The proposed project site plan, building elevations and landscaping shall be subject to SPARC approval in accordance with Section 26 -400 of the Zoning Ordinance. Consideration of PUD Zoning Amendment and Unit Development Plan. The public hearing was opened. SPEAKERS: Richard Lieb - Lieb and Quaresma, 1 Bodega - PEP representative. The public hearing was closed. A motion was made by Commissioner Sobel and seconded by Commissioner Head to recommend adoption of a mitigated negative declaration, recommend approval of a General Plan/ EDP land use designation modification from "Service Commercial" to Urban High Residential", and recommend the rezoning of the project site from R -1 6,500 to Planned Unit Development, based on the findings and conditions in the staff report as amended. AYES: 5 NOES: 0 ABSENT: 2 3 437 Findings for Negative Declaration a., The project does not have the potential to degrade the quality of the environment, substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drip below self sustaining levels, threaten to eliminate a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal or eliminate important examples of the major periods of California history or prehistory. b., The project does not have the potential to achieve short -term, to M the disadvantage of long -term, environmental goals. 00 c. The County of Sonoma has adopted a Finding of No Significant i Impact on the project after their environmental review. f. The development plan, as conditioned, contains adequate measures to mitigate potential adverse effects of noise, traffic, and security. Findings. for Rezoning a) Said plan clearly results in a. more desirable use of land and a better physical environment than would be possible under any single zoning district or combination of zoning districts. b) P.U.D. District is proposed on property which has a suitable relationship to one (1) or more thoroughfares; and that said thoroughfares are adequate to carry any additional traffic generated by the development. c) The plan for the proposed development, as conditioned, presents a unified and organized arrangement of buildings and service facilities which are appropriate in relation to adjacent or nearby properties and that adequate landscaping and /or screening is included if necessary to insure compatibility. d) The natural and scenic qualities of this urban site are protected, with adequate available public and private spaces designated on the Unit Development Plan. e) The development of the subject property, in the manner proposed by the applicant, will not be detrimental to the public welfare, will be in 4 W the best interests of the City and will be in keeping with the general intent and spirit of the zoning regulation of the City of Petaluma, with the Petaluma General Plan, and with the Environmental Design Plan adopted by the City. Conditions for Rezoning 1. The site plan, landscape plan, and building elevations are subject to review and conditional approval by SPARC. These plans, once approved by SPARC, shall become the PUD development plan for the project site. 2. Mailboxes are subject to approval of the Post Office. 3. The project shall meet State noise requirements for residential construction to the satisfaction of the Chief Building Inspector. Sound insulating walls and windows shall be installed on the, east side of the building units which parallel the car wash facility. Construction which allows placement of air conditioner units in residences backing to car wash with no further structural or electrical improvements shall be provided. 4. SPARC shall closely examine possibilities or increased social environment and outdoor areas for sitting or recreation. 5. An 8' sound absorbing (tongue -in- groove) fence along the eastern property line shall be installed subject to staff approval. 6. Trash bin area and screening shall be reviewed by SPARC. 7. Provide additional fencing to connect property line side fence to front of building units. 8. The sidewalk shall be repaired to staff satisfaction after construction but prior to occupancy. 9. Provide smoke detection device with p ilot light at or near entry door; supply approved heat detection system installed in accordance with NFPA, subject to approval of Fire Marshal 10. Exterior lighting on buildings and pathways to. be provided, subject to approval of Police Department. III. GREAT PETALUMA MILL, NORTHWEST CORNER OF "'B" STREET AND PETALUMA BOULEVARD NORTH, AP No. 8- 054 -05, (File 5.908C) . 1. Consideration of EIQ . 2. A motion was made by Commissioner Libarle to recommend preparation of findings in the staff report. Head and seconded by Commissioner a negative declaration subject to the AYES: 5 NOES: 0 ABSENT: 2 FINDINGS FOR THE NEGATIVE DECLARATION: 1. Asi : the project is, at this time, built with applicable landscaping, drainage system, parking and structures, it is not expected that an adverse impact will be experienced in the areas of air pollution, wind or' water erosion, absorption rates, plant, animal or wildlife, noise levels, transportation, health, safety and /or general welfare of those working or living in the neighborhood. 2. Impacts concerning soil stability along the waterfront, will be addressed through specific mitigation measures incorporated into the project. 