fence so as to provide separation_ between the open space of
the accessory dwelling and the open space of the existing house,

6. A street tree shall be added in the planting strip to the southeast of
the existing driveway curb -cut. Species selection and planting detail
•subject to SPARC approval prior to issuance of a building permit.
1. The finish floor height of', the accessory dwelling shall be certified by
..a qualified engineer or land surveyor as a minimum of 12 inches above
the 100 7year flood height, per Section 16 -703.
8. The design of the accessory dwelling shall be more related to the
existing main dwelling including at least the provision of horizontal
siding and a minimum of 8 in 12 roof pitch design subject to SPARC
review.

Architectural Review Committee .( SPARC) before issuance of a building
„permit for this accessory dwelling per Zoning Ordinance Section

The public hearing was opened.
.:Speakers: Morice Frates - 16 Wallace Court complaints regarding condition
of the existing accessory dwelling, vehicles parked on
property. Presented letters from neighbors expressing
concerns about traffic, condition of existing accessory
dwelling. (Neighbor's letters - Fuller - 14 Wallace Court;
Gustatson - 15 Wallace Court) .
;George Bono - 21 Wallace Court - complaints regarding traffic
condition of accessory dwelling.
'Dalton Dillingham - applicant's son - spoke for his !father
!(Lorris) . Explained plans; reason for accessory dwelling
changes.
'Lorris Dillingham - applicant; answered questions.
The public hearing was closed.
A motion was made by Commissioner Libarle and seconded by Commissioner
Hilligoss to recommend approval of a use permit subject to the conditions
listed in the staff report as amended.

according to Section 26 -41 of the Zoning Ordinance.

2. The colors., exterior materials of construction, and trim details for the
proposed accessory dwelling shall match that of the existing building
subject to review and approval by SPARC.

shall be of divided light design.
4. The existing accessory dwelling shall be converted for non - residential
use, including the removal of plumbing fixtures, subject to staff
approval, and to be upgraded to match the entire structure

Findings
1. The proposed use, subject to the conditions of approval, conforms to
ithe intent and requirements of the 'Zoning Ordinance, the General Plan
and EDP.
2. This project will not constitute a nuisance or be detrimental to the
.public welfare of the community, due to the mitigation measures
incorporated in the conditions of approval.
Conditions
1. The project shall be subject to Site Plan and Architectural Review
according to Section 26 -41 of the Zoning Ordinance (note in the case
of only minor modification, this may be Administrative SPARC review) .
2.. The six -foot fence along the east property line shall be extended -to
the front building setback line, .i.e..., 10 feet from the front property
line.
3. Additional landscaped screening shall be installed as needed along the
west property line, subject to staff .approval.
4. Hours of operation shall be 8 AM - 5 PM, Monday through Friday with
evening meetings until 9 PM no more than 2 times per week.
.5. This Use Permit may be recalled to the Planning Commission for review
at any time due to complaints regarding traffic congestion, noise
generation or other potentially objectionable operating characteristics.
At such time the Commission may repeal the Use Permit or add modified
conditions of approval.
6. All conditions of the Building Inspector and . Fire Marshal shall be
complied with.