3. The; proposed work will neither adversely affect the exterior architectural characteristics or other features of the landmark, its major interior architectural features, nor adversely affect the character or 'h ;istorical, architectural or aesthetic interest or value of the landmark and its site. A motion was made by Commissioner Head and seconded by Commissioner Serpilio ;to recommend approval of the proposed addition and facade modifications based on the findings and conditions in the staff report as amended. AYES: 1 5 NOES: 0 ABSENT: 2 FINDINGS FOR HISTORIC REVIEW APPROVAL: 1. The proposed work, as conditionally approved, will neither adversely affect the exterior architectural characteristics or other features of the landmark and its major interior architectural features., nor adversely affect the character or historical, architectural or aesthetic interest or value of the landmark and its site. 2. The proposed work, as conditionally approved, will neither adversely affect the exterior architectural characteristics or other features of the property which is the subject of the application, nor adversely affect its relationship in terms of harmony and appropriateness with its surroundings, including neighboring structures, nor adversely affect the character, or the historical, architectural or aesthetic interest or value of the district. I l; M CONDITIONS OF APPROVAL 1. All requirements as set forth by the Historical and Cultural Preservation committee will be incorporated into the project, except as amended herein. a. All construction shall be reviewed and approved by the City staff and Northwestern Pacific Railroad as to sensitivity to and compatibility with, existing improvements, facilities and railroad operations. All improvements shall respect dimensions of the railroad operating corridor. b. Window design shall echo the arched pattern on the adjacent brick wall. C. Decorative corner iron newel posts shall be provided along second story deck railing and "widows walk" trim, subject to review and approval of staff. d. All conditions of previous remodeling /reconstruction /additions, not in conflict with plans as approved by this proposal, shall remain in force and effect and shall be completed prior to occupancy of this addition. (e.g. Petaluma. Boulevard frontage wall facade improvements, alley design and improvements.) e. Riverfront area, located between the proposed addition and Steamer Gold outdoor eating area shall be cleaned up and improved with planters and benches or screened from access and view, subject to review and approval of planning staff. f. The tower and equipment shall be painted to match the addition as proposed prior to occupancy of the addition. g. The existing metal siding on the south elevation (over the "B" Street entrance) shall be painted a brick -like color, subject to review and approval by staff. h. All trees shall be a minimum fifteen gallon size, double staked; all shrubs shall be five gallon size. All landscaped areas not improved with lawn shall be protected with a two -inch deep bark mulch as a temporary measure until the ground cover is established. i. All plant material shall be served by a City approved automatic underground irrigation system. j. All planting shall be maintained in good growing condition. Such maintenance shall include, where appropriate, pruning, mowing, weeding, cleaning of debris and trash, fertilizing and regular watering.. Whenever necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements. Required irrigation systems 7 �I � shall be fully maintained in sound operating condition with heads periodically cleaned and replaced when missing to insure continued regular watering of landscape areas, and health and vitality of landscape materials. k. All outdoor mechanical equipment shall be fully visually screened upon installation subject to the approval of the Community Development Department. al IA l 1 1. Any outdoor advertising signs shall be submitted for review and approval of the Community Development Department. A sign program for the building shall be developed EjjE to issuance of a building permit. Signing shall conform to the City Sign Ordinance, and shall respect the historic nature of the project. m. The applicant shall comply with all applicable flood mitigation requirements adopted by the City Council. n. A trash enclosure screen shall be constructed, shall be protected from vehicular movements with minimum three foot wide curbed landscape buffers, and shall be designed to conform with all specification of the City Trash Enclosure Screen Design Standards. Location shall be adjacent to existing electric transformers and shall incorporate screening for the transformer boxes, subject to review and approval of staff. o. Lights shall be provided on the riverfront promenade and outdoor second story deck areas. Location and design of exterior lighting fixtures shall be shown on plans and be subject to approval of the Community Development and Planning Department. Such lighting shall be of a low level type and conform to the City's performance standards, and shall be of a design in keeping with the era and historic nature of the Mill. 2. Main structure rear parapet wall shall be faced with thin brick veneer, as previously approved by the Planning Commission in January, 1985, subject to approval of staff and SPARC 3. Condition ##7 of the H &CP Committee shall be amended to require metal siding on the south elevation (over "B" Street entrance) be replaced as necessary and painted to match new two -story addition siding material and color, subject to review and approval by staff. 4. The applicant shall comply with all applicable flood mitigation requirements adopted by the City Council. Refer to attached letter from the Sonoma County Water Agency. 5. Stamped concrete walkway surfaces and wood walkways shall be utilized along "B" Street and waterfront open areas as per Planning Commission approved plans of January 1985, subject to review by staff. �'j O IV. Consideration of rezoning from C -H (Highway Commercial) to C -C (Central Commercial) . The public hearing was opened. SPEAKERS: None. The public hearing was closed. A motion was made by Commissioner Head and seconded by Commissioner Serpilio to recommend the preparation and posting of a negative declaration based on the findings in the staff report. AYES: 5 NOES: 0. ABSENT: 2 Findings 1. The proposed rezoning does not have the potential to cause any adverse effects on human beings either directly or indirectly. 2. The proposed rezoning does not have the potential to achieve short -term, to the disadvantage of long - term, environmental goals. 3. An EIR was prepared and adopted for the General Plan /EDP land use designations. A motion was made by Commissioner Serpilio and seconded by Commissioner Sobel to recommend approval of the rezoning of the subject parcels from C -H to C -C based on the findings in the staff report.
